Terms & Conditions

   1. To be eligible to enter, individuals must rent any passenger or commercial vehicle from Europcar in Australia between 1 Dec 2010 and 11:59pm AEST on 31 January 2011.
   2. Individuals must then submit an entry, outlining in 25 words or less if they were an ogre, what would they love most about it?.
   3. To enter, entrants must then either:
         1. visit www.europcar.com.au follow the prompts to submit their entry and input the requested details by 11:59pm AEST on 31 January .
         2. write their full name, address, phone number and answer on the coupon provided on the Europcar Mirror Hanger and submit it to a Europcar branch by no later than 31 January 2011.

Additional Terms and Conditions

   1.      Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
   2.      Entry is only open to Australian residents aged 18 years or over who rent a vehicle with Europcar during the promotional period.
   3.      Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
   4.      The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
   5.      Incomplete, indecipherable or illegible entries will be deemed invalid.
   6.      Only one entry permitted per person.
   7.      If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
   8.      Promotion commences 1 Dec 2010. Entries close last entries received on 31 January 2011 at 5:59pm AEDST(for coupon entries) and at 11:59pm AEDST (for online entries).
   9.      The winner will be announced on February 7, 2011.
  10.      The winner will be notified by telephone and email.
  11.      This is a game of skill and chance plays no part in determining the winner.
  12.      The Promoter’s decision is final and no correspondence will be entered into. The winner will receive a trip for two (2) adults and two (2) children under the age of 13 to Surfers Paradise valued at up to AU$9,000 depending on date and point of departure. The prize includes return economy airfares from winner's nearest capital city in Australia. The prize includes seven (7) nights twin share accommodation at Centrepoint Apartments Surfers Paradise. Prize also includes, a one day (1) family theme park pass, eight (8) days car hire in an intermediate sized car, seven (7) lunches or dinners at Hard Rock Cafe Surfers Paradise and four (4) pieces of Hard Rock Cafe merchandise.
  13.      Additional spending money, meals, drinks, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges, telephone calls, mini-bar costs, in house movies, internet costs and all other ancillary costs are not included. All relevant airport taxes and government levies are the responsibility of the winner and will not be paid by the Promoter. Credit card payment is required at the time of booking for these airport taxes and government levies. The winner must request and organise their flights within 2 months of being notified as the prize winner. Prize must be taken by 06/02/12 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or peak periods including Schoolies 2011 (19 Nov-11 Dec11 inclusive).
  14.      Airfares element of the prize is as follows: Instant Purchase: Ticket issue must be same day as booking. Changes: On the day of scheduled departure, not permitted. Changes before the day of scheduled departure: A fee of $50.00 per passenger per ticket is applicable plus any Show Group fees. There may also be a difference between the original fare paid and your new fare that is payable at the time of this change. You cannot re-book and travel on the same day. Cancellation: Same day cancellation not permitted. Ticket value may be used towards payment of new travel on the initially booked airline network within 12 months of the date of the original ticket. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
  15.      The accommodation element of the prize must be taken in conjunction with the other prize elements (i.e. the flights & car hire), and may only be booked directly by Hard Rock, and is subject to availability. Winner may be required to present credit card at time of accommodation check in.
  16.      Lunch or dinner element of the prize is only to be taken at Hard Rock Surfers Paradise up to the value of $150 per day total. Any amounts over this value are to be paid for directly by the winner. No credits will be offered for any unused prize. Value is for food and non-alcoholic beverage only. Dine-in only. Meal prize is to be taken per day, eg not 2 meals in 1 day. Please present original of prize winner letter to Manager on Duty on arrival at cafe. Prize is for winning family only and non-transferable.
  17.      The merchandise element of the prize is to the total value of $120 and available from The Rock Shop at Hard Rock Café Surfers Paradise only. No credits for unused portion. Please present original prize-winner letter to Manager on Duty.
  18.      The Theme Pack element of the prize a one (1) x one (1) day Family pass (2 adults & 2 children 3-13 years inclusive. The winner has a choice of Gold Coast Theme Park options including Sea World, Movie World or Wet n Wild.
  19.      The car hire element of the prize is subject to standard rental conditions. Petrol and insurance is not included. The driver must have a current driver’s licence (in English) and be aged 25 years or over. If the winner is aged between 18 and 25, they will be permitted to take the hire car element of the prize, however, an age surcharge will apply and this cost will be the responsibility of the winner and will not be paid by the Promoter.
  20.      The ten (10) runner-up winners will receive a Shrek Forever After DVD - RRP $39.95
  21.      If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
  22.      In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
  23.      Any ancillary costs associated with redeeming the prizes are not included. Any unused balance of the prize will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
  24.      If for any reason a winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
  25.      If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  26.      Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  27.      Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28.      If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  29.      Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  30.      Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize .
  31.      As a condition of accepting the prize, the winner (and his/her companion, if applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  32.      The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
