Terms and Conditions

1.                  Information on how to enter and the Prizes form part of these Terms and Conditions.  Entry into the “Subscribe To An International Value Pack For Your Chance To Win 1 of 3 $3000 Flight Centre Vouchers” Promotion (“Promotion”) is deemed to be an acceptance of these Terms and Conditions.

2.                  Promotion commences on 1st December 2010 at 00.01hrs (AEDST) and ends on 31st December 2010, at 23.59hrs (AEDST) (“Promotion Period”).

3.                  Entry is only open to Australian residents who are existing Optus post-paid mobile customers. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.                  Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the entrant entering into this Promotion.

5.                  To enter, eligible entrants must subscribe to a $5, $10, $20 or $30 Optus International Value Pack (“IVP”) during the Promotion Period. Subscription to an Optus IVP is a month by month subscription.  Entry into the Promotion will be automatically awarded to the individual upon successful subscription of their IVP. Subscription to the IVPs is subject to the Promoter’s standard terms and conditions. For more information about the IVPs, individuals can visit www.optus.com.au/ivp.

6.                  Entrants must still have a valid Optus IVP subscription on 10th January 2011 at 14.00hrs in order to be eligible to claim a prize. For the sake of clarity, entrants who subscribed to an Optus IVP between 1st December 2010 and 14th December 2010 must sign up for at least two (2) months worth of Optus IVP during the Promotion Period.

7.                  Maximum of one (1) entry per customer for the duration of the Promotion Period is permitted.

8.                  Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

9.                  Incomplete or indecipherable entries will be deemed invalid.

10.               All valid entries received during the Promotion Period will be entered into the draw to be held on 10th January 2011 at 14.00hrs (AEDST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or an ineligible entrant is drawn.

11.               The first three valid entries drawn will each win a $3,000 Flight Centre voucher (“Prizes”). 

12.               All ancillary costs associated with redeeming the Prizes are not included. Redemption of the Prizes are subject to the standard terms and conditions of individual prize and service providers and any terms and conditions of the issuer including those specified on the Flight Centre voucher.  Flight Centre vouchers are redeemable with participating Flight Centre outlets, within Australia and are not redeemable for cash or travellers cheques. Each voucher expires twelve months from the date of issue. Any unused balance of a voucher (by the expiry date) will not be awarded as cash and will be forfeited. Where the cost of purchase exceeds the available voucher balance, the voucher holder will be required to make up the difference between the purchase price and the Flight Centre gift voucher balance. Participating Flight Centre outlets may not accept the voucher on a sale under $20. Flight Centre vouchers cannot be used for payment of credit or retailer accounts. Lost or stolen Flight Centre vouchers will not be replaced.

13.               Total Prize value in the Promotion is AU$9,000.00.

14.               In the event that for any reason whatsoever a winner does not redeem a Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited by the winner.

15.               Prizes (including any unused portion) cannot be transferred, exchanged or redeemed for cash.  The Promoter retains the right to substitute a Prize with a prize of equal or greater value (including where a Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.

16.               Winners will be notified in writing and by phone and their names will be published in The Australianon 20th January 2011.

17.               The Promoter may conduct a further draw at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park NSW 2113 on 11th April 2011 at 14.00hrs AEST, to award any Prize(s), if unclaimed, subject however to any directions from a regulatory authority. The winner(s) of the unclaimed prize(s), if any, will be notified in writing and their details will be published in The Australian on 18th April 2011.

18.               The Promoter’s decision in all aspects of this Promotion is final and no correspondence will be entered into, including but not limited to in the event of a dispute. The Prize must be taken as offered and cannot be varied.

19.               The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

20.               If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

21.               If a winner of a Prize is under the age of 18 years, the Prize will be awarded to the winner's nominated parent or guardian, on the winner’s behalf.

22.               The Promoter is not responsible for any incorrect or inaccurate information, either caused by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion.  The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

23.               If this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion (as appropriate), subject to any directions from a regulatory authority.

24.               It is a condition of accepting a Prize that the winner may be required to sign a release of liability in a form to be determined by and in the absolute discretion of the Promoter.

25.               Winners agree to participate in any news and media/PR activities surrounding the Promotion as reasonably requested by the Promoter. The Promoter reserves the right to use the winners’ names, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.

26.               Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a Prize.

27.               The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
