TERMS AND CONDITIONS

Member  must, during the Competition Period, visit the Program Website and in accordance with the directions at the Program Website, redeem five (5) of his or her Tokens (as defined in the Program Conditions) to purchase one of the three (3) official Aussie Celebration Wallpapers at the Program Website (a "Qualifying Purchase").


 Member will receive one (1) automatic entry into the Competition for each valid Qualifying Purchase. 

first valid entry drawn in the draw will win the prize ("the Prize"). The Prize is for 2 people and is valued at up to $5045.45 (including GST), depending on date and point of departure, and includes:

“COKE UNLEASHED – JANUARY & FEBRUARY 2011 – CRICKET PRIZE” COMPETITION CONDITIONS
Introduction

   1. The "Coke Unleashed – January & February 2011 – Cricket Prize" Competition (the "Competition") is conducted by Coca Cola South Pacific Pty Ltd, ABN 50 003 029 794 of Level 9, 40 Mount Street, North Sydney NSW 2060 ("Promoter").
   2. By participating in the Competition, individuals accept these conditions ("Conditions"). Information on how to participate and information on the prize form part of these Conditions. This Competition is run in conjunction with the "Coke Unleashed Program" (the "Program").
   3. All references to times and dates are to times and dates in Sydney, which may be Australian Eastern Standard Time ("AEST") or Australian Eastern Daylight Time ("AEDT") depending on the date.
   4. The word "including" means "including without limitation" and "includes", "included" and "in particular" are also to be understood as being without limitation.
   5. All references to dollars or "$" are references to Australian dollars.
      Eligibility
   6. 6. The Competition is only open to persons who:
         1. are "Members" of the Program; and
         2. are not:
               1. employees of the Promoter or the prize suppliers or any of their related bodies corporate; or
               2. a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of any such employee,
      ("Eligible Member"). The details on how to become a Member of the Program and the conditions for the Program ("the Program Conditions") are available at www.cokeunleashed.com.au ("the Program Website"). Eligible Members under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Member must read and consent to these Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement to evidence their consent to the Eligible Member entering this Competition, where the Eligible Member is under 18 years old at the date of entry.
      How to Enter
   7. The Competition commences at 0.00hrs on 11 January 2011 and closes at 24.00hrs on 28 February 2011 ("the Competition Period").
   8. To automatically be entered in this Competition, an Eligible Member must, during the Competition Period, visit the Program Website and in accordance with the directions at the Program Website, redeem five (5) of his or her Tokens (as defined in the Program Conditions) to purchase one of the three (3) official Aussie Celebration Wallpapers at the Program Website (a "Qualifying Purchase").
   9. The Member will receive one (1) automatic entry into the Competition for each valid Qualifying Purchase. The Program Conditions will apply to the Eligible Member's Qualifying Purchase. If any of the items identified in condition 8 are purchased by a Member from the Program Website before or after the Competition Period, an entry into the Competition will not be obtained as a result of the purchase.
      Prize draw & prize
  10. The draw will take place at Handling Matters, 1/3 Green Street, Brookvale, NSW, 2100 on 7 March 2011 at 11.00hrs.
  11. Subject to the verification process set out in condition 17 below, the first valid entry drawn in the draw will win the prize ("the Prize"). The Prize is for 12 people and is valued at up to $22,000 (including GST), depending on date and point of departure, and includes:
          * One (1) x night's twin share/double accommodation for 12 at the Four Points Sheraton or similar;
          * Round trip economy airfares for twelve (12) people (including airfare taxes) between the winner's nearest capital city and Sydney, NSW (if required);
          * Return transfers between airport and accommodation in Sydney (if required)
          * Return accommodation to SCG transfers in Sydney;
          * A guided tour of the SCG for twelve (12); and
          * A meet and greet and have a hit with, and get some tips from, three (3) Australian cricket players (the players are to be determined by the Promoter in its sole discretion).

      Prize Conditions
  12. The winner and their Prize companions must travel on the same flight together and sharing accommodation. The Prize cannot be separated into different holiday vacations. The winner and their Prize companions are responsible for making their way to and from their home to their nearest capital city airport. All passengers must travel together on the same flights and stay at the same properties in each destination. The winner and their Prize companions are responsible for any further costs associated with redeeming the Prize which are not otherwise specified in these Conditions, including but not limited to, food and beverage expenses, additional entertainment and/or miscellaneous expenses. For the avoidance of doubt, no additional "spending money" is included in the Prize. The winner and their Prize companions are responsible for obtaining any passports, visas, and vaccinations and their associated costs. The cost of any travel insurance is the responsibility of the winner and their Prize companions. It is a condition of taking the Prize that the winner and their Prize companions take out adequate insurance. The Promoter may request that the winner and their Prize companions provide evidence of such a policy before taking the Prize. The Promoter is not liable for any costs incurred if the winner and/or their Prize companions travel without insurance. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Once the booking is confirmed, changes will incur a fee of $150 per person, including GST plus supplier charges. No changes can be made to travel within 7 days of departure. Frequent Flyer points are not available from any airline. Travel suppliers/airlines to be chosen at the Promoter's discretion. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable. If the winner or any Prize companion is aged under 18 years of age, they must be accompanied by their parent or guardian as part of the 12 people who can attend the Prize. The Prize must taken by 29th February 2012 and cannot be taken during School Holidays, Christmas and other blackout periods, and is subject to booking and flights availability and the availability of the Australian cricket players and the SCG. Flights and accommodation are non-transferable and cannot be exchanged for other destinations or cash. No changes allowed. The Prize must be booked within 90 days of the original draw date (or the unclaimed prize draw date if the Prize is awarded via the unclaimed draw) and at least 60 days before departure. The Promoter will contact the winner to arrange a time when the Prize can be taken in consultation with the availability of the Australian cricket player and the SCG. If no one can agree on the dates for when the Prize must be taken, the Promoter will determine the dates in its absolute discretion. Winner will be required to sign a liability waiver form to accept the Prize. It is a condition of accepting the prize that the winner (and their Prize companions) must comply with all the conditions of use of the Prize and Prize suppliers' requirements.
  13. It is the responsibility of the winner and their Prize companions to ensure they are checked in for their flights, and arrive at the airport, at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with the winner or their Prize companions missing any of their flights.
  14. Total value of the Prize pool is up to $22,000 (including GST).
  15. The Promoter accepts no responsibility for any variation in the value of the Prize. If the Prize is unavailable, for any reason beyond the reasonable control of the Promoter, the Promoter may offer an alternative prize of equivalent value and specification, subject to any directions from a lottery authority.
  16. It is condition of accepting the Prize that the winner and their Prize companion must comply with all of the conditions of use for the Prize, and the Prize supplier's requirements.
  17. The Eligible Member whose entry is the first valid entry drawn is deemed by the Promoter to be the winner of the Prize, subject to verification ("the Provisional Winner"). The Provisional Winner (or their parent or guardian on their behalf if under 18) may be required to sign a deed of eligibility confirming that they have complied with the Conditions, and return this to the Promoter within the time specified on the deed, before the receiving the Prize. In addition, the Provisional Winner (or their parent or guardian on their behalf if under 18) and the Prize companions (or the companion's parent or guardian on their behalf if under 18) will be required to sign a deed of release, excluding the Relevant Parties (as defined below), from all liability in connection with the Prize to the maximum extent permitted by law, and return this to the Promoter within the time specified on the deed, before receiving the Prize. Notwithstanding the foregoing, the Promoter may refuse to award the Provisional Winner the Prize, if the Promoter has reason to believe that the Provisional Winner has not complied with these Conditions or the Program Conditions. If the Promoter refuses to award the Provisional Winner the Prize on the grounds identified in this condition, a new Provisional Winner will be drawn.
  18. Once a Provisional Winner and their Prize companions have satisfied the requirements of the Promoter's verification process under condition 18, and if the Promoter does not exercise its discretion under that same condition, the Provisional Winner will be deemed the winner of the Competition and the Prize will be awarded to them. The winner will be informed in writing by email, and if verified in time, on or before 9 March 2011. The winner will be published on the Program Website commencing on 16 March 2011 and, if the winner is from South Australia or Victoria, in The Australian on 16 March 2011.
  19. In the event that the Prize remains unclaimed or not won by 13 June 2011, all of the original Competition entries will be entered into an unclaimed prize draw. The unclaimed prize draw will take place at Handling Matters, 1/3 Green Street, Brookvale, NSW, 2100 on 14 June 2011 at 12.00hrs, subject to any written directions from a lottery authority. The Promoter reserves the right to draw reserves and record them in order drawn, and use them in the event that the Eligible Member first drawn or any subsequent reserve drawn at the unclaimed prize draw is ineligible to win the Prize, including for reasons set out in condition 18. The winner of the unclaimed prize draw, if one is required, will be informed in writing by email, and if verified in time, on or before 16 June 2011. The winner of the unclaimed prize draw, if one is required, will be published online at the Program Website commencing on 23 June 2011, and, if the winner is from South Australia or Victoria, in The Australian on 23 June 2011.
      General Conditions
  20. If for any reason the conduct or operation of the Competition or the Program is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right, subject to any written directions of the lottery authorities, to cancel, terminate, modify or suspend or recommence the Competition.
  21. If an Eligible Member tampers with, or subverts, the processes relating to participation in the Competition or the Program, or may benefit from such tampering or subversion by any other person, the Promoter reserves the right in its sole discretion to disqualify that Eligible Member from the Competition. The Promoter reserves the right to verify the details of the Eligible Member, and request identification to establish their age or identity.
  22. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of an Eligible Member's communications (including Token redemptions). The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any internet communication or telephone communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network, on the internet or at any website). To the full extent permitted by law, the Promoter is not liable for any injury or damage to any Eligible Member's (or any other person's) computer or resulting from or otherwise relating to participation in this Competition (including by downloading materials relating to this Competition).
  23. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
  24. Unless otherwise stipulated, rights to receive any Prize are not transferable or exchangeable and cannot be taken as cash.
  25. All of the Promoter's decisions are final and no correspondence will be entered into.
  26. The Promoter accepts no responsibility for any tax liability incurred as a result of an Eligible Member winning the Prize. Eligible Members should obtain independent tax and financial advice.
  27. No responsibility is accepted for late, lost, or misdirected entries or submission by the Eligible Member of Qualifying Purchases.
  28. The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilised in this Competition which may occur in the course of the administration of this Competition.
  29. Any costs associated with accessing the Program Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
  30. The Promoter encourages responsible drinking. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that are available at: www.health.gov.au/nhmrc/publications.
  31. To the full extent permitted by law, the Promoter, its related companies and Coca-Cola Amatil (Aust) Pty Ltd ABN 68 076 594 119 and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Competition or Prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person's rights under the Competition and Consumer Act 2010 (Cth) (the "Non-Excludable Rights").
  32. The winner of the Prize and their Prize companions consent to: (i) the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of the same) in any media worldwide for an unlimited period of time without remuneration for the purpose of promoting this Competition, the Program, the Promoter and/or 'Coca-Cola', 'diet Coca Cola, 'Coca-Cola Zero' beverages; and (ii) the Promoter authorising its related companies and Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) to do anything that the winner or their Prize companions consent to the Promoter doing under this condition.
  33. All entries become the property of the Promoter. Eligible Members' personal information will be collected by or on behalf of the Promoter to enable it to administer and promote the Competition and the winner of the Competition. The personal information of Eligible Members may be provided to others assisting in the conduct of the Competition, including the Competition administrator, suppliers and deliverers, and to authorities that regulate the Competition. Consumers may contact the Promoter via the Program Website or by calling the toll free number 1800 006 552 or by emailing cokeunleashedinfo@cokeunleashed.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Member does not provide accurate personal information, the Promoter may determine that they are not eligible to win the Prize. Eligible Members acknowledge that their personal information may be supplied to organisations outside of Australia and they provide their consent for this to occur by participating in the Competition.
