Summer of love first base - Terms

1. Information on how to enter and details of the Prize form part of these terms and conditions of entry. By entering or participating in this Competition, each participant fully and unconditionally agrees and acknowledges that these terms and conditions and the decisions of the Promoter on all matters relating to this competition are final and binding.

2. Entry is open to all residential customers of Aurora Energy Pty Ltd (“the Promoter”) in Tasmania (excluding King and Flinders Islands). The Promoter’s employees, contractors, agents (including agencies associated with this Competition) and their immediate families are ineligible to enter. Entrants can only enter in their own name and entry is limited to one entry per individual.

3. The Competition will be open from 16 December 2010 at 00:01 EST and conclude on 19 January at 11:59pm EST.

4. The Prize is 3 bottles of Frogmore Creek wine (Frogmore Creek Cuvee Evermore, Frogmore Pinot Noir and Frogmore Creek Sauvignon Blanc valued at $99.50), a basket of flowers from Fig Flowers (valued at $100), and 10 blocks of Cocolo chocolates (valued at $58.00).

5. The total value of the Prize is approximately $257.50.

6. To enter the Competition, entrants are required to sign up for the Warm newsletter or refer a friend to sign up. Completed registration to receive the Warm newsletter will result in automatic entry into the draw for the referrer and referee. For each referred friend who completes the registration process, the person referring them will also receive one entry into the competition.

7. The Prize will be awarded to the first correct entry drawn at random. Incomplete or incomprehensible entries will be deemed ineligible and disregarded.

8. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these terms and conditions.

9. The Prize draw will take place at the Promoter’s premises at Level 1, 21 Kirksway Place, Hobart, Tasmania on 25 January 2011. The winner will be notified by telephone and mail, and the winner’s details will be published on warm website at: www.warm.com.au/warm-competitionswinners on 28 January 2011.

10.The Promoter reserves the right to request the winner to provide proof of identity and residency at the nominated Prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

11. Should the Prize remain unclaimed, an unclaimed Prize draw will take place at 12:00pm (EST) on 4 January 2011 at the Promoter’s premises at Level 1, 21 Kirksway Place, Hobart, Tasmania. The winner will be notified by telephone and mail and their details will be published on warm website at: www.warm.com.au/warm-competitionswinners on 9 February 2011.

12. If the Prize remains unclaimed after the unclaimed Prize draw it will remain the property of the Promoter.

13. Entries will be deemed to be accepted at the time of receipt and NOT at the time of transmission. No responsibility will be taken for lost, late or misdirected entries.

14. If for any reason this Competition is not capable of running as planned (including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition) the Promoter reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition subject to the approval of the gaming authorities in Tasmania, where required.

15. The Promoter is not responsible for any injury or damage to entrants resulting from participation in, or sending or receiving of any communication or of any materials in, this Competition.

16. To the extent permitted by law, each entrant and the Prize winner irrevocably waives all rights against the Promoter, its employees, servants, agents, independent contractors or representatives (together, the 'Indemnified Persons') and release and discharge the Indemnified Persons from all claims, liability, costs, expenses, damages or losses (whether direct, indirect or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise) arising from or in connection with the Competition or the Prize. These terms do not limit or exclude liability to the extent that liability cannot, by law, be limited or excluded.

17. All entries will be the property of the Promoter. The information entrants provide may be used by the Promoter for the purpose of conducting this Competition. If the requested personal information is not provided as part of an entry, the Promoter will not be able to include the entry in the Prize draw. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Competition or communicating with entrants, and to State and Territory lottery departments. The winner’s name may be published as required under the relevant legislation. The collection, use and disclosure of personal information provided in connection with this Competition is governed by the National Privacy Principles under the Privacy Act 1988 (Cth) and the Promoter's privacy policy. 18. Each entrant consents to the Promoter using the entrant’s name, likeness, image and/or voice in the event the entrant is a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
