Burke's Backyard Scotts Reader Promotion January 2011

TERMS & CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Burke's Backyard magazine readers and Burke's Backyard website browsers. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Multiple entries permitted. Each entry must be submitted separately and in accordance with entry requirements.

5. The promotion commences 9:00am, AEST 27 Dec, 2011, and closes at 23:59pm, AEST 30 April, 2011. Enter by entering details as per the requirements of the competition on burkesbackyard.com.au. Tell us your contact details including your name, postal address and email/phone contact.

To win the 'Show us your own miracle" competition, upload a minimum of one and maximum of 2 photographs of what you have grown and, in 100 words or less, provide details of why it is a miracle to you. The photograph must include a picture of a Miracle Gro product and the person who grew the plant.

• HOW TO ENTER Upload entries on burkesbackyard.com.au • NOTE Make your photos the highest-quality (resolution) that your camera will allow. Images will only be accepted via the online website entry mechanism and will not be accepted via email or via traditional mail.

6. Incomplete, incomprehensible and illegible entries will be deemed invalid and will not be included in the judging.

7. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit. Judges decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.

8. The promotion will be judged by a panel of judges. Judging will begin on 12 noon on the 2nd of May, 2011 at the judges' premises. The best entry as determined by the judges will be deemed the winner and will receive the prize as stated below. The winner will be notified by mail and also email using contact details provided in their entry.

The winner of the Show us your own miracle competition will receive a prize package with the following:

$10,000 cash prize

Secondary prizes will be awarded to 10 finalists which will be Scotts giftpacks to the value of $50.

9. Total prize pool for the offer is $10,500. Prize does not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.

10. The prize is not transferable or exchangeable. All entries become the property of the Promoter, ACP Magazines, Burke's Backyard and Scotts Australia.

11. The collection, use and disclosure of personal information provided in connection with this competition are governed by the Privacy Notice.

12. If for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

13. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

14. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

No component of this prize is awarded in the form of a voucher/letter/ticket/pass.

15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/ or (g) redemption of a prize.

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

17. By entering the competition and providing an email address, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter's other publications, products, services and events and to promote third party goods and services it may be interested in.
