In 25 words or less, tell us your favourite gig experience and why?



(a) MTV Networks Australia Pty Ltd ACN 107 601 418 of Ground Floor, 4-16 Yurong St East Sydney, Australia NSW 2010 (“MTVNA”) is the promoter of this competition.

(b) Information on how to enter forms part of these Terms and Conditions.

(c) By entering any competition promoted by MTVNA you agree to these Terms and Conditions and any other applicable terms as advised by MTVNA.

(d) For the purposes of these Terms and Conditions, MTVNA includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.

(e) The MTV Live Session with Sia (“Event”) will be a live taping to be held at Studio 301, 2 Mitchell Road, Alexandria, Sydney NSW (“Venue”).

2. Entry requirements

(a) Entrants must be residents of Australia and 18 years of age or older.

(b) A condition of entry into this competition is that the winner and three guests must be able to make their own way to the Venue by 9:00am (AEDST) on Friday 28 January, 2011 for a taping that will run until 1:00pm (AEDST). No pass outs will be available.

(c) The employees, agents and contractors of MTVNA, any of its affiliate, parent or subsidiary companies are not eligible to enter the Competition.

(d) Direct family members of any person included in 2(b) are not eligible to enter.

(e) The competition can be entered online via www.mtv.com.au/win.

(f) To enter entrants must answer the following question: “In 25 words or less, tell us your favourite live gig experience”.

(g) All entries must include full contact details: name, date of birth, email address, home address and telephone number.

(h) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.

(i) Any information, photographs, audio-visual or other material provided to MTVNA by an entrant as part on an entry to this competition will not be returned to entrants. Entrants are advised to not send original material.

(j) Entries to this competition open on Friday 14 January, 2011 at 9:01am (AEDST) and close on Sunday 23 January, 2011 at 11:59pm (AEDST). Entries received after the closing date will not be eligible.

(k) MTVNA accepts no responsibility for lost entries.

(l) Unless otherwise agreed, any personal or confidential information submitted to MTVNA by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with MTVNA’s Privacy Policy.

3. Judging

(a) Entries will be judged at the MTVNA office at Ground Floor, 4-16 Yurong St East Sydney NSW 2010 on Monday 24 January 2011 at 12:00pm (AEDST).

(b) This Competition is a game of skill and the major prize winner (“Major Prize Winner”) will be selected by appropriately qualified judges on the quality and creativity of their entry.

(c) The Major Prize Winners will be notified by 5:30pm on Monday 24 January, 2011.

(d) The Major Prize Winner will be notified by email and telephone at the details provided in their entry. All reasonable efforts will be made to contact the Major Prize Winner. MTVNA will not be liable to any Major Prize Winner who cannot be contacted at the details provided in their entry.

(e) If MTVNA is unable to contact the Major Prize Winner after reasonable efforts, MTVNA may assign the prize to the entry judged the next best entry in the competition.

(f) The decision of the judges is final and MTVNA will not enter into correspondence or communication regarding the judges’ decisions even where MTVNA may not have acted reasonably or where MTVNA is shown to have made a decision in error.

4. Prizes

(a) The Major Prize Winner will win the following prize (“Major Prize”):

• 4 x General admission tickets to attend the local Australian taping of the MTV Live Session with Sia (“Event”) for the Major Prize Winner and three (3) guests on Friday 28 January, 2011 at the Venue.

• Meet and greet for them and their guests with Sia after the Event on Friday 28 January, 2011 at the Venue.

(b) This is a money can’t buy prize.

(c) The Major Prize Winner and their guests must be able to get to the Venue by 9:00am (AEDST) on Friday 28 January, 2011. The taping will take place from 9:00am until 1:00pm (AEDST).

(d) The Major Prize Winner’s guests must all be aged over 18 years of age as at Friday 28 January 2011.

(e) The prize does not include any travel or transfers to and from the taping or accommodation in Sydney, and all travel, transfers, accommodation and travel insurance costs (if necessary) will be the sole responsibility of the Major Prize Winner and their guests

. (f) MTVNA may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before MTVNA gives the prize over.

(g) MTVNA may require any person collecting a prize to sign a copy of these Terms and Conditions.

(h) Once a prize has been collected MTVNA is not responsible for the use or distribution of any prize.

(i) MTVNA will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.

(j) The Venue may require the Major Prize Winner and their guests to present photograph identification on entry to the Event. The Venue may refuse entry at its own discretion where such identification is not presented. MTVNA is not responsible for any refusal of entry made by the Venue because of failure to present identification.

(k) The Venue may also impose its own conditions of entry to the Venue and may refuse entry in its own discretion. MTVNA is not responsible for any refusal of entry made by the Venue.

(l) If a prize referred to in this competition becomes unavailable for any reason MTVNA reserves the right to substitute that prize for a similar item of similar value.

(m) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for any variation in the value of the prizes.

(n) Prize winners agree to participate in any promotional activity promoting MTVNA, prize sponsors and/or the competition at the reasonable request of MTVNA.

5. Intellectual Property

(a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ and their guests performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.

(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.

(c) MTVNA may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).

6. Warranties

(a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.

(b) Entrants indemnify MTVNA against any claim, loss or damager suffered by MTVNA as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.

(c) If MTVNA becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may deem that prize winner ineligible.

7. Governing Law

These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
