Terms and Conditions

1.     Information on how to enter forms part of these terms and conditions of entry.

2.     Entry is open to residents of Australia only. Employees of the Promoters (and their immediate families) and agencies associated with this promotion are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoters to enter into a further agreement as evidence of consent to this promotion.

3.     To enter, complete the reader survey and your contact details housed on www.herbalessences.com.au/beachpromotion and tell us in 25 words or less “what do you love about Herbal Essences Hello Hydration shampoo & conditioner”

4.     Participants must fill out, in full, all mandatory elements of the reader survey, contact details (name, date of birth, contact phone number, address, email address) and answer to question “what do you love about Herbal Essences Hello Hydration shampoo & conditioner” (in 25 words or less), for their entry to be valid.

5.     This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit. Judges decision is final and no correspondence will be entered into. Prize is not transferable or exchangeable and cannot be taken as cash.

6.     The promotion commences 00:01am, AEST 18 January, 2011, and closes at 11:59pm, AEST 1 March, 2011, “promotional period”. The promotion will be judged by a panel of judges. Judging will begin on 15 March, 2011 at 11am at the ACP Magazines premises. The winner will be notified by telephone and/or mail. The name of the winner will also be published in The Australian on 29 March 2011.

7.     The best entry (1) as deemed by the judges will win a $5000 shopping spree (presented in the form of a Westfield shopping voucher). Delivery is included to anywhere within Australia.

8.     Total prize pool value is $5000. Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

9.     Westfield Group is the issuer of the Westfield Gift Card but is not the promoter of the promotion and is therefore not responsible for the prizes, products, or services under the promotion or the fulfilment of the promotional terms. Westfield Group is responsible for the fulfilment of the terms and conditions of the Westfield Gift Card. Westfield Gift Cards are redeemable at participating stores only. 10.  Except for any liability that cannot be excluded by law, the Promoters (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following: a) any technical difficulties or equipment malfunctioning (whether or not under the Promoters’ control); b) any theft, unauthorised access or third party interference; c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not by the Promoters) due to any reason beyond the reasonable control of the Promoters; d) any variation in prize value to that stated in these Conditions of Entry; or e) anything arising out of or in connection with taking or using the prize.

 

11.  In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoters, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element.

 

12.  Entries remain the property of the Promoters. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion.  By entering this promotion entrants consent to the use of their information as described and agree that the Promoters may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant.  Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting ACP Magazines on (02) 9282 8000 or Procter & Gamble on (02) 8864 5000 during office hours. In the event that an entrant has opted in to receive further information and/ or marketing material from Procter & Gamble (ABN is 91 008 396 245), then that registrant will also be deemed to have consented to receipt of any email/ communication from Procter & Gamble (ABN is 91 008 396 245).
