Terms & Conditions
1. Information on how to enter forms part of these Terms and Conditions. Entry into the competition constitutes acceptance of these Terms and Conditions and an acknowledgement that this is part of the JUST SHOP loyalty program; which is governed by the JUST SHOP Membership Terms and Conditions (available at Participating Just Jeans Stores and at www.justshop.com.au).

2. To be eligible for entry into this promotion, a person must be aged 18 and over, a resident of Australia, and a valid JUST SHOP Member ("Eligible Entrant"). Employees of Just Jeans and/or their related entities and agencies are not eligible to enter this promotion.

3. This promotion commences at 9.00am (AEDST) on Wednesday 12th January 2011 and closes at 11.59pm (AEDST) on Tuesday 25th January 2011 ("Promotion Period"). Entry can be made via Internet only. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

4. To enter the Major Prize Draw, an Eligible Entrant must make a purchase from the Just Jeans Junior wear range at a participating Just Jeans store during the Promotion Period ("Qualyfing Purchase") and then visit www.justshop.com.au and complete the entry form in the full manner required, including their own name, telephone contact number, email address, receipt number and JUST SHOP Membership card number.

Note: Eligible Entrants will receive a receipt at the time of their purchase that will feature a Unique Receipt Number. Membership numbers can be found on the back of their membership cards.

5. Participating Just Jeans Stores refer to all Just Jeans stores in Australia that stock the Just Jeans Junior wear range excluding Just Jeans online, Just Jeans Swan Hill and all Just Jeans Factory Outlets.

6. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the Promotion Period. Entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.

7. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

8. For all entries a notification page will advise consumers their entry has been successfully received. If an entry is not successful because it is not in the required format, fields are incomplete or ineligible a "try again" message will be sent to the entrant. The "try again" message will prompt the entrant to check their entry form and resubmit their entry in the required form.

9. One entry per receipt number is permitted. Entrants may be required to present proof of purchase for all entries made. Proof of purchase include providing the Promoter with their purchase receipt within the required time frame set out by the Promoter.

10. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

11. The Major Prize draw will take place at 11:00am (AEDST) on Friday 28th January 2011 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121. The winner will be notified by telephone and in writing and their name and postcode published in The Australian newspaper on Friday 4th February 2011.

12. Major Prize: The first valid entry randomly drawn will win one (1) Family Holiday to the Gold Coast valued at up to $3,500. The prize includes return economy airfares for 2 adults and 2 children (under 11 years of age) from the winners nearest capital city to Coolangatta airport, four (4) nights accommodation in family room in a minimum 3.5 star hotel, full breakfast daily, a family 3 park fun pass and a four (4) day freedom pass including airport transfers and use of local bus services and shuttle to theme parks.

13. Minor Prize: The next ten (10) valid entries randomly drawn will each win a Toy Story DVD valued at $39.99.

14. Total maximum prize pool value is $3899.95 (including GST).

15. The major prize must be taken by the prize winner (and their companions) within twelve (12) months of being notified as a winner.

16. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

17. The winner (and their companions) must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Tasmania, Adelaide or Perth).

18. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made.

19. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

20. Just Jeans Pty Ltd, Oxygen Interactive Marketing Pty Ltd and other agencies associated with this promotion make no representation as to the safety, conditions or other issues that may exist at any destination.

21. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this prize should they be chosen as winners. The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the prize or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.

22. In the event that for any reason whatsoever a winner does not take the prize at the time stipulated by the Promoter then the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. The prize elements may be terminated without notice if these Terms and Conditions are not complied with.

23. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

24. If the Major Prize is unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 5:00pm (AEST) on Friday 13th May 2011, then a second chance prize draw will take place to distribute the prize at 11.00am (AEST) on Monday 16th May 2011 at the same address as the original prize draw. All valid and current members who made a qualifying purchase during the Promotion Period will be entered into the second chance prize draw. In the event of a second chance prize draw, the winner will be notified by mail and by telephone and their name and postcode published in The Australian newspaper on Friday 20th May 2011.

25. The Promoter is not responsible for any problems or technical malfunction of any computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this promotion.

26. Caution: any attempt to cause malicious damage or interference with the normal functioning of the Website application or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.

27. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.

28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

29. Prize values are correct at the time of printing and are subject to change without notice. Just Jeans Pty Ltd accepts no responsibility for changes to prize values. All prizes are not exchangeable, transferable or redeemable for cash or other goods or services. Any tax implications for Eligible Persons, which may arise from this promotion are the responsibility of the Eligible Persons, and independent advice should be sought.

30. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter.

31. The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

32. In conducting this promotion Just Jeans Pty Ltd:

•will use your name and contact information collected from you for purposes relating to and arising from this promotion;
•will publish all prize winner’s names and their suburb and the names of all winners and their suburb following any unclaimed prize draw;
•may require the winner of the prize to provide proof of identity and age;
•will not be liable for any loss or damage resulting from incorrect details being provided by entrants; and may otherwise use and disclose the entrant’s personal contact information as required or authorised by law.
•may publish the winner’s full name, suburb and state of residence on www.justjeans.com.au and on one JUST-SHOP e-newsletter to be sent to the entire JUST-SHOP email membership base.
•may require a photo of the winner participating in and/or with their prize and a written statement for the JUST SHOP Promotional publication and/or Just Jeans Facebook Page.
33. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter.

34. Just Jeans and its respective related bodies corporate, officers, employees and agents will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability that cannot be excluded by law.
