1. Information on how to claim and the rewards form part of these Terms and Conditions. Participation in this promotion is deemed to be acceptance of these Terms and Conditions.
2. Claims are only open to Australian residents aged 18 years and over. Employees and officers of the Promoter (and their immediate families), its associated companies, participating retailers, advertising agencies and other agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Promotion commences on 24/01/11 and ends for purchase close of business on 20/02/11 ( Promotional Period). Claims close 11:59pm AEDST on 20/02/11 or when 5,000 valid Claims have been received, whichever is the first to occur.
4. To be eligible to claim, a participant must purchase two (2) different Mortein Products (i.e. Mortein Products with a different barcode number) in the one transaction from a participating Woolworths or Safeway supermarket nationally during the Promotional Period (Qualifying Purchase). All products in the Mortein product range are ‘Mortein Products’ for the purpose of this promotion.
5. To claim, a participant must then visit www.mortein.com.au/promotion follow the prompts to the promotion claim page, complete the online claim form, input the requested details for the relevant Qualifying Purchase (including the last five (5) digits from the barcode of each of the two (2) Mortein Products purchased, the last four (4) digits from the receipt number listing the products in that Qualifying Purchase and their postal address) and submit the fully completed online claim form so that it is received by the Promoter by 11:59pm AEDST on 20/02/11 (Claim).
6. Claimants will be required to retain their original Woolworths/Safeway receipt(s) for each Claim as proof of purchase. Failure to provide this to the Promoter upon request will, at the Promoter’s discretion, result in an invalid Claim (and, at the Promoter’s discretion, in all of the claimant’s Claims being invalid) and forfeiture of any right to the reward. Each purchase receipt must clearly specify the store of purchase, that two (2) Mortein Products were purchased and that the purchase was made in one transaction during the Promotional Period and prior to submission of the relevant Claim.
7. Only one (1) Claim permitted per household. Offer is strictly limited to the first 5,000 valid Claims received.
8. Any Claim that does not comply with these Terms and Conditions will be invalid.
9. All Claims are deemed to be received at the time of receipt into the Promoter’s database and NOT at the time of transmission by the claimant.
10. The Promoter’s decision is final and no correspondence will be entered into.


OFFER:11. he first five-thousand (5,000) valid Claims received will each be awarded a ten dollar ($10) WISH Gift Card. Successful claimants will receive the $10 WISH Gift Card by standard post mail to the address provided on the Claim form within 28 days of verification of their Claim. Non-winning claimants will not be notified.
12. Woolworths Limited is the issuer of the WISH Gift Card but is not the Promoter of the offer and is therefore not responsible for the Mortein Products under the offer or the fulfilment of the offer. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. Participating stores may change from time to time. WISH Gift Card terms and conditions apply. WISH Gift Cards expire 12 months from their date of issue. See www.everydaygiftcards.com.au for full terms and conditions. Any costs in excess of the (GST inclusive) value of the Woolworths Gift Card and all ancilliary costs associated with redeeming the reward are included and are the responsibility of the claimant. If the cost of the item requested by the claimant is less than the value of the Woolworths Gift Card, the balance of the value of the Woolworths Gift Card will not be awarded as cash.
13. The Promoter reserves the right, at any time, to verify the validity of Claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who: (i) the Promoter believes either has tampered with the claiming process or has submitted a Claim which is not in accordance with these Terms and Conditions; (ii) acts in a disruptive manner; or (iii) acts with the intent to annoy, abuse, threaten or harass any other person. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. Incomplete or indecipherable Claims will be deemed invalid.
15. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
16. The total reward pool value is AU$50,000 (including GST).
17. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected Claims.
18. Rewards are not transferable or exchangeable and cannot be taken as cash. If any reward is unavailable, the Promoter reserves the right to substitute any reward for a reward of similar specification or equal value to any reward offered in this promotion, subject to any written directions from a regulatory authority. If, after verification of all the Claims submitted between 24/01/11 and 11:59pm AEDST on 20/02/11, there remain WISH Gift Cards from the 5,000 WISH Gift Cards which have not been awarded, these WISH Gift Cards will not be awarded and there will be no second chance draw.
19. The Promoter is not liable for any WISH Gift Card that has been lost, stolen, forged, damaged or tampered with in any way).
20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees as provided under the Competition and Consumer Act or any implied condition or warranty under the ASIC Act or similar consumer protection laws in the State and Territories of Australia, the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these Terms and Conditions; (f) any tax liability incurred by a successful claimant or entrant and/or (g) a WISH Gift Card or use of a Wish Gift Card.
21. If for any reason any aspect of this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated in any respect including (but not limited to) by reason of any cause beyond the reasonable control of the Promoter which affects the administration, fairness or proper conduct of this promotion, the Promoter reserves the right, subject to the written directions of any relevant authority, in its sole discretion, to (i) cancel, postpone, terminate, suspend or amend the promotion; or (ii) invalidate any Claim or disqualify any claimant, as appropriate.
22. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions or any instructions or directions on the promotional website www.mortein.com.au/promotion or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
23. Any costs associated with accessing the promotional website are the claimant’s responsibility and are dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically Claim repeatedly is prohibited and will render all Claims submitted by that claimant invalid.
24. Claimants should seek independent financial advice about any tax implications that may arise from the WISH Gift Card.
25. The Promoter may require the claimants to provide proof of identity, proof of age and proof of residency at the nominated reward delivery address. Identification considered suitable for verification is at the Promoter’s absolute discretion.
26. Claimants consent to the Promoter using the claimant's name, likeness, image and/or voice in the event they are a successful claimant, including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27. The Promoter, through its agent, The Marketing Zoo, is collecting personal information contained in the Claim form for the purposes of conducting this Promotion, as required by Australian regulatory authorities. Claiming is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the claimant. If a claimant does not wish to be contacted for these purposes or wishes to access, update or correct any personal information, a claimant should direct these requests to the Privacy Officer of the Promoter at Reckitt Benckiser of 44 Wharf Road, West Ryde NSW 2114. All Claims become the property of the Promoter.
