Terms & Conditions

By entering the ‘Pilot Fix it with Frixion’ Game of Skill Competition (the “Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS

1.1. Information on how to enter and the prizes form part of the terms of entry.
2. WHO CAN ENTER?

2.1. Subject to clause 2.2, entry is open to all residents of Australia over the age of 18 years. Individuals must have a current Facebook membership to be able to become a fan of the Promoter’s page and complete the entry process.

2.2. Employees and their immediate families of PILOT PEN AUSTRALIA PTY LTD and its associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. HOW TO ENTER AND ENTRY CONDITIONS

3.1. The “Contest Period” starts on Wednesday 1st of December 2010 at 09:00am and ends at 17:00 (AEDST), on Monday 28 February 2011. Sponsor’s computer clock in Australia is the official time clock for the entries and will be time stamped accordingly. There will be two judging rounds, entries for which will commence and conclude on the following dates and times:

Entries from the first judging round will not be entered into the subsequent judging round.

3.2. To enter individuals will be asked to submit a photograph they have taken showing a funny typo (for example on a sign, etc). To submit their photo and enter, individuals must: (a) visit www.facebook.com/pilotaustralia and read the entry instructions; (b) click on the “FIX IT WITH FRIXION” tab and then the “Enter now” button; (c) follow the prompts to become a fan of the www.facebook.com/pilotaustralia page (if not already a fan); (d) follow the prompts to upload a photograph of their FUNNY TYPO and explain, in 25 words or less, where they found their funny typo and why it is funny. Photo submissions must not contain any copyright protected material and must not contain any defamatory, obscene, lewd, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening or inappropriate language, pictures or other material (as determined by Sponsor in Sponsor’s sole discretion) ,or, any trademarks, service marks, logos, brands, or products other than Pilot and must comply with clause 3.13. All entrants who submit a photo must review and agree to the photo upload terms and conditions viewable on Facebook, and the photo upload terms and conditions that form part of these Terms and Conditions.

3.3. Entries will be judged on creativity, humor and originality of the typo pictured in the photograph submitted. In the event that two or more entrants submit an identical typo (which is deemed to be a winner) the tied entrants response to the 25 word or less question will then be judged (on the criteria of creativity and originality) and a winner chosen. The Competition is a game of skill and chance plays no part in determining the winners.

3.4. Only one entry per person per day will be accepted from entrants. Each entry submitted by an entrant must be substantially unique. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

3.5. The submitted photographs must be:

   1. the original independent creation of the entrant; and
   2. free from any claims, including copyright or trademark claims, by other parties.

3.6. All entries must be received by 15/01/11 at 17:00 (AEDST) to be included in the FIRST judging round, and by 28/02/11 at 17:00 (AEDST) to be included in the SECOND judging round.

3.7. Entries remain the property of the Promoter and will not be returned to the entrant.

3.8. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any payment for such use.

3.9. All entrants must be 18 years of age or older to enter this Competition.

3.10.

Incomplete or indecipherable entries will be deemed invalid.

3.12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

3.13. When an entrant submits any materials via the Competition including comments, and images (“Content”), the entrant, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use. Entrants warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights; (b) entrants will obtain prior consent from any person that appears in their Content; (c) entrants will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) Content submitted shall not contain viruses or cause injury or harm to any person or entity; and (e) entrants will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, entrants agree to indemnify the Promoter for any breach of the above terms.

3.14. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

4. PRIZES

4.1. There will be two (2) prize winners in the competition, one (1) in each judging round. Each winner will receive a prize package valued at $1,799, consisting of:

    * a 16GB Apple iPad; and
    * $1,000 (awarded in the form of a cheque)

Total prize pool is: $3,598 (including GST). Prize value is based upon the recommended retail prices and is correct as of 9 November 2010. The Promoter accepts no responsibility for any change in prize value between now and the date the prizes are awarded.

4.2. The winners are not entitled to receive any money from the Promoter or the Sponsor if there is a difference between the maximum prize value listed in these Terms and Conditions and the actual prize value at the time the prize is awarded.

4.3. The prize cannot be transferred or exchanged and cannot be redeemed for cash, unless otherwise specified. The Promoter and the Sponsor do not accept any responsibility for any tax liability incurred by a winner or entrant. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.4. In the event that for any reason any winner does not take the prize or an element of the prize at the time stipulated by the Promoter then the prize or that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize or that element of the prize.

4.5 The Promoter is not the manufacturer of the Apple iPad. Winners will be required to contact Apple directly with any queries regarding the warranty of the Apple iPad prize.
5. HOW WINNERS ARE SELECTED

5.1. Each entrant who has entered the Competition within the Contest Period and in accordance with the terms of these Terms and Conditions will be eligible to win one of the prize packages detailed in clause 4.1. The winners will be judged by a panel of judges appointed by the Promoter and one (1) winner will be selected in each judging round (from valid entries received in that judging round). The winning entry will be deemed to be the most creative, humorous and original entry from all entries received in a particular judging round.

5.2. All entries must comply with the Terms and Conditions. Entries that do not contain the information required by clause 3.2. or that do not otherwise comply with these Terms and Conditions, may be deemed invalid and, in that event, a new entry will be selected by the judges (as the winning entry).

5.3. The winners will be notified by a phone call and/or email after the judging is complete, and a letter advising the winners of their prize will also be Express Posted and/or sent by an email.

5.4. The judges’ decision is final in all aspects of this competition and the Promoter will not enter into any correspondence regarding the results or any other aspect of this competition.

5.5. It is a condition of accepting the prize that the winners must comply with all conditions of use of the prize and also the prize supplier’s requirements.

5.6. It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
6. NO LIABILITY

6.1In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s or the Sponsor’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter or the Sponsor may in its absolute discretion modify, suspend, terminate or cancel the Competition (as appropriate) and recommence it from the start on the same conditions.

6.2. PILOT PEN AUSTRALIA PTY LTD and the Sponsor (and each of their associated agencies and companies) will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3. PILOT PEN AUSTRALIA PTY LTD and each of their associated agencies and companies will take no responsibility in the event any element of a prize as set out at Clause 4 of these Terms and Conditions cannot be supplied as part of this Competition for any reason outside of the Promoter’s control. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

6.4. PILOT PEN AUSTRALIA PTY LTD, the Sponsor (and each of their associated agencies and companies) and Facebook will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur in the following circumstances without limitation: a)during the judging; b) as a consequence of late, lost or misdirected mail; c) as a result of taking and using the prize; d) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this competition; or e) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this competition.

6.5. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook and that the information an entrant provides will only be used for the purposes outlined above. Any questions, comments or complaints regarding the competition should be directed to the Promoter and not to Facebook.

6.6. Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.
7. PROMOTER’S DETAILS

7.1. The Promoter is PILOT PEN AUSTRALIA PTY LTD, (ABN 37 144 701 502) of Locked Bag 6015, Regents Park NSW 2143.

7.2. The Sponsor is ONE FOR ALL PTY LTD who is conducting the competition on the Promoter’s behalf.

7.3. The Promoter and its related entities (“Pilot”), is collecting the entrant's personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winners). Entry is conditional on provision of this information. The entrant may request access to his or her personal information by writing to Privacy Officer, c/- Legal Department, PILOT PEN AUSTRALIA PTY LTD, Locked Bag 6015, Regents Park NSW 2143.

7.4. If any entrant wishes to receive information about PILOT PEN AUSTRALIA PTY LTD products, offers and promotions (including via electronic means) from PILOT PEN AUSTRALIA PTY LTD, entrants can tick the opt-in boxes located on the online entry page. In using the personal information of entrants who tick the opt-in boxes for the purposes set out above, Pilot Australia may disclose the information to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses).
