Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid. 2. Entry is open to residents of Australia and New Zealand who have either a valid email address and Australian or New Zealand mobile phone ("Eligible Entrant"). Any person who is under the age of 18 years is not permitted to enter. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter. 3. The promotion commences at 12:01am Australian Eastern Daylight Saving Time ("AEDST") on Monday 27 January 2011 & closes at 5.00 pm AEDST on Monday 14th February 2011 ("Promotion Period"). 4. To enter, complete an entry form in one of the participating stores, place the completed entry form in the entry collection box provided, no other method will be permitted unless given in writing prior to the entry being submitted. 5. The Promoter retains the absolute discretion to require any entrant, (including groups of entrants in the same Household), to provide proof of residency at the Household address shown on their entry before awarding a prize. 6. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, or for submitting an entry which is not in accordance with these conditions of entry. 7. All valid entries received during the Promotion Period will be entered in the Major Prize draws. 8. The following prizes will be awarded: a. All prize draws will be conducted at the store in which the entry is placed 10. Quality control or printing errors will not invalidate an otherwise valid entry code in the random prize draw and the major prize draw. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all valid prize claims will be honoured. 11. All prize winners will be notified by either email or SMS depending upon the method they used to send their winning entry. Prizes are not transferable & cannot be taken as cash, unless otherwise stipulated. 14. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes. 15. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law. 16. Each entry becomes the property of the Promoter. Promoter’s decision is final and no correspondence will be entered into. 18. The Promoter may conduct an unclaimed prize draw at the same time and place as the original draw on Monday 20 June 2011 to distribute any prizes unclaimed by that date subject to any written directions given by a relevant lotteries or gaming authority. The first valid entry drawn will win the unclaimed prize of the highest value and the draw will continue until all unclaimed prizes have been distributed. Winners of any unclaimed major prize will have their name and postcode published at www.heavenlynights.com.au 19. No prize winner under the age of 18 years will be awarded his or her prize. 20. Each winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void. 21. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value. 22. By entering the competition and claiming a prize, the major prize winner agrees that the Promoter may use their name, image and photograph/s for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s. 23. Prizes will only be available for collection from the store in which the entry was placed after 5.00 pm AEDST on Monday 14th February 2011 24. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process. 25. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion. 26.
