1. Information on how to enter and prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2. Entry is open to residents of Australia, aged 18 and above only. Employees and their immediate families of the Promoter and their related corporate bodies are not eligible to enter this promotion. Winner’s travel companion must be over 13 years of age.

3. The Promotion commences at 12.01am AEDT on 7 February 2011 and closes at 5pm AEDT on 7 March 2011 (‘promotion period’).

4. To enter, participants must become a member of The Perk, update their details and complete the entry form via the News Limited registration page (below) during the promotional period:

One entry per person will be permitted. All complete entries will be entered to the draw.

5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry.

6. There will one Grand Prize draw. The draw will take place at 3pm (AEDT) on 11 March 2011 at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089. All eligible entries will be entered into the draw. The winner will be notified by phone, in writing, published on http://www.news.com.au and in The Australian newspaper on 18 March, 2011. The first eligible entry drawn will win the Prize.

7. The Grand Prize includes:

- Return economy airfares for 2 adults from the winner’s nearest Australian capital city to Cairns, and air transfers to Lizard Island.

- 3 nights twin share in a Sunset Point Villa on the exclusive Lizard Island, including all meals and selected alcoholic and non-alcoholic beverages. Use of non-motorised watersports, glass bottom paddle skies and snorkelling equipment (snorkelling lessons are provided in the swimming pool, if required).

- 1 day trip for 2 people with Aroona Luxury Boat Charters in a luxury cabin, discovering reefs in the Cairns region, snorkelling, scuba diving gear (provided only to approved licensed divers) and feasting on culinary treats provided by the chef, to the Great Barrier Reef to view or swim with Minke Whales. (Viewing of Minke Whales cannot be guaranteed).

The Grand Prize is valued at a maximum $10,000. (the prize value is correct at time of printing). The Prize is valid to 31 December 2011 but the Winner must be aware that the annual season to view Minke Whales is between late June to mid July, each year.

The Prize winner is recommended to book as early as possible to ensure travel and accommodation availability. The Prize cannot be refunded for cash or transferred and cannot be used in conjunction with Frequent Flyer programs. The prize does not cover any other travel costs incurred. All components of the prize must be taken together. Airline tickets must be used in conjunction with the trip, over the specified routing in the stated class of travel. Travel restrictions may apply. The prize winner and their travel companion must travel together. Meals and Transfer fees (other than those specified above) tips, domestic travel to and from departure point, taxes and any other personal expenses and travel insurances must be paid for by the winner. If for any reason the winner is unable to accept the prize as stated, and between the dates indicated, the winner will forfeit the prize and no compensation will be given in lieu. If any part of the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any law or written directions from a regulatory authority.

It is the winner and their travel companion’s personal responsibility to ensure that they have valid documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travelers. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Cash will not be awarded in lieu of the prize or element thereof.

8. The Promoter reserves the right to redraw in the event of any entrant not claiming a prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct further draws on 24 June 2011, as required, at the same time and place as the original draw. The winner, if any, will be notified by phone, in writing, published in The Australian newspaper on 1 July 2011.

9. The Promoter’s decision is final and no correspondence will be entered into.

10. The winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

11. The Prize will only be delivered in Australia.

12. If for any reason this promotion is not capable of running as planned (whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion), the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

13. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information either caused by website users or by any of the equipment or programming associated or utilised in this competition, or by any technical error that may occur in the course of administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

14. The Promoter collects information about you to include you in the promotion and, where appropriate, to award prizes and may also use the information to assist it in improving its goods and services and to contact you, including by electronic communication methods (including email and SMS) in the future with special offers. The Promoter may share your information with its Australian related companies who may contact you with special offers. The Promoter may also share your information with other persons or entities that assist it in running promotions or with other companies who provide prizes for promotions or reader offers.

15. By entering the promotion, each entrant agrees in addition to the above uses, that the Promoter may disclose entrants’ personal information, to State and Territory lottery departments, the winners’ names will be published as required under the relevant lottery legislation and the Promoter may publish or cause to be published the winner's names and suburb in any media.
