2. The promoter is Boost Juice Pty Ltd, of O100A, Chadstone Shopping Centre 1341
Dandenong Road, Chadstone 3148 (“Promoter”).
3. This promotion is in no way sponsored, endorsed or administered by, or associated
with, Facebook. You are providing your information to Boost Juice Pty Ltd and not to
Facebook. The information you provide will only be used for judging the winning entry
of the promotion. facebook.com is not associated with or affiliated with the promotion
or the business of the Promoter and will not be held liable for any failure by the
Promoter to honour or fulfil the terms of the promotion. The promotion is subject to
the normal business guidelines of the participating stores/Promoter.
4. To the fullest extent permitted by law, facebook.com and its employees are exempt
from all liability (including negligence), for any loss or damage or personal injury,
arising in any way out of an entrant participating in this promotion, including, without
limitation: (a) any technical difficulties; (b) entries that are late, lost, damaged or
misdirected prior to their receipt by the Promoter, or after receipt due to reasons
beyond the reasonable control of the Promoter; (c) any variation in the promotion to
that stated in the Promoter’s conditions of entry; and (d) any tax liability incurred by
the winner of the promotion.
5. There will be 1 x $1000 cash prize to be given away to the winner. The total prize
pool is $1,000.
6. Boost Juice Pty Ltd will send 1 x $1000 cheque to the 1 valid winner chosen. If the
winner is under the age of 16, the cheque will be addressed to the winner’s parents
or guardian.
7. Any persons under the age of 18 must obtain parent/guardian permission before
entering this promotion.
8. Entry is open to all persons with a valid facebook account, who must be residents
of Australia. Employees of the Promoter and associated promotional partners, their
related companies and agencies and the immediate families of the above listed
persons cannot enter this promotion.
9. To enter, entrants must purchase the limited edition mango and berry smoothie
that is promoted with ‘no name’ in Boost Juice Bars outlets, log onto www.facebook.
com/boostjuice, then click the ‘like’ button on the webpage to become a fan of
the Boost Juice Bars facebook page. Entrants then need to click through on the
promotional advertisement on the Boost Juice Bars facebook page and write their
entry for the new name of the mango and berry smoothie. Entrants must purchase the
‘mango and berry smoothie with no name’ during the promotional period to be eligible
to enter. This is a game of skill, and chance plays no part in determining the winners.
10. Multiple Submissions permitted, subject to the following: (a) each Submission
must be substantially unique; and (b) each Submission must be submitted separately
and in accordance with entry requirements. Once a Submission has been written
on the official Boost Juice Bars facebook page www.facebook.com/boostjuice, it
cannot be further modified or edited, however, entrants may modify elements of their
previous Submission(s) and re-submit them as a new Submission, provided the new
Submission is materially and substantially different to the previous Submission(s), as
determined by the Promoter in its sole discretion.
11. Promotion commences 08.00am Monday 02/05/11 and closes 11.59pm on
Sunday 29/05/11.
12. The entries will be judged by The Promoter and 1 x prize winner will be chosen
on Wednesday 01/06/11 at 12:00pm (AEST) in its absolute discretion. Entries will
be judged based on creativity and Boost Juice Pty Ltd assume sole discretion on
choosing the winning entry.
13. The winners will be confirmed by The Promoter at 2pm on Thursday 02/06/11.
14. The Promoter will notify winners through phone or email contact by COB Thursday
02/06/11.The judge’s decision is final and no correspondence will be entered into.
15. In the event that two or more entrants submit the same new name for the mango
and berry smoothie, the entrant that submitted the new name first will be deemed the
winner. If that entrant is not contactable by phone or email by 16/06/11, the entrant
that submitted the same new name next in time will be deemed the winner.
16. The winners will be announced on the boostjuicebars.com website.
17. If the winner is not contactable by 16/06/11, a new winner will be chosen and will
be decided by 2pm on Friday 17/06/11 by The Promoter. The Judge’s decision is final
and no correspondence will be entered into.
18. The promoter reserves the right to request a valid receipt of purchase from the
winner. Receipts for all transactions can be requested by entrants at point of purchase
at Boost Juice Bars Australia. If a receipt is requested by an entrant it must be at time
of purchase and cannot be provided at any time after the point of purchase.
19. As a condition of accepting the prize, the winner may be required to sign any legal
documentation as and in the form required by the Promoter and/or prize suppliers in
their absolute discretion, including but not limited to a legal release and indemnity form.
20. Entries must not contain any offensive language or any insulting or racial comments.
21. The submission must not contain any copyrighted or patented wording. Any
elements of an entrant’s Submission must be entirely original, created by the entrant
or a third party that has agreed to appear in Boost Juice Bars Australia or have their
material featured in Boost juice Bars Australia in accordance with these Terms
and Conditions.
22. The winner consents to Boost Juice Bars Australia using the winning smoothie
name for the mango and berry smoothie in Australian Boost Juice stores, Boost Juice
marketing collateral and for future Boost Juice promotions and campaigns. Royalties
will not be paid to the winner for the use of the winning name in Boost Juice Bars or
any associated marketing collateral at any time.
23. Entrants must comply with all applicable laws and regulations, including
without limitation, those governing copyright, content, defamation, privacy, publicity
and the access or use of others’ computer or communication systems in creating
their submission.
24. The Promoter reserves the right, at any time, to verify the validity of all entries
(including an entrant’s identity, age and place of residence), and to disqualify any
entrant who submits an entry into this promotion that is not in accordance with these
Terms and Conditions or who tampers with the entry process. Errors and omissions
will be accepted at the Promoter’s discretion.
25. This prize is not transferable or exchangeable.
26. Any ancillary costs associated with redeeming this prize is the responsibility
of the winner.
27. In case of a dispute as to the owner of an online entry, entry will be deemed to
have been submitted by the registered facebook user from whose account the entry
is made.
28. Participants must comply with all requirements of the Promoter including
requirements specified in these Terms and Conditions. The Promoter may, at its
absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
a. fails to establish their entitlement to enter the promotion to the Promoter’s
satisfaction;
b. tampers with or benefits from any tampering with the entry process or the
operation of the promotion;
c. submits an entry which in the Promoter’s opinion is not in accordance with these
Terms and Conditions;
d. acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or
harass any other person; or
e. in the opinion of the Promoter, engages in conduct in entering or participating
in this promotion which is fraudulent, misleading, deceptive or generally damaging
to the goodwill or reputation of the promotion or Boost Juice Bars creating public
disrepute, contempt, scandal or ridicule.
29. The Promoter is not responsible for technical, hardware or software malfunctions,
lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete,
garbled or delayed electronic communications whether caused by the sender or by
any of the equipment or programming associated with or utilised in this promotion or
by any human error which may occur in the processing of entries in this promotion.
30. If, in the judges’ opinion, there is any suspected or actual evidence of electronic
or non-electronic tampering with any portion of the competition, or if technical
difficulties compromise the integrity of the competition, the judge reserves the right
to terminate the competition and decide the winner of the promotion using all entries
received as of the date of termination.
31. The Promoter shall not be held liable for any loss or damage whatsoever which is
suffered (including but not limited to indirect or consequential loss) for personal injury
suffered or sustained, as a result of accepting a prize, except liability which cannot be
excluded by law.
32. The Promoter accepts no responsibility for any tax implications that may arise
from the prize winnings. Independent financial advice should be sought.
33. The information is collected by the Promoter relating to each entry (or entrant)
for the purposes of conducting this promotion and publishing the winner’s details is
as required by the law. If any of the information requested is not provided the entry
