Joint Promoters – Beechworth Honey and McKenzie’s Foods.

CONDITIONS
PARTICIPATION
1.This joint competition (“Competition”) is conducted by Beechworth Honey Pty Ltd, ABN 14 504 758 154, of 38-40 Hammersley Road, COROWA, NSW 2646 and Ward McKenzies (“Joint Promoter”).  ABN 52 004 586 645, of 47 – 51 Slough Road, ALTONA, VIC 3018.

2.Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.

3.The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.

4.Competition entry opens at 9.00am (AEST) on 2/05/11 and closes at 7pm on 31/08/11/("Entry Period").

ENTRY
5.To enter, an Eligible Entrant must purchase from IGA supermarkets one “Beechworth Honey” branded product and one “McKenzie’s branded oat product in store ("Promotion Product").

6.Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Beechworth Honey and  McKenzie’s oat product they purchase from participating IGA stores in Victoria, New South Wales, ACT, Tasmania, South Australia or Tasmania.
 
7.Entry can be made by completing in full the entry form available from IGA stores and sending to Visit Beechworth Competition.  PO Box 450 Corowa or visiting www.mywinterwarmers.com   and fully complete the entry form. All entries must contain an address, day time telephone number, valid email address and show the barcode from each product and the store receipt number. 
 
8.The Promoter takes no responsibility for late or misdirected entries.

9.For each entry the entrant must keep their proof of purchase in the form of the original store receipt showing purchase of the Promotion Product  that identifies it as an item purchased before the end of the Entry Period

10.An entry by more than one person (ie a joint entry) is invalid.

11.All entries remain the property of the promoter, and entry into the competition is taken as acceptance of consent to receive ongoing marketing communications unless notification is given to the promoter to unsubscribe from such communications.

PRIZE DRAW
12.Entry opens at 9.00am (AEST) on 2/5/11 and closes at 7pm on 31/8/11 (“Prize Draw Entry Period"). All valid entries received during the Prize Draw Entry Period will be included in the Prize Draw.

13.The three major prize draws will be held at 9am on 13/6/11, 18/7/11 and 5/9/11 at Beechworth Honey, 38-40 Hammersley Rd, Corowa.  NSW.  The 21 gifthamper draws will be held at 9am on 18/4/11, 25/4/11, 2/5/11, 9/5/11, 16/5/11, 23/5/11, 30/5/11, 6/6/11, 13/6/11, 20/6/11, 27/5/11, 4/7/11, 11/7/11, 18/7/11, 25/7/11, 1/8/11, 8/8/11, 15/8/11, 22/8/11, 22/8/11 29/8/11 at Beechworth Honey, 38-40 Hammersley Rd, Corowa, NSW.
 
14.The Eligible Entrant who submitted the first valid entry drawn in the Prize Draw will win the Prize, which is known as a “Win a weekend package ”. The package includes two nights accommodation for two adults and up to three children at the Beechworth Honey Cottage, 124 Malakoff Road, Beechworth, Victoria, 3747 and a gifthamper of Beechworth Honey and  McKenzie’s products.  Weekly prizes are gifthampers of Beechworth Honey and McKenzie’s  products.

PRIZE
15.If the winner of the Prize is under 18 years of age, the prize will be awarded to a parent or guardian of the winner, as determined by the Promoter, on the winner's behalf.

16.The major prize comprises, for its winner and, up to four guests being one adult and up to three children under the age of 18:
i.2 nights accommodation at Beechworth Honey cottage, 124 Malakoff Road, Beechworth, Victoria, 3747 a fully self contained cottage situated just outside Beechworth ("Accommodation");
ii.Gift hamper of Beechworth Honey and McKenzie’s  products.
iii.There are three major prize packages.
iv.The weekly prizes comprises for its winner a gifthamper of Beechworth Honey and McKenzie’s products.

17.if a person aged less than 18 years wins the major Prize, the parent or guardian to whom the prize is awarded must be one of the persons taking the package.

18.The prize will be arranged by the Promoter subject to availability of the Beechworth Honey cottage and must be taken between the 1st of July 2011 and 31st December 2011. If a nominated prize winner or any of their guests is unable to travel on the dates of availability notified by the Promoter, that nominated guest will forfeit their entitlement to collect their prize.

19.Once booking details have been arranged by the Promoter, changes to the accommodation arrangements can not be made
.
20.All components of the prize must be taken together as a single booking by the Promoter. Any part of the prize that is not taken for any reason is forfeited.

21.The prize does not (except as expressly stated) include:

i.any transport between a traveler’s residence and the Beechworth Honey cottage;
ii.any overnight accommodation while travelling to or from the Beechworth Honey cottage;
iii.any other travel or accommodation;
iv.any meals;
v.any incidental accommodation charges (such as telephone calls,  food and beverages);
vi.any spending money;
vii.any insurance (such as travel or health cover);
viii.any medical or health related services;
ix.any other ancillary costs which may be incurred by the winner or his/her guests in relation to the prize.

22.The prize cannot be exchanged for other travel or accommodation at other destinations of for cash.

WINNERS
23.The prize winner will be notified in writing which will be sent by e-mail to the e-mail address indicated in the entry.

24.The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.

25.The name of the prize winner will be published on the Beechworth Honey www.beechworthhoney.com.au and McKenzie’s Foods www.mckenziefoods.com.au websites throughout the period of the promotion.  Final results will be published on 10th September 2011.

26.Subject, where relevant, to any directions given under the legislation regulating the Competition:
i.Any unclaimed major prizes by 12/10/2011 the prize will be awarded to another Eligible Entrant in a redraw commencing at 9.00am  on 12/10/11 at 38-40 Hammersley Road, Corowa, NSW. If there is such a redraw, the name of the winner(s) in the redraw will be published  on the Beechworth Honey www.beechworthhoney.com.au and  McKenzie’s Foods www.mckenziefoods.com.au   corporate websites.
ii.Any unclaimed gifthampers by 30/11/11 will be awarded to another Eligible Entrant in a redraw commencing at 9.00am on 12/12/11 at 38-40 Hammersley Road, Corowa, NSW.  If there is such a redraw, the name of the winner(s) in the redraw will be published  on the Beechworth Honey www.beechworthhoney.com.au and  McKenzie’s Foods www.mckenziefoods.com.au   corporate websites

27.In order to be entitled to the prize, the winner and each person accompanying the winner must, if requested by the Promoter, agree to and sign:
i.an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
ii.a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
iii.If the winner of a prize is under 18 years of age, a parent or guardian of the prize winner must sign the documents referred to above (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize (or participation in that prize) are signed in accordance with this condition, as and when required by the Promoter.

ENTRY VERIFICATION
28.All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.

29.The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) fails to produce items as required by the conditions or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions.

GENERAL
30.The maximum total value of the prize is up to $3600.00.  Each major prize value is up to $500.00 each and the gifthamper prize is up to $100.00 each.

31.The prize is valued at 11/3/11. The Promoter takes no responsibility for any variations in value of the prizes.

32.A right to receive a prize is not transferable or exchangeable and, except as provided for in these conditions, cannot be taken as a monetary payment.

33.If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition subject to written directions from State Regulatory Bodies.

34.The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in any communication sent to (or by) the Promoter or any entrant or (ii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.

35.CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION, TO CAUSE DAMAGE TO OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

36.All of the Promoter’s decisions are final and no correspondence will be entered into.

37.The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.

38.To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred by any Eligible Entrant or any winner's guest on taking their prize or arising out of or otherwise in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from or contributed to by the negligence of a Relevant Party; (iii) any liability for personal injury or death.

39.The winner of the Prize and each person accompanying the winner, consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.

40.Entrants' personal information and that of any winner's guests will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and may be used to market its products to the entrant. The personal information of the winner and any winner's guests may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 2 or by calling 02 6033 2322 during business hours or by visiting the www.beechworthhoney.com.au or ww.mckenziesfoods.com.au. to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.

41.The promoter reserves the right to substitute a different prize of equal or greater value in its absolute discretion.

42.The promotion is a promotional opportunity and a “game of chance”.

43.The permit number for each state is ACT TP 11/01387.2, NSW 12/06436.5

44.All prizes remain the property of the promoter until they are delivered to the prize winner.

45.it is the participants ongoing responsibility to inform the Promoter of their current residential and email addresses and daytime telephone number, should any of these change during the Promotion.
