The promoter is Qantas Holidays Limited ABN 24 003 836 459 of Level 10, 241 O’Riordan Street, Mascot, NSW, 2020 (PH: 13 27 87). (Promoter) 3. The promotion commences at 9am (AEST) on 23 May 2011 and closes at 5pm (AEST) on 27 May 2011 (Promotion Period). 4. Entry is open only to Australian residents over the age of 18, who are employed as travel consultants by an IATA- approved travel agency physically located in Australia, which sells products offered by the Promoter (Eligible Consultant), excluding directors, management, employees and their immediate families of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate. Entry is not open to Flight Centre Limited employees or media. 5. To enter, Eligible Consultants must, during the Promotion Period, be the first to correctly answer the Jersey Boys question published every day in Travel Daily by submitting their answer to jerseyboys@traveldaily.com.au (Eligible Registration). 6. Consultants are only permitted to provide one entry per day and only agency email addresses will be accepted. 7. The Promoter is not responsible for any lost, late or misdirected entries. 8. The decision in awarding is final and no correspondence will be entered into. 9. There will be 5 prizes in total. 10. Each prize is valued at $290 AUD and consists of a double pass to a performance of Jersey Boys at the Theatre Royal. 11. The maximum total prize pool is $1450 AUD based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prizes. 12. Each prize will be awarded to the first 5 consultants from separate agencies who correctly answer the daily question during the Promotion Period. Consultants can only win once during the promotion period. In the event that no entries are received, the promoter reserves the right to keep the remaining double passes. If a prize is forfeited or remains unclaimed after the Prize Claim Period, the Promoter reserves the right to award the relevant Prize to the next Eligible Consultant who, during the Promotion Period, was the next to correctly answer the daily question. Consultants can not win more than once. 13. Winners will be notified by email the following day by Travel Daily and Qantas Holidays and will be published in Travel Daily. 14. Each winner will have five working days from the date they are notified that they have won, to accept their prize (Prize Claim Period). Each winner will be required to select a Jersey Boys Sydney show during the 2011 season excluding 8pm Saturday performances, subject to ticket availability and will be required to collect their tickets from the venue box office on the night of performance. Each prize must be taken as stated and no Trade Incentive Campaign – Jersey Boys Travel Daily Competition Terms and Conditions May 2011 Page 2 of 3 compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services, and they are not transferable to any other person, unless agreed to by the Promoter. If a winner decides not to take the prize, it will be forfeited. 15. If a prize or any part of a prize cannot, in the opinion of the Promoter, be provided for any reason, then the Promoter reserves the right to provide an alternative prize or part of a prize to the same value as that part of the prize being replaced. 16. The prize does not include flights, meals, ground transportation or any other costs not specifically stated. If a winner is based interstate, it will be their responsibility to make their own way to the event and at their own expense. 17. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion. 18. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties. 19. The exclusion of liability in clause 18 does not apply to limit or exclude liability: a) For personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or b) To the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law). 20. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at www.qantas.com.au/travel/airlines/privacy/global/en. 21. Receipt of a prize may have Fringe Benefits Tax (FBT) implications. To the extent that there is any FBT liability, this will be paid for by the employer of the recipient.
