TERMS AND CONDITIONS

1)     In these terms the ”Promoter”/”we” means Paramount Pictures Australia Pty of Level 3, 208 Clarence Street Sydney NSW 2000, ABN 85 0085 73171.

2)     By entering the “Transformers: Dark Of The Moon” competition (the “Competition”), entrants agree to be bound by these terms and conditions. Entrants may be required to provide written acknowledgement of these terms and conditions before receiving a prize. These terms and conditions will be governed by the laws of New South Wales, Australia and the state courts of New South Wales, Australia shall have exclusive jurisdiction in relation to any disputes arising therefrom.

3)     Entry is open to all residents of Australia over the age of 12 years, excluding employees of the Promoter and its advertising agencies, sub agents, respective employees and their immediate families.

4)     Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter and must ensure that their parent/guardian is willing and able to accept the first prize on their behalf if necessary.

5)     To enter, entrants must visit http://www.facebook.com/TransformersAU  and upload a photo of themselves proving that they are Australia’s biggest Transformers fan. This Competition is a game of skill.

6)     Uploaded photos must include ‘Australia’s Biggest Transformers Fan Entry’ in the photo description.

7)     The Competition will open on 24th May at03:00 pm and will close on 28th June 2011 at 3.00 pm. Entries received before or after this time will not be counted. All times referred to are Australian Eastern Daylight Standard Time or Australian Eastern Standard Time, whichever is applicable in New South Wales at the time. Entry times will in all cases be when the entry is received by the database of the service provider(s), not the time when the entry was submitted.

8.    Entries without the required information will be deemed incomplete and will not count towards an entry into the Competition

9)     The ten entries with the most Facebook ‘likes’ at 3.00pm on 28th June 2011 will become the Competition finalists. The entry deemed most creative and unique from the ten finalists, as judged by the Promoter, will be deemed the first prize winner and the remaining nine finalists will be runners up. The first prize winner and the runners up (together the “Winners” and each a “Winner”) will be notified via private messages to their Facebook account by 5pm on 29th June.

10)   Should there be more than ten top entries with the same number of ‘likes’ the Promoter reserves the right to select the finalists based on the creativity and uniqueness of their entries.
11)   The first prize consists of AUD $5000, payable by a preloaded eftpos card. The first prize Winner is under the age of 18 at the time of entry, the prize will be given to their notified parent or guardian aged 18 or over, for them to accept on the Winner’s behalf.

12)   Each runner up will receive a “Transformers Dark Of The Moon Fan Pack” containing: 1 x Transformers 1 DVD (RRP$12.99), 1 x Transformers 2 DVD (RRP$12.99), 1 x Transformers Dark Of The Moon Soundtrack (RRP $24.99), 1 x Transformers Hasbro Toy (RRP$29.99), 1 x Transformers Dark Of The Moon Power Charging Mat (RRP$150), 1 x Transformers Dark Of The Moon Webcam (RRP $45), 1 x Transformers Game for Wii (RRP $79.95). Total prize pack value $355.91.

13)   Prizes are not transferable or redeemable and must be taken as offered. No alternatives will be offered. If, due to circumstances beyond the Promoter’s control, Promoter is unable to provide the stated prize(s) the Promoter reserves the right to award a substitute prize. Prizes are subject to any additional terms and conditions of the manufacturer / supplier.

14)   The Promoter accepts no responsibility for any variation in the value of the prizes. All prize values are in Australian dollars and are correct at time of creation of these terms and conditions. Any change in the value of the prize between the publishing date and the date prizes are claimed is not the responsibility of the Promoter.

15)   Once a prize has left the Promoter’s premises the Promoter is not liable for any damage to or late delivery of the prize.

16)   If any prize remains unclaimed by 5th July 2011, the relevant Winner’s entry will be deemed invalid and a second selection to determine the Winner will take place on 6th July 2011. Such Winner shall be notified by private Facebook message within five days of such selection taking place.

17)   Without in any way limiting the foregoing or limiting, expanding or amending the Terms of Use residing on http://www.paramountpicturesintl.com/intl/au/index.html?deeplink=terms (which Terms of Use shall remain in full force and effect) if the Promoter considers, in its sole discretion, that any entry is inappropriate, fraudulent or infringes or violates someone else’s rights such entry may be removed from the webpage and/or disqualified from the Competition, as the Promoter may determine in its sole discretion.

12) By submitting a photo, the entrant represents and warrants that no laws were broken in the creation of the photo and that their photo is their own original creation, has not been copied in whole from any other work, has not been previously published, does not violate the rights of any other person or company (including but not limited to privacy rights, publicity rights, trademark rights and copyrights), does not defame, libel, or slander anyone or any entity, and does not contain offensive, defamatory, vulgar, obscene or profane content, as determined by the Promoter in its sole and absolute discretion.

18)   Submitted photos must contain solely an image of the individual entrant and may not contain any of the following:

• Anyone other than the entrant

• Crude, vulgar or offensive pictures, depictions, images, language and/or symbols

• Nudity

• Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements

• Phone numbers, personal addresses – physical or email or otherwise

• Website or web page links

• Illegal (e.g., discriminatory, harassing) or inappropriate activity, behaviour or conduct

• Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by the Promoter, in its sole discretion 

19)   The Promoter's decision in relation to any aspect of the Competition is final and binding on each entrant. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected mail.

20)   Entry is free. Any costs associated with entry to the Competition, such as telephone or internet usage, are the entrant’s responsibility. Entrants should seek the permission of the bill payer before entering.

21)   This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to the Promoter and not to Facebook. The information you provide will only be used to contact you about the prize.

22)   It is the entrant’s responsibility to advise the Promoter of any change of contact details.

23)   Entries via any computer generated automated system will be deemed ineligible and will not be entered into the draw.

24)   To the extent permitted by law, any Winner of the Competition releases the Promoter and Facebook from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the Winner as a result of any loss or damage to any physical property of the Winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter or the prize.

25)   Entrants agree to indemnify, defend and hold the Promoter harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements arising out of or related to a breach of the foregoing representations and warranties.

26)   The Promoter is not responsible for any lost or ineligible entries, or incorrect or inaccurate information, either caused by the enrtant or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

27)   In the event of war, terrorism, state of emergency, disaster or, without limitation, any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the Competition.

28)   If, for any reason, the Competition is not capable of running as planned including, but not limited to, technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition.

29)   All entries become the property of the Promoter. Entrants grant to the Promoter an irrevocable, world-wide, fully-paid, perpetual license to use their entries in any and all media, now known or hereafter devised, in any manner related to the Competition and/or the motion picture “Transformers 3: Dark Of The Moon” without prior notice, approval or compensation.

30)   Winners of the Competition agree to participate in any news media activities surrounding the Competition as reasonably requested by the Promoter.

31)   The Promoter collects entrants’ information in order that entrants may participate in the Competition and will disclose such information to third parties in order to operate the Competition.  We may share your information with other persons or entities that assist us in performing the above or with other companies that provide the prizes or elements of the prizes for the Competition.
