TERMS AND CONDITIONS
Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions.
Entries are open to female residents of Australia aged 18 years or over as at the entry date. Employees and their immediate families of the Promoter, its agencies, related bodies corporate and franchisees associated with this promotion are ineligible.
Entries open at 9am ADST on 23/04/11 and close at 5pm ADST on 04/06/11. If you are represented by a modelling agency then you must get written consent from an agency representative prior to entering into this competition. It is your sole responsibility to ensure that you comply with any and all contractual obligations with your modelling agency and are in no way in breach of such obligations by entering into this competition. Contract details can be supplied to modelling agencies upon entrant request.
You can only enter the Search for The Next Chiko Chick Competition by completing and submitting, in full, an Entry Form online at www.chiko.com.au. The Entry Form will include an acknowledgement and release which will authorise the Promoter’s use of the entrant’s name, voice and image in any media worldwide for any marketing, advertising and/or publicity purposes for an unlimited period, without any further reference or payment to the entrant and further warranting that there is no restriction or obligation which would prevent such use by the Promoter.
Only entrants who have completed and submitted an Entry Form can be considered for the Semi-finalists and Finalists periods of the competition.
Successful entrants will be selected by a panel of experts (Judges) and announced on 10/06/11 to progress to the next round. Successful entrants will be notified by email on or about 13/06/11.
SEMI FINALISTS EVENT
50 Semi Finalists will be selected and expected to attend a casting session on 1 night during the week of 11/07/11. The specific date required is dependent on the state in which the entrant resides.
All costs incurred by the entrant including but not limited to transport, spending money, meals, taxes, insurance, transfers and all ancillary costs associated with attending and taking part in the Semi Finalist Event, shall be the sole responsibility of each entrant.
It is a condition of attending the Semi Finalist Event that entrants must provide original photo identification, to the satisfaction of the Promoter, as proof of identity and residency and that confirms that they are 18 years of age or over.
Once the Semi Finalist Event has been completed, the Judges will decide who will be selected to progress through as finalists (Finalists).
If you are selected as a Finalist, the Promoter will notify you by telephone on or about 25/07/11 and you will receive confirmation by mail on or about 27/07/11.
FINALIST EVENT
The Finalists will be required to attend the Chiko Calender & Poster Photo shoot and Filming in a secret location within Australia between 05/09/11 – 18/09/11.
Each Finalist will be provided with a return economy airfare to the photo shoot location from the Finalist’s nearest capital city, return transfers to the location, meals and six nights accommodation in a standard room.
All additional costs, including but not limited to spending money, taxes, insurance, transfers and all other ancillary costs associated with attending and taking part in the Chiko Calender & Poster photo shoot and filming, shall be the sole responsibility of each Finalist.
It is a condition of attending the Chiko Calender & Poster Photo shoot and Filming that Finalists have no criminal record and acknowledge, consent and agree to the Promoter’s use of their name, voice and image in any media worldwide for any marketing, advertising and/or publicity purposes for an unlimited period, without any further reference or payment to the Finalist, and further warrant that there is no restriction or obligation which would prevent such use by the Promoter. Upon request, each Finalist must sign a legal release and/or any other legal documentation, in a form determined by the Promoter in its absolute discretion.
If a Finalist is unable to attend the Chiko Calender & Poster Photo shoot and Filming, the Finalist will automatically forfeit her right to take part in the Chiko Calender & Poster Photo shoot and Filming and any entitlements. In this event, the Promoter may, in its absolute discretion, select another entrant to attend the Chiko Calender & Poster Photo shoot and Filming as a Finalist. Finalists must confirm their attendance by 19/08/11.
One Finalist will be selected to be the Next Chiko Chick (Winner). The Winner will be announced at the Winners Function on the final night of the Chiko Calendar shoot and via the Australian media. The Winner will also be notified in writing.
This is a game of skill and chance plays no part in determining the selection process. Each entrant will be individually judged based on the various criteria as determined by the Promoter in its absolute discretion, including but not limited to the entrant’s personal style, attitude, personality, qualities as an ‘Aussie’ girl and presentation in front of the camera.
The Judges’ decision is final and no correspondence will be entered into with any entrant regarding this competition.
MAJOR PRIZE
The Winner will win the Major Prize valued at up to $AU25,000 consisting of:

the Winner’s image being used in advertising campaigns and other advertising material, such as posters and other marketing at the sole discretion of the Promoter
•
A 12 month contract with Chiko valued up to $AU15,000
•
A travel voucher to the value of $AU5,000
•
A Chiko Surfboard and lessons valued at $AU1,000
•
A shopping spree valued at $AU500
•
A MAC Beauty voucher valued at $AU500
•
A Luggage Pack valued at $AU250
•
A week away in a luxury location shooting the Chiko Chick Calendar valued at up to $AU3,000
The prize must be taken as stated and no compensation will be payable if the Winner is unable to take the prize as stated. The prize is not transferable to another person (unless agreed by the Promoter) or exchangeable for other goods and services and cannot be redeemed as cash or other goods and services. Any element of the prize that is unused will be forfeited and no compensation will be paid in lieu of that element of the prize.
It is a condition of accepting the Major Prize that the Winner will, upon request, sign a Deed of Copyright Assignment, Release and Indemnity (Deeds), in a form determined by the Promoter in its absolute discretion, setting out the Winner’s obligations with respect to participating in certain photographic sessions, and other media-related marketing, advertising, promotional and publicity activities as required by the Promoter and setting out the Promoter’s rights in respect of the use of the Winner’s image in media-related marketing, advertising, promotional and publicity activities.
The prize will be awarded in full and final satisfaction of the Winner’s participation in all Chiko marketing/advertising/ promotional/publicity activities, and no further payments will be made. The Winner acknowledges that she will not be retained under a modelling contract or any other form of talent agreement with any third party and will not be authorised to make any form of representation (whether written, verbal or otherwise) on behalf of the Promoter without the Promoter’s prior written consent. The Promoter will determine, in its absolute discretion, the nature and level of involvement and media exposure (if any at all) for all marketing/advertising/promotional/publicity activities. The Promoter reserves the right to refuse to allow a Winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate.

The remaining runner-up Finalists (a maximum of 5) will each receive:

OTHER IMPORTANT INFORMATION
In the event that for any reason whatsoever the Winner or a Finalist does not take an element of their prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the Winner/Finalist and cash will not be awarded in lieu of that element of the prize. Prizes or any unused portion of a prize is not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of any prize or any aspect of a prize. In the event that a prize is not available, the Promoter reserves the right to substitute a prize in its absolute discretion to the same and equal recommended retail value and/or specification or to provide a cash equivalent.
All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By submitting an entry, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry
being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant, including sending the entrant electronic messages. All personal details of the entrants will be stored at the office of the Promoter. A request to access, update or correct any information should be directed to that office. The Promoter’s full privacy policy is available on request. In addition, all entries (including all accompanying photographs, responses to the personality test questions, etc.) become the property of the Promoter and it is a condition of entering that those entries may be used by the Promoter for their own promotional, marketing and publicity purposes without restriction or the payment of any fee to the entrant.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in this promotion, the cancellation, termination, modification or suspension of the promotion by the Promoter or taking any prize, except for any liability which cannot be excluded by law.
Without limitation, each entrant hereby releases, waives, and forever discharges the Promoter and the Agency (and their respective owners, officers, directors, shareholders, principals, agents, representatives and employees), in respect of any losses, costs, claims, actions, demands, liabilities or expenses (including, without limitation, legal costs and expenses) or damage (whether actual, contingent or prospective) of whatsoever nature or description (whether foreseeable or not, and whether caused by any act or omission or negligence on the part of the Promoter or the Agency or not) that the entrant or any of their respective successors, guardians, legal representatives or assigns may have against the Promoter or the Agency or either of them on account of any injury to the entrant, and/or any property of the entrant; and/or resulting in the death of the entrant, arising out of or in connection with the entrant’s participation in, this competition.
The Promoter reserves the right to cancel, terminate, modify or suspend the promotion at any time.
If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this contest, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
The Promoter reserves the right to request prize winners to provide proof of identity and proof of residency at any time. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to conduct security verification checks at its absolute discretion.
The Promoter accepts no responsibility for any legal or tax implications that may arise from entering the Competition or being awarded the prize winnings. Independent legal and financial advice should be sought by all entrants.
