Mario Kart Scorecard Competition 2011


You and your guests will get to play Mario Kart Wii on the big screen before watching 'Cars 2' in 3D. Of course you'll also be treated to drinks, popcorn and Choc Tops! There will be a winner in each of VIC, QLD, NSW, WA and SA, so be sure to enter for your chance to win!

Terms and Conditions of Participation

Information on how to participate and prizes form part of these Terms and Conditions. Participation in the Mario Kart Scorecard Competition 2011 (Competition) indicates your acceptance of the terms and conditions of participation set out below. Participation which does not comply with these terms and conditions will be deemed invalid.
The Competition is conducted by Nintendo Australia Pty Ltd (ABN 43 060 566 083) of 804 Stud Road, Scoresby, Victoria, 3179 (Promoter).
Participation in the Competition is open to people residing in Victoria, New South Wales, Queensland, Western Australia and South Australia. It is not open to employees of the Promoter and members of their immediate families. By participating in the Competition you represent that you are eligible to participate.

To participate you must obtain a ‘Score Card’. Score Cards will be available to be downloaded from the Promoter’s website from 29th April 2011 and in some magazines selected by the Promoter and at some events selected by the Promoter.
Participants are required to play Mario Kart at home with their family/household members and after play, complete the Score Card then take a “creative” photo of themselves, with their family/household members, holding the Mario Kart Score Card (“Mario Kart Score Card Photo)”.
Participants are required to email scorecard@nal.nintendo.com.au with their name, address, phone number and a copy of the Mario Kart Score Card Photo. All entries must be received by the Promoter by 6 June 2011. All Mario Kart Score Card Photos submitted by the Promoter may be used by the Promoter on the Promoter’s website.

There will be a winner in each of the five (5) states (“Winners”). The Winners will be the Participant in each of these states that emails to the Promoter the most creative Mario Kart Score Card Photo. The definition of creative is at the sole discretion of the Promoter. The Winners will be announced on the 13 June 2011 on the Promoter’s website.
Each Winner will receive an exclusive Gold Class Cinema Session for 30 guests of their choosing (inclusive of themself) where they can play Mario Kart on the big screen and be treated to a movie screening of ‘Cars 2’ (valued at $2753 per Cinema Session) (“Cinema Session”) (“the Prize”). The Cinema

Sessions will take place on 26th June 2011 at a location in each of the five (5) states- as listed below:
Sydney – George St Event Cinemas
Melbourne – Crown Village Cinemas
Brisbane – Indooroopilly Events Cinemas
Adelaide – Marion Event Cinemas
Perth – Innaloo Event Cinemas

Nintendo will contact each Winner prior to the Cinema Sessions and advise all relevant details. The dates and locations of the Cinema Sessions will be fixed and if any Winner is unable to attend a Cinema Session the Winner must agree to forfeit the Prize and another Winner for that city will be selected. The Winner and all guests must make their own way to the Cinema location.
The total Prizes being offered are valued at a maximum of $13,765.00
The declaration of the Winners by the Promoter will be final and no correspondence will be entered into regarding this declaration.
The Prizes cannot be exchanged, transferred or redeemed for cash.
The value of the Prizes are given in Australian dollars. The value of the Prizes are the suggested retail price. The value of the Prizes may be subject to variation and the Winners will not be entitled to receive from the Promoter compensation for any variation in Prize value. If a Prize is unavailable for any reason, the Promoter may provide to the Winner another item of equal or greater value.
Participants in the Competition may be photographed and/or filmed by or for the Promoter at the Cinema Sessions. Participants agree to assign all their rights in such photographs and/or footage to the Promoter and agree that such photographs and/or footage may be posted on the Promoter’s website and other public forums.

Neither the Promoter nor its officers, agents, employees or associated companies will be liable for any loss (including any indirect or consequential loss) or damage suffered or incurred by any person participating in the Competition unless such liability may not be lawfully excluded in which case their liability will be limited to the greatest extent permitted by law.
If there is a dispute as to the identity of participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.
The personal information provided by participants to the Promoter may be used by the Promoter for the purpose of conducting the Competition.

Participants' personal information may be distributed by the Promoter to persons engaged by the Promoter to conduct the Competition. The Promoter is bound by the provisions of the Privacy Act 1988. Participants may access the personal information held by the Promoter by contacting the Privacy Compliance Officer, Nintendo Australia Pty Limited, 804 Stud Road, Scoresby, Victoria, 3179.
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
