Terms and Conditions


1.   Information on how to enter this competition and prizes form part of these terms and conditions of entry. Entry into this competition is deemed acceptance of these terms and conditions of entry. Entry is via www.take40.com/competitions. This is a Game of Skill and chance plays no part in determining the winners.  Participants can enter more than once, however each entry must be substantially unique.

2.   Entry into this competition is open to all Australian residents aged 13 years and over. Entrants under the age of 18 must obtain the prior permission of a parent or legal guardian over the age of 18 to enter. Directors, officers and employees of MCM Media and Johnson & Johnson Pacific Pty Limited and each of their immediate families, associated agencies of MCM Media and companies associated with the competition are not eligible to enter the competition.
   
3.   To enter the competition, entrants are required to go to www.take40.com and click through to the ?Clean & Clear® - Win awesome prizes for you + your BFF!? page and tell us in 25 words or less ?what?s the most fun you?ve had with your BFF??. The participant will then be asked to register their details and select their prize of choice. Entrants will be required to leave their details including name, date of birth, address, phone number and e-mail address. Incomplete, incorrect and incomprehensible entries will be deemed invalid.

4.   The Promoter and Johnson & Johnson Pacific Pty Limited accept no responsibility or liability for any entries not received or included for any reason, including (without limitation) due to technical or other failure.

5.   The cost of accessing the competition website will be dependent on the entrant?s individual Internet Service Provider and the responsibility of the entrant.

6.   The competition commences on Friday 27th May 2011 at 12:00pm (AEST) and online registration commences at this time. All online registrations must be received by 12:00pm (AEST) on Friday 24th June 2011.

7.   All responses will be read and judged by a judging panel at MCM Media, Level 1, Building 210, The Entertainment Quarter, Moore Park, NSW 2021 on Friday 24th June at 1:00pm (AEST). The winners will be notified by email within 2 working days of the judging date. Winners will be determined on the originality and creativity of their entries.

8.   Prizes will be delivered to winners within 28 days of the judging date.

9.   Entrants acknowledge and agree that Johnson & Johnson Pacific Pty Ltd may advertise the names of winners on the Clean & Clear® Facebook page.

10.   Prizes: The fifteen best entries as determined by the judges will be awarded the following prizes.

Each gift pack is valued at $59.84.

Each prize is valued at $36.00

11.   The total prize pool is valued at $1,458.40.

12.   Judges decision is final and no correspondence will be entered into. Prizes are not exchangeable or transferable and cannot be redeemed for cash.  All online registrations are deemed to be received at the time of receipt into the Promoter?s database, and not at the time of transmission by the entrant. 

13.   All prize values are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value.

14.   The Promoter, Johnson & Johnson Pacific Pty Limited and each of their related bodies corporate, associated agencies and companies associated with this competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person?s negligence) in connection with or arising out of this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

15.   Should an entrant?s contact details change during the promotional period, it is the entrant?s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

16.   MCM Media, Johnson & Johnson Pacific Pty Limited and each of their related bodies corporate, associated agencies, and companies associated with this competition will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.

17.   The Promoter reserves the right to request winners to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Where the winner is aged less than 18 years old, the Promoter reserves the right to request the winners to provide proof that they obtained the prior permission of a parent or guardian over the age of 18 to enter. Proof of identification, age, residency and entry validity considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.

18.   The prize winners must, at the request of the Promoter or Johnson & Johnson Pacific Pty Ltd, participate in all promotional activity (such as publicity and photography) surrounding the winning of and using the prize, free of charge, and consent to the Promoter and Johnson & Johnson Pacific Pty Ltd using each of their name and image in promotional material in any media worldwide.  [

19.   All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition and for publicity purposes surrounding the competition) but no further use of this information will be made without prior consent. If the entrant has marked the ?opt-in? box on the entry form, the entrant consents to the Promoter providing Johnson & Johnson Pacific Pty Ltd (JJP) with the entrant?s personal information and consents to JJP using this information for future promotional and marketing purposes regarding JJP?s products and services including contacting the entrant via any medium including, but not limited to, mail, telephone and commercial electronic messages   A copy of JJP?s Privacy Policy is available at www.jnjaust.com.au/privacy.jsp.
 
20.    If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the competition.

21.   In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions.

22.   The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by any person who interferes or tampers with or benefits from any interference or tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
