TERMS AND CONDITIONS

 

1. General

 

(a) STYLETREAD.com.au, Unit 44, 2 Slough Business Park, Silverwater NSW, 2128.  The prize vauled at $300 will be provided by Peep Toe Shoes.

 

(b) Information on how to enter forms part of these Terms and Conditions.

 

(c) By entering any competition promoted by StyleTread you agree to these Terms and Conditions and any other applicable terms as advised by StyleTread.

 

(d) For the purposes of these Terms and Conditions, StyleTread includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.

 

2. Entry requirements

 

(a) Entrants must be residents of Australia.

 

(b) The employees, agents and contractors of StyleTread, any of its affiliate, parent or subsidiary companies are not eligible to enter the Competition.

 

(c) Direct family members of any person included in 2(b) are not eligible to enter.

 

(d) The competition can be entered by online via www.styletread.com.au/peeptoe-quiz

 

(e) To enter, entrants must answer the following question: If you were to order you favourite Peep Toe shoes on StyleTread.com.au, how much would you pay for delivery?

 

(f) All entries must include full contact details: full name and email address

 

(g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.

 

(h) Any information, photographs, audio-visual or other material provided to StyleTread by an entrant as part on an entry to this competition will not be returned to entrants. Entrants are advised to not send original material.

 

(i) Entries to this competition open on Friday, June 24, 2011 at 9:01am (AEST) and close on July 8, 2011 at 11:59pm (AEST). Entries received after closing dates will not be eligible.

 

(j) StyleTread accepts no responsibility for lost entries.

 

(k) By entering the competition and checking the opt-in box on the entry form, entrants agree that their full name and email address will be provided to StyleTread for the purposes of marketing and they agree that StyleTread may send them marketing/promotional material. All communications from StyleTread will be subject to all laws and regulations in respect of commercial electronic messages.

 

(l) Unless otherwise agreed, any personal or confidential information submitted to StyleTread by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with StyleTread’s Privacy Policy.

 

3. Judging

 

(a) Entries will be drawn and judged at StyleTread’s office at Unit 44, 2 Slough Ave Slough Business Park, Silverwater, NSW 2128 on July 12, 2011 at 12:00pm (AEDST).

 

(b) This Competition is a game of skill.  A judge appointed by StyleTread will randomly select the winner based on those entrants who answered the game of skill question correctly. 

 

(c) The prize winners will be notified by 5:30pm on July 12, 2011.

 

(d) The prize winners will be notified by email at the details provided in their entry. All reasonable efforts will be made to contact the prize winners. StyleTread will not be liable to any prize winner who cannot be contacted at the details provided in their entry.

 

(e) If StyleTread is unable to contact the prize winners after reasonable efforts, StyleTread may assign the prize to the entry judged the next best entry in the competition.

 

(f) The decision of the judges is final and StyleTread will not enter into correspondence or communication regarding the judges’ decisions even where StyleTread may not have acted reasonably or where StyleTread is shown to have made a decision in error.

 

4. Prize

 

(a) Randomly the appointed judges will select the winner of the $300 Peep Toe voucher based on those entrants who answered the game of skill question correctly.

 

(b) The prize cannot be used in conjunction with any other discounts or special offers.

 

(c) The prize is not transferable for any other brands.

 

(d) The prize can only be used toward ONE pair of Peep Toe shoes only.

 

(e) The prize can only be used one time only.

 

(f) StyleTread may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before StyleTread gives the prize over.

 

(g) StyleTread may require any person collecting a prize to sign a copy of these Terms and Conditions.

 

(h) Once a prize has been collected StyleTread is not responsible for the use or distribution of any prize.

 

(i) StyleTread will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.

 

(j) If a prize referred to in this competition becomes unavailable for any reason StyleTread reserves the right to substitute that prize for a similar item of similar value.

 

(k) Prizes are not transferable or redeemable for cash. StyleTread accepts no responsibility for any variation in the value of the prizes.

 

(l) Prize winners agree to participate in any promotional activity promoting StyleTread, prize sponsors and/or the competition at the reasonable request of StyleTread.

 

5. Intellectual Property

 

(a) StyleTread may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.

 

(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of StyleTread and StyleTread may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.

 

(c) StyleTread may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).

 

6. Warranties

 

(a) Entrants warrant and represent to StyleTread that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.

 

(b) Entrants indemnify StyleTread against any claim, loss or damager suffered by StyleTread as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.

 

(c) If StyleTread becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to StyleTread , StyleTread may deem that prize winner ineligible.

 

7. Governing Law

 

These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
