1. General

(a) MTV Networks Australia Pty Ltd (ABN: 18 107 601 418) of Ground Floor, 4-16 Yurong St East Sydney, Australia NSW 2010 (“MTVNA”) is the promoter of this competition (“Competition”).

(b) By entering any competition promoted by MTVNA you agree to these Terms and Conditions and any other applicable terms as advised by MTVNA.

(c) The competition will be advertised on the MTV channel and via the MTV website at www.mtv.com.au/snowjam.

(d) The MTV Snow Jam event (the “Event”) is a private event and will be held in Melbourne, Victoria and Mt Buller Ski Resort, Victoria from Thursday 14 July 2011 until Sunday 17 July 2011.

(e) In these Terms and Conditions:

i. a reference to dollars or $ is a reference to Australian dollars
ii. a reference to a business day means a day on which MTVNA is open for business in Sydney, Australia.

2. Entry requirements

(a) Entrants must be residents of Australia.

(b) Entrants must be aged 18 years and over.

(c) The employees, agents and contractors of MTVNA, any of its affiliate, parent or subsidiary companies or any agency associated with the Competition are not eligible to enter the Competition.

(d) Direct family members of any person included in 2(c) are not eligible to enter.

(e) The competition can be entered online via www.mtv.com.au

(f) To enter entrants must:
i) Click on the link to the competition website at www.mtv.com.au
iii) Fill out all of the required data entry fields in the application to accompany the entry.

(g) All entries must include full contact details for each entrant: name, email address and telephone number.

(h) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.

(h) Entries to this competition open at 3:00pm (AEST) on Friday 24 June 2011 and close at 11:59am (AEDST) on Friday 8 July 2011. Entries received after closing dates will not be eligible.

(i) MTVNA accepts no responsibility for lost entries.

(j) Incomprehensible and incomplete entries will be deemed invalid.

(k) Entrants in the competition may enter as many times as they like.

(l) The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

(m) Unless otherwise agreed, any personal or confidential information submitted to MTVNA by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with MTVNA’s Privacy Policy, available at www.mtv.com.au .

(n) MTVNA reserves the right in its sole discretion to disqualify any individual who MTVNA has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. MTVNA’s legal rights to recover damages or other compensation from such an offender are reserved.

3. Judging

(a) Competition will be drawn on Friday 8 July 2011 at 2:00pm (AEST) at Ground Floor, 4-16 Yurong St East Sydney NSW 2010.

(b) 1 major prize winner (“Major Prize Winner”) and 14 daily minor prize winners (“Minor Daily Prize Winners”) will be determined by random draw. The daily prize period is from 3:00pm Friday 24 June – 11:59am Saturday 25 June, and from 12:00pm – 11:59am for all other days during the Competition period.

(c) The winners will be notified by phone and email immediately following the draw date The Major winner will be published in the Public Notices section of the Australian newspaper on Tuesday 12 July 2011.

(d) Only one prize per person will be awarded (South Australian residents are entitled to win more than one prize). In the event that an entrant (other than a South Australian resident) wins more than one instant prize, the first instant prize won will be awarded and the remaining prizes will be redrawn.

(e) Subject to State regulation, due to date of the prize an unclaimed Major Prize draw will take place at Ground Floor, 4-16 Yurong St East Sydney NSW 2010 on Tuesday 12 July 2011 at 9:00am (AEST). The winner will be notified by phone and email immediately following the draw date. The Major winner will be published in the Public Notices section of the Australian newspaper on Wednesday 13 July 2011.

(f) Subject to State regulation, an unclaimed Minor Prize draw will take place at Ground Floor, 4-16 Yurong St East Sydney NSW 2010 on Friday 7 October 2011 at 9:00am (AEDST). The winners will be notified by phone and email within two days of the draw date.

(g) The decision of the judges is final and MTVNA will not enter into correspondence or communication regarding the judges’ decisions even where MTVNA may not have acted reasonably or where MTVNA is shown to have made a decision in error.

4. Prizes

(a) (i) The Minor Daily Prize Winners (14 in total) will each receive: 1 x Burton “Boothaus” duffle bag valued at $59.95.
The Minor Daily Prize Pool is valued at $839.30
(ii) The Major Prize Winner will win the following prize (“Major Prize”);

• 2 x return economy airfares (for the Major Prize Winner and one guest) from the Major Prize Winner’s nearest capital city to Melbourne (subject to Clause 4(c)) departing on Thursday 14 July 2011, returning Sunday 17 July 2011, valued at a maximum of $700.00
• 1 night twin share accommodation for Major Prize Winner and guest minimum 3.5 star hotel in Melbourne on Thursday 14 July 2011 (checkout morning of 15 July 2011), valued at a maximum of $209.00.
• Airport transfers to and from Melbourne airport and to and from Melbourne to Mt Buller valued at a maximum of $55.00
• 2 nights twin share accommodation for Major Prize Winner and guest, minimum 3.5 star hotel in Mt Buller, Victoria on Friday 15 July 2011 and Saturday 16 July 2011 (checkout morning of 17 July 2011), valued at a maximum of $1260.00.
• 2 day ski package hire for the Major Prize Winner and guest valued at $886.00, consisting of:
 2 consecutive day ski lift pass for Mt Buller Resort for the Major Prize Winner and guest for 15 and 16 July 2011 valued at
 1 x 1 day group ski/snowboard lesson for the Major Prize Winner and guest
 1 x 2 day’s ski or snowboard hire for the Major Prize Winner and guest (ski hire includes premium skis, boots and poles, snowboard hire includes premium snowboard, bindings and boots)
 1 x 2 day outerwear (ski jacket and pants) hire for the Major Prize Winner and guest

• 1 x Burton “Hero” snowboard, for the Major Prize Winner (length to be determined after competition drawn), RRP $629.95
• 1 x Custom EST snowboard bindings (suitable for the “Hero” snowboard) for the Major Prize Winner, RRP$299.95
• 1 x Burton “Day Hiker” 20L Backpack for the Major Prize Winner, RRP$99.95
• Access into the Snow Jam Melbourne and Mt Buller Event.

The total Major Prize Pool is valued at up to $4,139.85

(b) The total Competition prize pool is valued at up to $4,979.15

(c) Once a prize has been collected MTVNA is not responsible for the use or distribution of any prize.

(d) Other than as expressly set out in Clause 4(a)(ii), the Major Prize Winner and their guest will be responsible for any safety gear and ski wear deemed necessary to participate in the mountain activities included in the Major Prize, including without limitation helmets, wristguards, gloves, goggles and thermal clothing.

(e) MTVNA will be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.

(f) MTVNA reserves the right to refuse to allow the Major Prize Winner or his or her guest to take part in any or all aspects of the Major Prize, if the Promoter determines that the Major Prize Winner or his or her guest is not in the mental or physical condition necessary to be able to safely participate in the Major Prize.

(g) It is a condition of accepting the prize that the Major Prize Winner and his or her guest may be required to sign an acknowledgment that each agrees to participate in the prize at their own risk and that MTVNA is not responsible for any injury resulting from any such participation, except to the extent any injury is due to the negligence or willful misconduct of MTVNA.

(h) If a prize referred to in this competition becomes unavailable for any reason MTVNA reserves the right to substitute that prize for a similar item of similar value Subject to State regulation.

(i) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for any variation in the value of the prizes Subject to State regulation.

(j) Prize winners agree to participate in any promotional activity promoting MTVNA, prize sponsors and/or the competition at the reasonable request of MTVNA.

(k) If the Major Prize Winner and his or her guest reside in the greater metropolitan area of Melbourne, flights will not be included in the Major Prize, and it will be the Major Prize Winner’s and their guest’s responsibility to make their way to and from the Melbourne hotel.

(l) The prizes under this Competition cannot be used in conjunction with any other discounts or special offers.

(m) Frequent Flyer points are not available for any of the flights included in the Major Prize.

(n) Airline tickets included in the Major Prize cannot be used as part payment of another airfare.

(o) The prize must be taken for the dates specified and is subject to hotel and flight availability.

(p) If the Major Prize Winner and/or their guests determine that travel insurance is required, they will be responsible for arranging and paying for such travel insurance.

(q) The Major Prize Winner and their guests must depart from and return to the same point of departure and travel together.

(r) The Prize includes accommodation costs only and all incidental costs including meals (not expressly included in the Major Prize) will be the responsibility of the Major Prize Winner. A credit card imprint or cash deposit may be required from the Major Prize Winner and/or guests at check-in to the hotel for any incidental charges.

(s) MTVNA may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before MTVNA gives the Prize over.

(t) MTVNA may require any person collecting a prize to sign a copy of these Terms and Conditions.

(u) Unless expressly stated all other ancillary costs and expenses associated with taking any prize under this Competition become the responsibility of the winner.

(v) The Major Prize must be taken together as a package, and is for the specified dates of the event only). If the winner (for whatever reason) is unable to travel or does not take an element of the major prize within the time stipulated by the Promoter then the prize will be forfeited and cash will not be awarded in lieu of the major prize.

(w) Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. (x) The prizes under this Competition cannot be used in conjunction with any other discounts or special offers.

(y) Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

5. Intellectual Property

(a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.

(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.

(c) MTVNA may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).

6. Warranties

(a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law of Australia.

(b) Entrants indemnify MTVNA against any claim, loss or damager suffered by MTVNA as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.

(c) If MTVNA becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may deem that prize winner ineligible.
