http://readytogo.holeproofexplorer.com.au/index.html Terms and Conditions HOW TO ENTER To be eligible to enter, individuals must visit www.holeproofexplorer.com.au, follow the prompts to registration page, input the requested details and explain [in 500 words or less] about your upcoming adventures to win and then submit their completed registration. Each month, a judging panel will choose the winner from the submissions lodged in the preceding month, being the person who, in the opinion of the judging panel, deserves to win $2,000 to make their next adventure happen. The monthly grants will begin 31.7.2011 and run for 12 months. TERMS AND CONDITIONS 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Promotion commences at 9.00am on 21.6.11 and entries close at 11.59pm AEST on 30.6.12. 3. Entry is open to Australian and New Zealand residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 5. Incomplete or indecipherable entries will be deemed invalid. The Promoter reserves the right to vet all entries prior to them going live on the web site and reserves the right to remove any entries at any time in their absolute discretion. However, the Promoter is not responsible for any entries uploaded to the site and visitors to the site view it at their own risk. 6. Entrants can only enter once. Entrants warrant that: (a) they will not submit any material that is unlawful or fraudulent or that may be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist or otherwise unsuitable for publication (b) they will only submit material which they have personally created or otherwise have a right to submit and which is not misleading; and (c) their entry shall not contain viruses or cause injury or harm to any person or entity. 7. The winners will be notified by telephone and email. This is a game of skill and chance plays no part in determining the winners. The Promoter’s decision is final and no correspondence will be entered into. 8. Each monthly winner will win a $2,000 grant to put towards their next adventure. Winners are required to use the grant towards funding their next adventure (whether that be in travel expenses, accommodation, equipment or otherwise) and the Promoter reserves the right to be provided, and the winners will provide, upon request, evidence of their usage of the grant money in this manner. Any winner found to have used the money in a contrary manner may be required to refund the grant to the Promoter. 9. It is a condition of accepting a prize that the winner will provide to the Promoter at least five to ten images from their adventure in digital format and a 200-word account of their holiday within 14 days of completion. Such account will meet the same requirements as required of entries under clause 7. 10. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf. 11. Total prize pool value is up to $24,000. 12. Entrants consent to the Promoter using the entrant's name, likeness, image, voice and/or submission in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 13. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. 15. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. 16. Promoter. Entrants and winners assign all of their rights, title and interest (including copyright) in and to their submission to the Promoter from the time of submission. Entrants and winners consent to any use of their submissions by the Promoter, including any use which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 17.
