Participation in an ebee is deemed acceptance of these Terms and Conditions. 1. Definitions Ebee® – is a means provided by Ebees.com.au for an organisation to ask individuals some questions of its choosing (usually related to products, services, events or feedback). Those individuals who supply correct/valid answers go into a draw to win a prize/s. A Facebook Like nominated by the organisation running the ebee may also form part of an entry into a draw by a participant. Ebee draw – means the process by which an ebee winner/s is determined Ebees.com.au – means ebees.com.au Pty/Ltd Pod – means the pool of entries that have correct/valid answers for all questions in the ebee. The winner/s will be drawn from this pool of entries. Private ebee – means an ebee for which The Promoter supplies its own individual email addresses and the ebee is not made available for the public to participate in, nor is it seen on the home page of ebees.com.au or in the search results on ebees.com.au. A private ebee is usually used for the purpose of engaging an organisation’s subscriber base in some form of promotional or feedback activity. Prize collection time period – means the time period that a prize winner and The Promoter have to make contact with each other and arrange for delivery/collection of the prize. This time period is set at 6 weeks being 42 days. Public ebee – means an ebee for which The Promoter makes it available to anyone who wishes to participate (unless a specific demographic has been set by The Promoter running the ebee). A public ebee is usually used for the purpose of engaging new individuals to that organisation. The Promoter – means the individual, website, business, charity, club, organisation, or any such other group who is conducting an ebee and providing a prize/s. 2. Public ebee membership Membership of Ebees.com.au is open to all Australian residents unless that person is barred from using the ebees.com.au website for any reason by Ebees.com.au. When joining Ebees.com.au, a person is required to use an email address as a means for logging in and communication. Ebees.com.au will not use email addresses for any purpose other than that of promotional and feedback activity and any other related means required to operate the Ebees.com.au’s environment. Specifically, Ebees.com.au will not sell/swap an individual’s email address with any other website or organisation. Email addresses will not be displayed publicly as a matter of use in any ebee. Ebees.com.au reserves the right to send emails to its members at its discretion. 3. Private ebee membership Email addresses supplied as a part of a private ebee will not be used for any purpose by Ebees.com.au other than that of the promotional and feedback activity and any other related means required to operate the Ebees.com.au’s environment. How to play an ebee For a private ebeee, when an ebee starts, an email may be sent to the email addresses supplied by The Promoter running the private ebee inviting them to participate. For a public ebee, when an ebee starts, an email may be sent to the member database of Ebees.com.au inviting them to participate. A post may also be made on Facebook inviting followers to participate. By clicking on the relevant link in the email, an individual will be taken to the Ebees.com.au website and presented with the questions as created by The Promoter. Depending on the questions asked, it may be necessary to visit The Promoter’s website, business, view a video or some other means in order to find the correct/valid answers to the questions. Some questions may be used for feedback purposes for The Promoter and therefore will not require an exact answer. The individual needs to submit their answers to all the questions in the ebee and all of these answers need to be received by the Ebees.com.au website before the closing date and time in order for the entry to be considered to be eligible to win. If The Promoter has used an option to allow people to Like them on Facebook as a part of the ebee, then the participant may click on that Like button. Reminder emails may be sent at various times to email addresses that have not submitted a full set of answers to the questions for the ebee. After an individual has submitted their answers for questions in an ebee, if they click on the links in the ebee invite, they can view and edit their previously submitted answers. The individual can edit and resubmit their answers up until the close of the ebee. The individual still only has one entry in the ebee and the answers the participant has in the ebees.com.au database at the close of the ebee, are the answers used to consider whether the person has a correct/valid entry or not. At the close of an ebee, no further answers may be received by the Ebees.com.au website. When an ebee has closed, any individual that has all answers correct for all questions that require a correct answer and all questions answered with a valid answer for questions that require a valid answer, goes into the Pod from which a draw for the prize/s for the ebee will take place. The winning individual/s is chosen at random from the Pod and announced through Ebees.com.au. 5. How ebee prize winners are determined To determine winning entries the following process is used but may be changed at any time at the discretion of Ebees.com.au. From the Pod of valid entries for an ebee, the first randomly selected entry is the first prize winner; if a second prize is offered as part of the ebee, the second randomly selected entry from the Pod is the second prize winner and so on until all prizes are allocated a winner. As a prize winner is drawn, that entry for the prize winner is removed from the Pod and hence the entry is not eligible to win more than one prize from any one ebee. If instead of first, second, third and so-on for prizes, there are several of the same prizes for an ebee, then that number of entries will be drawn and they shall be deemed the prize winners. 6. How ebee prize winners are announced Ebees.com.au may announce winners in different ways from time to time. Ebees.com.au may show the winners of the prizes within an ebee (and only the winners of prizes within an ebee) in the order they were drawn or Ebees.com.au may show prize winners as being the last entries left after eliminating a randomly selected pool of non-prize winners from the Pod. Whichever means is used to display the prize winners,this means does not affect the underlying means of determining a prize winner, which is explained in the section “How ebee prize winners are determined”. 7. Notification of prize winners Ebees.com.au will send to each ebee prize winner’s provided email address, an email notifying them that they have won a prize. The notification will contain The Promoter’s provided contact details. Ebees.com.au will send to the The Promoter’s provided email address, an email notifying them of each of the ebee prize winner’s provided contact details. It is the responsibility of The Promoter to followup and ensure that each prize winner know of their prize win. 8. Collection/Distribution of prizes An ebee prize winner has the Prize Collection Time Period from the ebee draw date to make contact with The Promoter. It is the responsibility of The Promoter and the prize winner to make arrangements for collection/distribution of prizes. Some states have regulations regarding whose responsibility it is to collect or distribute the prize and it is the responsibility of The Promoter to understand and follow these regulations. Under no circumstances is Ebees.com.au in any way responsible for arrangements for the collection or delivery of prizes, faults and/or complaints about prizes, or any other such matters arising relating to prizes. Under no circumstances is Ebees.com.au in any way responsible for arranging the mailing/delivery/collection of ebee prizes to ebee prize winners nor is Ebees.com.au in anyway responsible for communicating with the ebee prize winner and The Promoter in regards to prize collection and/or the prize itself or any such dispute that may arise between the two parties. Any mailing/delivery/collection costs of an ebee prize to an ebee prize winner remains the responsibility of The Promoter unless negotiated otherwise between The Promoter and the ebee prize winner. Under no circumstances is Ebees.com.au in any way responsible for mailing/delivery/collection costs of ebee prizes to ebee prize winners. 9. Forfeit of prize by prize winner After the Prize Collection Time Period has expired, if an ebee prize winner has not communicated with The Promoter and the ebee prize winner cannot show that they have attempted in good faith to make contact with The Promoter within the Prize Collection Time Period, then this prize winner will be no longer considered a prize winner. There will then be no responsibility on The Promoter to provide that prize to that prize winner. A redraw will take place only after The Promoter has confirmed in writing (such as email or through Ebees.com.au’s administration facilities) that there has been no communication from the prize winner and that The Promoter wishes to conduct a re-draw for the prize. A new prize winner will be selected under the same means as described above under the heading “How ebee prize winners are determined”. Subject to the “Collection/Distribution of prizes” conditions above, if for any reason a prize winner does not take the prize or an element of the prize by the Prize Collection Time Period, then the prize or that element of the prize will be forfeited by that prize winner unless The Promoter deems otherwise. 10. Eligibilty to enter an ebee Unless otherwise stated only Australian residents may enter any ebee. Furthermore, the Promoter may restrict participation to a narrower demographic based on age, location or any other restrict they so deem fit. 11. Ebees.com.au retains the right to cancel any public or private ebee membership at any time for any reason or for no reason whatsoever. 12. Employees and the immediate families of The Promoter running an ebee are ineligible to win any prizes in that ebee. 13. Ebees.com.au reserves the right to verify at any time the validity of entries and participants (including a participant’s gender, age and postcode where appropriate) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the discretion of Ebees.com.au. Failure by Ebees.com.au to enforce any of its rights at any stage does not constitute a waiver of those rights. 14. Incomplete, misspelt or indecipherable entries will be deemed invalid unless Ebees.com.au deems otherwise. Entries with more than one answer when only one answer is required will be deemed invalid unless Ebees.com.au deems otherwise. Ebees.com.au accepts no responsibility for late or lost entries. 15. Only answers received via the official Ebees.com.au process will be eligible. 16. If there is a dispute as to the identity of a prize winner, the Promoter may in its sole discretion, determine the identity of the prize winner. 17. Winners will be notified in writing via email and their name, suburb, postcode and state may be published on the Ebees.com.au website at Ebees.com.au’s discretion. 18. Ebees.com.au’s decision for drawing prize-winners and determining correct answers is final and no correspondence will be entered into. 19. If a prize (or part of any prize) is unavailable, The Promoter may in its discretion, reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification. 20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 21. ebee participants consent to Ebees.com.au using the participant's name, suburb, postcode and state in the event they are a prize winner in any media for an unlimited period without remuneration. 22. If an ebee or its website is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason including infection by computer virus, software bugs, tampering, unauthorised intervention, hardware failure, connection failure, technical failures or any other occurrence which corrupts or affects the administration, security, fairness, integrity or proper conduct of an ebee, Ebees.com.au reserves the right, in its sole discretion, to cancel, terminate, change or postpone such ebees as appropriate. 23. Ebees.com.au and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to an ebee invited or non-invited participant’s or any other person's mobile handset, computer or peripherals related to, or resulting from, visiting or using the Ebees.com.au website or related websites, participation in any ebee or the downloading of any materials related to an ebee. 24. Any cost associated with accessing Ebees.com.au’s website is the participant’s responsibility. The use of any automated entry software or any other mechanical or electronic means that allows a participant to automatically enter repeatedly is prohibited and will render all entries submitted by that participant, and any associated participant, invalid. 25.
