Terms & Conditions

All participants agree to the following terms and conditions for the HP “Who’s Who In Kung Fu Panda 2?” Contest.
This Contest is organized by Hewlett-Packard Australia Pty Limited, with the permission of DreamWorks Pictures.


1. The Contest period is from 26 June 2011 to 31 July 2011. Contest submissions received after the Contest Period will not be accepted.

2. This Contest is open to individuals who are legal residents of Australia, aged 18 years and above, and who have correctly completed the challenges outlined in the competition during the Contest Period.

3. Employees of HP and its wholesalers, resellers, business partners, dealers, advertising and sales promotion agencies who are working directly or indirectly on this program and members of their immediate families are not eligible to participate.

4. Participants are permitted to submit multiple entries, but only the most recent submission will be judged.

5. Any incomplete or invalid Contest submissions will not be processed and will be disqualified and/or deleted without prior notice.

6. HP will not be responsible for any lost or misplaced entries.

7. The Contest winner will be the submission with the most original and creative tiebreaker, as determined by a panel of judges appointed by HP.

• The prize for this Contest is as follows:

o 1 x TouchSmart610 Desktop PC $2,699RRP*
o 1 x Envy14 Notebook PC $1,999RRP*

The total value of each prize pool is $4,698.00RRP*.All prices quoted are recommended retail price including GST and excluding delivery.

8. Prizes are non-transferable, non-refundable and non-exchangeable for cash or for any other prizes.

9. HP reserves the right to substitute any prize with another of similar value at its sole discretion.

10. HP reserves the right to forfeit or award any unclaimed or leftover prizes at its sole discretion.

11. All costs incurred in the delivery of prizes shall be borne by HP. Liability for any tax on the prize will be the sole responsibility of the winner. It is recommended that participants should contact their own accountant or taxation advisor in this regard. No compensation will be due to the winner who fails to accept the prize.

12. Winners will be notified by phone or email by no later than 01 September 2011.

13. Prizes must be redeemed within THIRTY (30) days after notification. Unclaimed prizes will be forfeited after this period. Unclaimed prizes may be utilized for future HP related marketing programs.

14. HP cannot confirm the actual collection/delivery date of all prizes beforehand and will not be responsible for any delays.

15. Each participant warrants in respect of its 25 words or less submission that:

a. The submission is an original work of that participant, and not copied from a third party or otherwise in breach of any intellectual property rights anywhere in the World;
b. HP (and its affiliates) has the rights, in relation to the slogan submission, referred to in clause 16 of these Terms and Conditions.
c. The submission will not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy) of others;
d. The submission will not include any religious, defamatory, violent, infringing, obscene, pornographic, sexual, indecent or unlawful content;
e. Participant will not upload or otherwise transfer files that contain viruses or corrupted files that may damage the operation of another computer;
f. Participant will not provide false or inaccurate information pertaining to the origin or source of any part of the submission.

16. HP (and its affiliates) reserves the right to use, publish or display the names, photographs and all content of the submission of any participant, including the winner, for any purpose HP deems fit to the extent permitted by the law, including without limitations for advertising and publicity purposes; without any further compensation or notice. Furthermore, each participant hereby grants to HP (and its affiliates) a royalty-free and non-exclusive license to use the copyright and all other intellectual property rights of whatever nature in such submission for such purposes. Each participant also agrees in so far as it is permitted by law to waive all moral rights in the submission including the right of attribution of authorship.

17. HP reserves the right to amend, delete, or add to the terms & conditions of this Contest at any time and without issuing prior notice. All decisions made are final and binding. No appeals otherwise will be entertained. 18. Participants undertake that they shall not bring any action, claim, or proceedings against HP, whether in contract, tort (including negligence) or otherwise, relating to this Contest and indicate that they have read and agreed to the terms and conditions herein and other communication materials for this Contest.

19. HP will not be responsible for typographical or other errors or omissions regarding prices or other information or for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, (including but not limited to) any injury or damage to contestants or any other person’s computer, related to or resulting from participation in the Contest. Any product images used are for illustrative purposes only and may vary from products described. If the Contest cannot run as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, prohibition by the relevant authorities or any other causes beyond the control of HP which corrupts or affect the administration security, fairness, integrity or proper conduct of this Contest, HP reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Contest as it sees fit.

20. All submissions become the property of HP. HP collects the participant’s personal details in order to conduct the Contest, and may pass that information to its affiliates and agencies assisting with the Contest, some of which may be overseas. If the information requested is not provided, the participant may not participate in the Contest. If the participant gives his/her consent, HP may contact him/her from time to time with information about special offers and products and services that may interest him/her, but contestants may unsubscribe later if he/she no longer wishes to receive further marketing information. Participants may also contact HP to change his/her details. Further information in relation to HP’s privacy policy can be obtained from: http://welcome.hp.com/country/ap/en/privacy.html. Demographic and profile data will also be collected and used to tailor user experience.
21. The laws of Australia will govern the terms and conditions of this Contest. All participants agree to submit to the non-exclusive jurisdiction of the courts of Australia for all disputes arising from, in relation to or in connection with, this Contest.
