Terms and Conditions

1. Instructions on how to enter form part of these Conditions of Entry. Participation in this Promotion is deemed acceptance of these Conditions of Entry.

2. The competition is open to all residents of Australia that are over the age of 18 years and are members of Kidspot Social, except employees of the Promoter or Kellogg (Aust) Pty Ltd and members of their immediate families and agencies associated with this promotion.

3. The major photo competition runs for three weeks, commencing at 10am on Friday, July 1, 2011 (AEST) and ending at midnight on Friday, July 22, 2011 (AEST)

4. To enter the major photo competition, members must upload a photo to the Unlock The Holiday Fun Kidspot group photo album, ensuring that the following entry mechanics are followed:

- photos of your winter fun activity
- photos must include big smiles
- entries must include a 25 words or less caption which creatively describes the activity

a) Unlimited entries per person into the photo competition.

- all entries must be completely individual, with separate photos and captions for each entry.

b) The major prize winner in the Unlock the Holiday Fun photo competition will win $2000 cash. Prize fulfillment will be made via direct deposit into the winner’s nominated bank account.

5. To enter the weekly competitions, entrants must answer the weekly topic question posted in the Unlock the Holiday Fun with Coco Pops group at Kidspot Social.

b) Unlimited entries per person into the weekly competitions, providing members submit separate entries with individual activity ideas.

c)The weekly competitions will run from 10am Friday morning until 9am Friday throughout each week of the promotional period. Weekly winners will be judged and announced in the competition topic thread on the following dates:

- 11th July, 2011
- 18th July, 2011
- 25th July, 2011
 
d) The weekly winners of the Kidspot “Unlock The Holiday Fun with Coco Pops!’ Competitions will win $100 cash. Prize fulfillment will be made via direct deposit into the winner’s nominated bank account.

6. Incomplete, illegible and inappropriate entries will be deemed invalid and will not be included in the judging.

7. If the entry is deemed inappropriate or offensive, it will be removed by Kidspot administrators at their discretion.

8. The winner's profile photo and details may be posted to the Kidspot Facebook page as well as across various Kidspot communication channels.

9. Upon completion of the three week Unlock the Holiday Fun photo competition, a panel of judges appointed by the Promoter will choose one overall winner from the pool of all photos entered over the duration of the competition. The winner will be notified through email communication. Each entry will be individually judged based on originality, creative and literary merit.

Judging will take place at Kidspot, Level 5, 14 Queens Road, Melbourne Victoria 3004 on 25th July 2011.
 
10. All Kidspot Social competition winners must:

b) Be agreeable to the usage of their profile photo and details within Kidspot onsite creative, editorial features and email communication

11. The judges’ decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.

12. This is a game of skill and chance plays no part in determining the winner.

13. The Entrant’s entry must be original and must not infringe on any third party’s intellectual property rights. The Promoter reserves the right to seek a declaration from any entrant that their entry complies with this clause.

14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

15. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.

16. In the event that for any reason whatsoever a prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner. If the prize is forfeited within twenty four business hours of the notification taking place, a re-judging will occur immediately.

17. Any costs associated with accessing the Kidspot website are the responsibility of the person seeking access and are dependent on the internet service provider used.

18. All entries are deemed to be received at the time of receipt by the Promoter, not time of transmission by the entrant. The Promoter accepts no responsibility for late, lost or misdirected entries.

19. All entries submitted become the property of the Promoter.

20. Except for any liability that cannot be excluded by law, the Promoter (and their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter.s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (f) any tax liability incurred by a winner or entrant; (g) the prize and/ or (h) participation in the promotion.
