1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.The promotion commences on Sunday 1st May 2011 and closes at 11.59pm AEST on Sunday 31st July 2011 (“Promotional Period”).
3.This promotion is not valid in conjunction with any other offer. Entry is only open to Australian & New Zealand residents 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Promotion excludes all purchases made directly from Electrolux Home Products Pty Ltd.
4.To be eligible to enter, individuals must purchase a participating Simpson Top Loader washing machine, as listed below, for domestic use at a residential address from any participating authorised Simpson dealer in Australia or New Zealand during the Promotional Period.

Participating Simpson Top Loader washing models are as follows (“Participating Products”):

SWT552SA, SWT605SA, SWT802SA, SWT902SA, SWT955SA, 36S550N, 36S605N, 22S750N, 22S950M, SWT554, SWT604, SWT704, SWT754, SWT954.
5.To enter, individuals must then, during the Promotional Period, visit www.simpson.com.au/promotions (for Australian residents) or www.simpson.co.nz/promotions (for New Zealand residents), follow the prompts to the official online entry form, complete the requested details including their first name, last name, delivery address, postal address, home phone number, mobile phone number, nominated email address, model number of Participating Product, serial number of the Participating Product, full purchase receipt number, purchase receipt date and store of purchase and then accept the Terms and Conditions by clicking the box provided. Entries must be received by 11.59pm AEST on Sunday 14th August 2011. No entries will be accepted after this date. If an entrant is unable to provide the serial number of the Participating Product purchased at the time of submitting the online entry form, the entry will be accepted for consideration, however, the entrant must complete the online entry form minus the serial number and provide the Promoter with the serial number within 90 days of the date of purchase and no later than Saturday 29th October 2011.
6.The Promoter does not guarantee that all Participating Products will be available for purchase throughout the Promotional Period.
7.For the purposes of these Terms and Conditions, the following definition applies: 'Purchase' means payment in full for the Participating Product during the Promotional Period from an Australian or New Zealand participating authorised Simpson dealer. If an individual does not receive their Participating Product at time of payment they are still eligible to enter provided that they have paid for their Participating Product in full during the Promotional Period. Please note that only lay-bys that have been paid in full by 11.59pm AEST on Sunday 31 July 2011 are eligible to enter.
8.Purchase does not include:

i.rental payment plans with a term of less than 18 months;
ii.lay-bys or pre-orders not paid in full by 11.59pm AEST pm Sunday 31st July 2011;
iii.commercial, government or business transactions;
iv.purchases via eBay or similar online third party internet websites;
v.only lay-bys that have been paid in full by Sunday 31 July 2011 are eligible for the Cotton On Gift Card. PLEASE NOTE: Purchasers of SWT552SA, SWT605SA, SWT802SA, SWT902SA, SWT955SA, 36S550N, 36S605N, 22S750N, 22S950M, SWT554, SWT604, SWT704, SWT754, SWT954 models for Government and Commercial contract sales, second quality (T2) and auction goods are excluded from this promotion. SECOND QUALITY GOODS (T2). If your appliance Serial Number has “A”, “B”, or “C” before it, you will not be entitled to claim;
vi.Electrolux staff, family or friend purchases;
vii.purchases made in conjunction with any other offer;
viii.accessories or product delivery costs; or
ix.any online discounter (including shoppingsafari.com.au, thebargainhunter.com.au, shopbot.com.au, shopsafe.co.nz, priceme.co.nz), online bidding or auction websites (including ebay.com.au, trademe.co.nz) or otherwise purchased through unauthorised Simpson dealers.
9.There will be a total of thirteen (13) draw dates (“Consumer Prize Draws”). Entries for each Consumer Prize Draw close at 11.59pm AEST on every Sunday between Sunday 8th May 2011 and Sunday 31st July 2011 inclusive. All Consumer Prize Draws will take place at The Consortium Centre, 87 Egerton Street, Silverwater NSW 2128 at 11.00am AEST on every Monday between Monday 9th May 2011 and Monday 1st August 2011 inclusive except in the case of Monday 13th June 2011 where the draw will take place on Tuesday 14th June 2011. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Un-drawn entries in each Consumer Prize Draw will be entered into any subsequent Consumer Prize Draws. Winners will be notified be email within two (2) business days of the relevant Consumer Prize Draw.
10.The first twenty-six (26) valid entries drawn in Consumer Prize Draw 1 and the first twenty-seven (27) in each subsequent Consumer Prize Draw will each win a Cotton On Gift Card to the value of $150. Each Cotton On Gift Card can be redeemed at any Cotton On retail store in Australia or New Zealand in conjunction with the terms and conditions of issuance which can be found at www.cottonon.com.au.
11.Any ancillary costs associated with redeeming the Cotton On Gift Card are not included. Any unused balance of the Cotton On Gift Card will not be awarded as cash. Redemption of the Cotton On Gift Card is subject to any terms and conditions of the issuer including those specified on the Cotton On Gift Card.
12.If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
13.Total prize pool value is up to $52,500.00.
14.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
15.A draw for any unclaimed prizes may take place on Tuesday, 8th November 2011 at the same time and place as the original Consumer Prize Draws, subject to any directions from a regulatory authority. Winners’ will be notified by email within two (2) business days.
16.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
17.Incomplete, indecipherable or illegible entries will be deemed invalid.
18.Only one (1) entry per person and per household permitted in accordance with the entry requirements.
19.Entrants must retain the original purchase receipt(s) for all entries as proof of purchase. Failure to produce a copy of the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
20.Any cost associated with accessing the Promoter's website for the purpose of registering an entry is the entrant's responsibility and is dependent on the Internet service provider used.
21.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
22.Prize winners should allow 28 days for delivery of their Cotton On Gift Card from the relevant Consumer Prize Draw date.
23.The Promoter reserves the right to reclaim the Cotton On Gift Card from any entrant, if the initially purchased Participating Product is returned after the entry has been processed and fulfilled (other than for warranty reasons). This clause does not limit or affect the entrant's rights with regards to warranties on the Participating Product either from the manufacturer or granted by legislation.
24.It is the responsibility of the prize winners to be available for the delivery of the prize as organised by the Promoter (the Promoter will send prize winners an email notifying them of the delivery time frame). In the case of a prize being undeliverable, it is the responsibility of the prize winner to organise the redelivery at their own cost.
25.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
26.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant; or (f) use of a prize.
27.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
28.All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion and opting in at the point of product registration, each entrant also acknowledges that a further primary purpose for collection of entrants' personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion and opting in at the point of product registration, each entrant agrees that the Promoter may use entrants' personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation. 1.Every person who has correctly entered the “Simpson Free Powder” Promotion and has a Participating Product in accordance with the terms and conditions for that promotion may also be eligible to claim a gift in accordance with these Terms and Conditions. This Simpson Free Powder Giveaway - Offer is not to be used in conjunction with any other offer.
2.Clauses 1, 2, 3, 4, 6, 7 (i) – (ix), 15, 16, 17, 19, 20, 23, 24, 25, 27, and 28 of the “Simpson Free Powder” Promotion, as detailed above, equally apply to this “Simpson Free Powder Giveaway” - Offer. These terms and conditions should be read in conjunction with those terms and conditions. If there are any inconsistencies these shall prevail in relation to this offer.
3.To claim, individuals must, during the Promotional Period, visit www.simpson.com.au/promotions (for Australian residents) or www.simpson.co.nz/promotions (for New Zealand residents), follow the prompts to the official online claim form, complete the requested details including their first name, last name, delivery address, postal address, home phone number, mobile phone number, nominated email address, model number of Participating Product, serial number of the Participating Product, full purchase receipt number, purchase receipt date and store of purchase and then accept the Terms and Conditions by clicking the box provided. Claims must be received by 11.59pm AEST on Sunday 14th August 2011. No claims will be accepted after this date. If a claimant is unable to provide the serial number of the Participating Product purchased at the time of submitting the online claim form, the claim, will be accepted for consideration, however, the claimant must complete the online claim form minus the serial number and provide the Promoter with the serial number within 90 days of the date of purchase and no later than Saturday 29th October 2011.
4.Once the online claim form has been submitted, claimants will be instructed online to either:

i.scan and upload a copy of their purchase receipt (as well as their rental payment contract, if applicable); OR
ii.send their photocopied purchase receipt and a printed copy of their fully completed online claim form (as well as a printed copy of their rental payment contract, if applicable) in a stamped envelope to:

- For Australian Residents: “Simpson Free Powder Giveaway - Offer”, PO Box 620 Eastern Suburbs Mail Centre, NSW 2004; or

- For New Zealand Residents: “Simpson Free Powder Giveaway - Offer”, PO Box 47013, Ponsonby, Auckland NZ 1144.
5.Claims will then be processed for validation. All purchase receipts must be received by the Promoter within 14 days of submitting their online claim form and no later than 5pm AEST (for online claims) and last mail received (for mail claims) on Sunday 28th August 2011.Purchase receipts received after Sunday 28th August 2011 will render the claim invalid. All claims must be made by the actual purchaser of the Participating Product as evidenced by the purchase receipt. Claims or registrations by any other person will not be accepted.
6.For Australian residents, every valid claim received will be awarded the gift of a one (1) year supply of OMO Top Loader or Front Loader washing powder dependent on the product model purchased awarded in the form of twelve (12) 1kg packs of OMO Top Loader or Front Loader washing powder (one (1) pack for each month).
7.For New Zealand residents, every valid claim received will be awarded the gift of a one (1) year supply of Persil Top Loader or Front Loader washing powder dependent on the product model purchased awarded in the form of twelve (12) 1kg packs of Persil Top Loader or Front Loader washing powder (one (1) pack for each month).
8.Claimants should allow 4-6 weeks for delivery of their gift from Sunday 14 August 2011.
