GENERAL INFORMATION 1.1 Information on how to enter this competition forms part of the terms of entry. 1.2 The competition commences Wednesday, 7th September 2011 at 00:01 AEST and concludes Sunday, 23rd October 2011 at 23:59 AEDT (the “Promotion Period”). 1.3 The competition will be advertised on Network Ten, the Ten website www.ten.com.au, the Renovators website www.therenovatorstv.com.au, the LG website www.lg.com.au, Network Ten third party opt in email database, A Day At The Green third party opt in email database, Formula 1 third party opt in email database participating retailer catelogues and point of sale material in/at any participating retailers. 2. ENTRY ELIGIBILITY 2.1 Entry is open to all residents of Australia aged 18 years and over at the time of entry. 2.2 Employees and their immediate families of Network Ten Pty Ltd, Salmat IDR, LG Electronics Australia Pty Ltd, Shine Australia Pty Ltd and their associated agencies, and companies associated with the Promotion are not eligible to enter. 2.3 Entrants must have read and accepted these Terms & Conditions of Entry. 2.4 Entrants are required to registered members of the Ten website. Viewers may register to become a member of TEN via the website. It is free to become a member. These Terms and Conditions apply in conjunction with the TEN Members rules 3. HOW TO ENTER 3.1 Entrants will be required to complete one of the options below to enter (all steps in an Option must be completed to constitute an Eligible Entry); OPTION ONE I. Purchase any LG product during the Promotion Period from participating retail stores. “Eligable Purchase”. II. Retain a copy of their original purchase receipt for the Eligible Purchase as proof of purchase. The Promoter reserves the right to request a proof of purchase for each entry made to verify all entries before awarding the prize. Failure to provide proof of all purchases, in the absolute discretion of the Promoter, will result in the invalidation of all of an entrant’s entries and forfeiture of any right to a prize and a re-draw will occur at the discretion of the Promoter on any chosen date; and I. Send a text/SMS message to 1999 2222. Entries to the SMS number must include the entrant’s full name, address, state, LG model and receipt number and prize number corresponding to the entrants preferred Life’s Good Adventure (“nominated prize). III. SMS entrants will receive a reply message. OPTION TWO II. Make an Eligible Purchase. III. Retain a copy of their original purchase receipt for the Eligible Purchase as proof of purchase. The Promoter reserves the right to request a proof of purchase for each entry made to verify all entries before awarding the prize. Log on to www.therenovatorstv.com.au and complete the online entry form with the requested details (including but not limited to) full name, address, state phone number, e-mail address, LG model and receipt number and the entrants preferred Life’s Good Adventure 3.2 Each ‘Eligible Entry’ will be entered into the draw for their nominated prize in the entry form. There will be three draws in total. One for each prize. The draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday, 24th October 2011 at 10:00 (AEDT) and the winners will be notified in writing and a phone call within 2 days of the draw. The winner’s name (and address if the winner is from SA) will also be published in the public notices section of the Australian on Monday, 31st October 2011. 3.3 For prize option three the winner has until 17:00 (AEDT) on Friday, 4th November 2011 to claim to claim the prize. If the prize remains unclaimed then subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday, 7th November 2011. The winner of the unclaimed prizes draw will be notified in writing and a phone call within 2 days of the draw. The winner’s name (and address if the winner is from SA) will also be published in the public notices section of the Australian on Monday, 14th November 2011. 3.4 Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday, 6th February 2012. The winner of the unclaimed prizes draw will be notified in writing and a phone call within 2 days of the draw. The winner’s name (and address if the winner is from SA) will also be published in the public notices section of the Australian on Monday, 12th February 2012. 3.5 Consumers may enter the competition once per day provided that each new entry submitted is a result of making a new eligible product purchase. If a consumer has made multiple Eligible Purchases, multiple entries are permitted (limit of one entry per Eligible Purchase). However only one prize per household is permitted (SA residents are entitled to win more than one prize). 3.6 The SMS entry mechanic in Option One is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. The Eligible Entrant will be deemed to be the account holder of the mobile phone used to make the Eligible Entry in Option One. 3.7 The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted. 3.8 Incomplete or incomprehensible entries will be deemed invalid. 3.9 The Promoter reserves the right to request the winner to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including store receipt for the Eligible Purchase) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 3.10 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but is not limited to, entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple Eligible Purchases or entries. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. 3.11 Entries must be received by 23:59 (AEDT) on Sunday, 23rd October 2011. The time of entry for entries made under Option One will in each case be the time the SMS message is received by the Salmat IDR database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account are invalid and will not be accepted. 3.12 Maximum SMS entry cost in Option One is $0.55 (including GST). The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider. 4. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date. 4.3 The Grand Prize will be awarded to the person named in the Eligible Entry. Should an entrant’s contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter. 4.4 The Grand Prizes cannot be transferred nor exchanged and is not redeemable for cash (unless cash is specified). 4.5 Unless otherwise stated, the winner and their travel companion are responsible for all other expenses unless specified above in clause 4.1 including spending money, meals, drinks, transfers, accommodation upgrades, meal upgrades, mini-bar, laundry charges, room service, telephone calls, travel insurance, gratuities, service charges, activities, incidentals and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 4.6 Flights leave from the winner’s nearest capital city in Sydney, Melbourne, Adelaide, Brisbane or Peth (Flight Departure Capital City). The winner and their travelling companion must travel on the same flight from flight departure capital city and stay in their allocated accommodation. If the winner is from Tasmania, ACT or Northern Territory, connecting flights from the capital cities in these states to the nearest Flight Departure Capital City are not included in the prize package for the winner and travelling companion. If the Grand prize winner and companion are from a regional area, travel arrangements to and from the nearest Flight Departure Capital City airport do not form part of the prize and are the responsibility of the winner and their travel companion. 4.7 Grand Prize One ‘Home Renovation’ must be taken within a year from draw date and must also be taken in addition to the these terms and conditions; o The prize includes a mix of services and materials to the total value of $50,000 inclusive of GST and can not be received as cash. o Services and materials provided include design consultation, building labour services and building materials. o Any costs over and above $50,000 is not part of the prize and is to be funded by the winner. o A consultation is included as part of this prize to help the winner choose which area of the home they wish to renovate. o The home renovation must be limited to one area of the home. I.e. Back/frontyard or kitchen or bathroom or bedroom. o Any renovations to the back/front yard must comply to council regulations and any excavations needed as part of the renovation is not included and becomes the responsibility of the winner. o Any renovations to the kitchen or bathroom must not dramatically change the building, electrical cable, water pipe structure of the property. Basic plumbing and electrical work is included as needed. o The promoter and it’s associated agencies is not responsible for any advice taken as part of the renovation consultation of this prize. o The promoter and it’s associated agencies is not responsible for any damages that might occur as a result of the home renovation. o Once renovation is completed it becomes the winners responsibility to complete their own safety checks. o Any council approvals that may be needed as a result of the home renovation is not included in the prize and becomes the responsiblilty of the winner. o To qualify for this prize and make any renovation to the property, the winner must be the legal owner of the property. 4.8 The Grand Prize Two must be taken in its entirety by Friday, 16th March 2012 through to Sunday, 18th March 2012 and is subject to hotel and flight availability. It cannot be changed once the booking has been made. Any changes made will be at the winners expense. If the winner resides in VIC then the flight component of the prize will not be included and the winner and travelling companions will need to make their way to and from the hotel. 4.9 To participate in the F1 Two Seater Ride ‘Hot Lap’, the winner must be accept the below clauses in addition to these terms and conditions; o The winner must comply with all directions of the Promoter, race officials, and the nominated driver at all times and wear all safety and passenger equipment required. The winner will not be permitted to obtain drivers’ signatures and acknowledge that there will be no formal introduction to the driver of the car when participating in the prize. The winner must agree to take part in a briefing prior to the “Hot Lap”, and also undergo and pass all required medical tests and other requirements (including blood alcohol and drug testing) as determined by the Promoter and/or the operators of the prize in their absolute discretion. The winner must not be under the influence of any drugs or have a blood alcohol reading above .00 whilst taking part in the Hotlap. The winner must not have any heart condition, history of heart disease, or other medical conditions that would make it dangerous to participate in the Hotlap. The winner must declare to the Promoter any health-related issues that may affect their safe participation in the Hotlap and obtain a written clearance from their doctor in this respect. The Promoter reserves the right (but has no obligation) to refuse to allow a winner to take part in any or all aspects of the prize if the Promoter determines, in its absolute discretion, that the winner is not in the mental or physical condition necessary to safely participate in that aspect of the prize. Notwithstanding any other conditions set out herein, the Promoter at all times reserves the right to prevent any individual from participating in the prize for any reason whatsoever. The winner must also agree to comply with these Conditions of Entry, the Conditions of Sale and Conditions of Entry to the Event (collectively, the Conditions) (copies of which are available at www.grandprix.com.au or from the Promoter, and the Conditions of Entry displayed at entrances to the Event). o The winner must, at their own cost, organise and undertake a compulsory medical examination (which may include an ECG test) to obtain medical clearance by the date specified by the Promoter. The winner must consent to the test results being made available to CAMS for the purpose of assessing fitness to participate in the Hot Lap. o In order to participate in the Hot Lap, the winner must 18 years + and also be within the following height, weight and body dimension restrictions: Maximum height: 1.8 m (6ft) Minimum height: 1.58 m (5 ft 2 in) Maximum weight: 88 kg (14 stone) Maximum girth (including upper arms): 139.7cm (55 in) o Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrant’s own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Fédération Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited (CAMS), Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited (ACN 003 764 770), Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event, including the prize. 4.10 Certain legislation may imply warranties or conditions or impose obligations upon the Promoter which cannot be, or may only be to a limited extent, excluded, restricted or modified. These Terms & Conditions must be read subject to those statutory provisions. These Terms & Conditions will not affect any statutory rights that an entrant may have. 4.11 The Promoter and its associated agencies and companies (including their respective officers, employees and agents) shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this offer or the Grand Prizes, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 4.12 The Grand Prize Three must be taken in its entirety by Friday, 11th November 2011 through to Sunday, 12th November 2011 and is subject to hotel and flight availability. It cannot be changed once the booking has been made. Any changes made will be at the winners expense. If the winner resides in NSW then the flight component of the prize will not be included and the winner and they companion must make their way to and from the hotel. 4.13 Meet and Greet with with one of the bands and Bimbadgen Senior winemaker that forms part of Grand Prize Three is subject to availability. 4.14 The Grand prize winners and their companion/s may not use ‘Frequent Flyer’ points from any airline on the travel prize and cannot upgrade any travel prize using ‘Frequent Flyer’ points. 4.15 The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the Grand Prize/s, if the Promoter and associated partners and sponsors determines, in their absolute discretion, that a winner/s and their travel companions (if applicable) is not in the mental or physical condition necessary to be able to safely participate in any of the Grand Prizes (or any component thereof). It is a condition of accepting the Grand Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 4.16 The winner may be asked for their credit card details upon checking in to the hotel as security. The room comes as is, any purchases made from the mini bar or damages made to the room will be the responsibility of the winner. 4.17 It is the traveller’s personal responsibility to ensure that they have valid documentation, which meet the requirements of government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers. 4.18 The Grand Prize is not transferable or redeemable for cash (unless cash is specified). If for any reason any element of the Grand Prize is or becomes unavailable, which is out of the Promoter’s control then a similar prize to equal value, will be awarded in lieu. 4.19 The Promoter and their associated agencies and companies make no representation as to the safety, conditions or other issues that may exist at any destination. 4.20 In the event that for any reason whatsoever a winner does not take an element of the Grand Prize within the time stipulated by the Promoter then that element of the Grand Prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Grand Prize. 4.21 Once prizes have left the Promoter or prize partners premises, the Promoter or and associated sponsor takes no responsibility for prizes damaged, delayed or lost in transit. 4.22 The winner and their companion agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation, other than the Promoter and associated sponsor. 4.23 Independent financial advice should be sought as tax implications may arise as a result of accepting the Grand Prize. 5. STANDARD TERMS 5.1 It is a condition of accepting the Grand Prize that the winner and their travelling companion/s must comply with all the conditions of use of the Grand Prize and the Grand Prize supplier’s requirements. It is also a condition of accepting the Grand Prize that the winner and their travelling companion/s may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 5.2 The Promoter’s decision is final and the promoter will not enter into correspondence regarding the competition result. 5.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. 5.4 The Promoter and prize supplier shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter and prize supplier are not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 5.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 5.6 The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available. 5.7 If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation. 5.8 All entries become the property of The Promoter. Subject to clause 5.8, the Promoter collects personal information about you to enable you to participate in this promotion, and may be disclosed the associated sponsor for this purpose. If you are not willing for this to occur you cannot participate in the competition. 5.9 Entrants may choose to opt-in to receive further information from the Promoter and their associated agencies and companies if they enter via Option Two, and check the appropriate check box on the competition entry page. If the entrant checks the check box the associated sponsor may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
