TERMS AND CONDITIONS

    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible.
    Promotion commences at 12:00pm AEST on Monday 12/09/2011 and closes at 11:59am AEST on Saturday 17/09/2011 ("Promotional Period").
    Individuals can enter through the "Winning Smiles" application ("Application") on the Facebook Platform. This is located on the "Winning Smiles tab on the Panasonic page on Facebook (www.facebook.com/panasonicaustralia).
    Individuals must "Like" the Panasonic Page and agree to allow Application before proceeding to submit an entry.
    Five (5) questions will be made available during the Promotional Period. To submit an entry, entrants must, using the Application, follow the prompts to answer the question within 25 words or less, and submit their entry. Each question will only be available for a 24hour period during the Promotional Period. Each question will be available from 12:00pm AEST each promotional day and will be removed at 11:59am AEST each promotional day, at which point the next question will be made available (if any).
    This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not Facebook. The information they provide will only be used for the purposes as set out in these Terms and Conditions. Any questions, comments or complaints should be directed to the Promoter and not Facebook.
    All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
    Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; (b) each entry must contain an answer to the current question of the day only and (c) each entry must be submitted separately and in accordance with entry requirements. A maximum of one (1) prize will be awarded per entrant per question. For the removal of doubt, an entrant cannot win more than one (1) prize for multiple answers submitted for the same question.
    Incomplete, indecipherable or illegible entries may be deemed invalid by the Promoter, in its absolute discretion.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged by the Promoter based on originality and creative merit to the answer provided.
    There will be sixty (60) winners determined for each question. Winners will be determined by a panel of judges and the best sixty (60) entries as determined by the judges for each question will be deemed winners.
    The best sixty (60) valid entries, as determined by the judges, for each question will each win a Panasonic electric toothbrush valued at $30 (Recommended Retail Price), model no. EW-DS11 'Compact Sonic Toothbrush'.
    Winners will be announced on the Panasonic blog (http://blogs.panasonic.com.au/consumer) and notified by e-mail. The Promoter's decision is final and no correspondence will be entered into.
    Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. In the event that any prize is unavailable, due to reasons beyond the control of the Promoter, the Promoter will offer an alternative prize of equal value and/or specification.
    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of mechanical tampering or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant, including entries submitted by them; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly, is prohibited and may render all entries submitted by that entrant invalid.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
    The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
    The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. If the entrant opts in at the time of entry the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
