Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
The promotion commences at 00.01 (AEST) on 18/08/11 and closes at 23.59 (AEDST) on 04/12/11 (“Promotion Period”). Weekly Prize draws will take place as set out in the table below in Condition 12. The Major Prize Draw will take place at 10:00 (AEDST) on 05/12/2011 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade Richmond VIC 3121. All winners will be notified in writing (mail or email) and the Major Winner will be contacted by telephone and their name and locality published in The Australian newspaper on 7/12/2011. All reasonable steps to notify the winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into
Entry is open to residents of Australia who are aged 18 years or over and who are a current House VIP Member (“Eligible Entrant”). Directors, employees and their immediate families of the Promoter, its agencies and retail outlets associated with this promotion are ineligible to enter.
To enter, an Eligible Entrant must, during the Promotion Period spend $50 or more in a House retail outlet within Australia and show their VIP member card at the time of purchase to receive a promotional flyer featuring a unique code. Entries can then be submitted as follows:
(a) Online: Visit www.house.com.au and completing the online entry form as required. In order to complete the online entry form, Eligible Entrants must provide their full name, a current and valid email address, 17 digit House Membership number and the unique code that is printed on their promotional card handed to them at the time of making their purchase.
(b) SMS: Send a text message with their Unique Code, Full Name followed by their 17 digit House Membership number to 199 94 499 (Max. SMS charge is 55c inc GST).

Bonus Entries: An Eligible Entrant who submits their entry online can gain additional entries into the Major Prize draw by referring their friends to the competition using the Refer a Friend Function on the entry form page. For each friend an Eligible Entrant refers, they will gain one entry into the prize draw. A maximum of five friends can be referred for each valid entry submitted. Referred persons must have a pre-existing relationship with the referrer and each referred person must be a distinct individual. Participants must obtain prior consent before referring a friend. An Eligible Entrant can also earn one bonus entry by clicking the ‘Like’ Facebook button after they have submitted a valid entry. SMS entries submitted via the Internet are not valid and will not be accepted. A return SMS will be sent to each entrant who submits a valid SMS entry to confirm receipt of their entry.
Multiple entries are accepted, however each entry must be based on a separate Eligible Purchase and must independently comply with these Conditions of Entry. Entries will be deemed accepted at the time of receipt, not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the Promotional Period.
Entrants must retain, and may be required to present original store receipts of their Eligible Purchase and also the promotional flyer containing the unique code for all entries (“Proof of Purchase”). A failure to provide Proof of Purchase for all entries may, at the discretion of the Promoter, result in all entries submitted by an entrant being deemed invalid.
INSTANT WINS: There will be 200 Instant Win prizes of a $10 VIP Member reward credit (“Instant Win prize”). Total Instant Win prize pool value is $2000. Instant Win Prizes will be randomly awarded to valid entrants throughout the Promotion Period and will be notified by reply SMS or email advising that they are a provisional instant winner. Provisional Instant winners will be issued with a 5 digit unique Prize Claim Number (PCN) as determined by the Instant Win system. The PCN will need to be recorded by the provisional winner for prize verification purposes. In the event of any dispute with the Promoter, or at the Prompter’s request, Instant Winners will be required to correctly quote their PCN to be awarded their prize. The Promoter reserves the right to withhold the awarding of an instant prize to a provisional winner who cannot provide a valid PCN. Any instant win prizes awarded to ineligible or invalid entrants will be awarded during a second chance draw. Entrants who are not instant winners are automatically entered into any following weekly prize draws and the major prize draw.
WEEKLY PRIZE DRAWS: There will be 15 x weekly prize draws conducted for this promotion. The weekly prize draws will take place at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121 on the dates specified in the table below at 11:00 (AEST/AEDST). Entries close for each draw on the dates specified in the table below. Non-winning entries in each draw will roll over into subsequent draws.

WEEKLY PRIZES: The first valid entry drawn in each Weekly Prize Draw will win a House Gift Hamper valued at $150 (“Weekly Prize”). Total Weekly Prizes prize pool value is $2250. Each Eligible Entrant who submits an entry into this promotion in accordance with these Conditions of Entry will be entered into the Weekly Prize Draws as outlined in Condition 12. The first valid entry drawn in each Weekly Prize Draw will win the Weekly Prize.
MAJOR PRIZE: Each Eligible Entrant who submits an entry into this promotion in accordance with these Conditions of Entry will be entered into the Major Prize Draw. The first eligible entry randomly drawn from all entries received will win the right to attend the Major Prize Event (as outlined in Condition 15)
The person whose entry was drawn must confirm their eligibility to be awarded the Major Prize Event within two (2) business days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If the winner’s entry is deemed invalid the Promoter will draw another entrant at the same time and place as the original draw and repeat this process until an Eligible Entrant is drawn. If the Promoter is unable to notify any entrant drawn, the procedures outlined in Condition 21 will apply.
MAJOR PRIZE: Major Prize “Event”: The Major Prize is one (1) opportunity for the winner to participate in the ‘Win a House’ (“Event”). Details regarding the Event are as follows:
The Event will take place at 1:00 pm (AEDST) on 12/12/2011 at the House Essendon store located at Shop 3 Homemaker Hub 120 Bulla Road Strathmore, ESSENDON Vic 3041. If the winner’s usual residential address is more than 200 kilometres from Melbourne CBD the Promoter will provide the winner with two (2) adult return economy airfares (including airfare related taxes and charges) for the winner and one (1) travel companion to Melbourne, Victoria from the Australian domestic airport closest to the winner’s ordinary residential address, two (2) night accommodation (minimum 4 star, standard twin share room) and transfers to and from the airport and the Event so the winner can participate in the Event. The flights and accommodation are valued at up to $2,000 (Recommended Retail Price including GST, depending on point of departure). All other costs including meals, beverages, laundry services, spending money, transport to and from departure point, insurance, travel insurance and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winner and their travel companion. Any passes, tickets or vouchers issued by the Promoter are subject to prevailing terms and conditions of use.
There will be one hundred (100) envelopes at the Major Prize Event. Ninety- nine (99) envelopes will each contain a $10,000 consolation cash prize. One (1) envelope will contain a $1,000,000 cheque. At the Event, the winner will be given the right to randomly pick one (1) envelope from the one hundred (100) envelopes for the chance to win. The winner shall win the prize contained in the envelope that he or she (or his/her proxy, as stated in Condition 15(c) or 15(d) selects). The odds of the winner winning the $1,000,000 cheque are 100:1.
If the winner cannot attend the Event, the winner may appoint a proxy aged 18 years or over to attend and participate in the Event on their behalf, provided that the winner gives the Promoter written notice to that effect before the Event. The proxy may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. The prize will be made payable to the winner only and will be delivered to the winner and not to the proxy. The Promoter’s decision is final and no correspondence will be entered into.
If the winner is unable to appoint a proxy or if the winner’s appointed proxy cannot attend the Event, a representative of the Promoter will appoint a proxy to attend the Event and pick an envelope on the winner’s behalf.
Any prize money will be paid in full within twenty-eight (28) days of the Event into a bank account held in the winner’s name as nominated by the winner in writing.
It is a condition of accepting the Major Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
If the prizes or any element of the prizes become unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable Australian State and Territory legislation.
In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative prize (including an alternative Event date as specified by the Promoter) to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
Total maximum prize pool value is up to $1,006,250. The Promoter accepts no responsibility for any variation in prize value. The prize is non-transferable, non-refundable and non-redeemable for other goods or services. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Entrants can only enter in their own name. The Promoter reserves the right to request an entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
The Promoter may conduct an unclaimed prize draw as is necessary at the same time and place as the original draw on 03/03/2012 in order to distribute any prize unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing (mail or email) and if a Major Prize winner, their name and locality will be published in The Australian on 06/03/2012.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.
The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer, mobile phone device or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.

    WEEKLY PRIZES: The first valid entry drawn in each Weekly Prize Draw will win a House Gift Hamper valued at $150 (“Weekly Prize”). Total Weekly Prizes prize pool value is $2250. Each Eligible Entrant who submits an entry into this promotion in accordance with these Conditions of Entry will be entered into the Weekly Prize Draws as outlined in Condition 12. The first valid entry drawn in each Weekly Prize Draw will win the Weekly Prize.

    MAJOR PRIZE: Each Eligible Entrant who submits an entry into this promotion in accordance with these Conditions of Entry will be entered into the Major Prize Draw. The first eligible entry randomly drawn from all entries received will win the right to attend the Major Prize Event (as outlined in Condition 15)

    The person whose entry was drawn must confirm their eligibility to be awarded the Major Prize Event within two (2) business days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If the winner’s entry is deemed invalid the Promoter will draw another entrant at the same time and place as the original draw and repeat this process until an Eligible Entrant is drawn. If the Promoter is unable to notify any entrant drawn, the procedures outlined in Condition 21 will apply.

    MAJOR PRIZE: Major Prize “Event”: The Major Prize is one (1) opportunity for the winner to participate in the ‘Win a House’ (“Event”). Details regarding the Event are as follows:

        The Event will take place at 1:00 pm (AEDST) on 12/12/2011 at the House Essendon store located at Shop 3 Homemaker Hub 120 Bulla Road Strathmore, ESSENDON Vic 3041. If the winner’s usual residential address is more than 200 kilometres from Melbourne CBD the Promoter will provide the winner with two (2) adult return economy airfares (including airfare related taxes and charges) for the winner and one (1) travel companion to Melbourne, Victoria from the Australian domestic airport closest to the winner’s ordinary residential address, two (2) night accommodation (minimum 4 star, standard twin share room) and transfers to and from the airport and the Event so the winner can participate in the Event. The flights and accommodation are valued at up to $2,000 (Recommended Retail Price including GST, depending on point of departure). All other costs including meals, beverages, laundry services, spending money, transport to and from departure point, insurance, travel insurance and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winner and their travel companion. Any passes, tickets or vouchers issued by the Promoter are subject to prevailing terms and conditions of use.

        There will be one hundred (100) envelopes at the Major Prize Event. Ninety- nine (99) envelopes will each contain a $10,000 consolation cash prize. One (1) envelope will contain a $1,000,000 cheque. At the Event, the winner will be given the right to randomly pick one (1) envelope from the one hundred (100) envelopes for the chance to win. The winner shall win the prize contained in the envelope that he or she (or his/her proxy, as stated in Condition 15(c) or 15(d) selects). The odds of the winner winning the $1,000,000 cheque are 100:1.

        If the winner cannot attend the Event, the winner may appoint a proxy aged 18 years or over to attend and participate in the Event on their behalf, provided that the winner gives the Promoter written notice to that effect before the Event. The proxy may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. The prize will be made payable to the winner only and will be delivered to the winner and not to the proxy. The Promoter’s decision is final and no correspondence will be entered into.

        If the winner is unable to appoint a proxy or if the winner’s appointed proxy cannot attend the Event, a representative of the Promoter will appoint a proxy to attend the Event and pick an envelope on the winner’s behalf.

        Any prize money will be paid in full within twenty-eight (28) days of the Event into a bank account held in the winner’s name as nominated by the winner in writing.

    It is a condition of accepting the Major Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

    If the prizes or any element of the prizes become unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable Australian State and Territory legislation.

    In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative prize (including an alternative Event date as specified by the Promoter) to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.

    Total maximum prize pool value is up to $1,006,250. The Promoter accepts no responsibility for any variation in prize value. The prize is non-transferable, non-refundable and non-redeemable for other goods or services. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought

    Entrants can only enter in their own name. The Promoter reserves the right to request an entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

    The Promoter may conduct an unclaimed prize draw as is necessary at the same time and place as the original draw on 03/03/2012 in order to distribute any prize unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing (mail or email) and if a Major Prize winner, their name and locality will be published in The Australian on 06/03/2012.

    Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

    Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

    The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

    The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

    Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

    The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer, mobile phone device or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

    If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.

    The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

    The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

    As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
