“HOYTS I DON’T KNOW HOW SHE DOES IT” ONLINE PROMOTION

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of NSW, VIC, SA, WA, QLD and ACT. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.

4. The “I Don’t Know How She Does It” online promotion commences on 26/10/11 and closes 4:00pm AEST on 31/10/11 (“Promotional Period”).

5. To enter, entrants must be a member of either the Hoyts Movie Club or Hoyts Rewards and visit www.hoyts.com.au purchase a ticket to ‘I Don’t Know How She Does It’ during the promotional period and complete their online entry by answering ‘What question would you ask Sarah Jessica Parker if you could?’. Non-members can sign up to either the Hoyts Movie Club or Hoyts Rewards during the promotional period and complete the same entry process as outlined above.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Incomplete or indecipherable entries will be deemed invalid.

8. One entry per member permitted subject to the following: (a) only one (1) entry permitted per member; (b) entry must be submitted by answering the promotional question; and (c) entry must be submitted in accordance with entry requirements.

9. Winners will be notified immediately in writing via email and phone (if number available).  If the winner cannot be contacted by 12.00pm on Tuesday 1st November 2011 the prize will be forfeited. No replacement prize will be given.

10. This is a game of skill.  Chance plays no part in determining the winner.  Each entry till be individually judged based on literary and creative merit.  All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights.  Entries must not have been published previously and/or have been used to win prizes in other competitions. The winner, and only the winner, can only ask pre-approved questions to Sarah Jessica Parker who will respond accordingly. No additional or personal questions should be asked beyond the confirmed questions.

11. This interview may only be recorded by the interviewer on a small recording device. Unfortunately no autographs or personal photos can be secured.

12. The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.  The judge’s decision will be final and no correspondence will be entered into.

13. Major Prize:
• Opportunity to ask Sarah Jessica Parker pre-approved questions on the red carpet of the Premiere on November 2nd, 2011 (for the winner and the winner alone).
• Two (2) tickets to the Melbourne premiere of I Don’t Know How She Does It on November 2nd  2011 at Crown Casino.
• Return economy airfares for two (2) adults from nearest capital city to Melbourne
• 1 night accommodation in Melbourne                           
• One-way transfer to movie premiere

14. Opportunity to meet Sarah Jessica Parker is subject to talent and schedule availability and cannot be guaranteed. Every endeavor will be made to ensure the opportunity to ask Sarah Jessica Parker questions on the red carpet.

15. Total prize could not be valued.

16. The prize must be taken on Wednesday 2nd November, with the winner to be in Melbourne for the premiere of I Don’t Know How She Does It on Wednesday 2nd November 2011.  If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant State and/or Territory regulatory authority.

17. The winner and companion must depart from and return to the same departure point and travel together. Once flights have been confirmed by the Prize Provider/s changes are not permittable. Cancellations to the booking may be subject to fees payable by the winner.  The itinerary is to be determined by the Promoter in its absolute discretion.  Frequent flyer points will not form part of the prize. The Prize is subject to the standard terms and conditions of individual prize and service providers. Winner and companions may be required to present a credit card at time of accommodation check in. If the winner is under the age of 18 years at the time of the prize draw they must travel with a parent or approved guardian.

18. All other expenses, including spending money, meals, travel to and from departure point, transfers (unless otherwise stated), travel insurance and all other ancillary costs are the responsibility of the winner. Incidental charges charged to the winner’s room, such as meals, mini bar, laundry room services, telephone calls etc., are at the expense of the winner. A credit card imprint or cash deposit may be required from the winner’s at check-in to the hotel. Unless expressly stated all other expenses become the responsibility of the winner.

19. The Promoter, prize provider and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent any winner and/or their companion from participating in the Activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

20. As a condition of accepting the prize, the winner and companion must sign any legal documentation as and in the form required by the Promoter and/or Prize Providers in their absolute discretion, including but not limited to a legal release and indemnity form.

21. The winner and companion of the prize acknowledge that elements of the prize are dangerous and may result in injury or death, and participate at their own risk. To the full extent permitted by law neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and agents, and/or companies providing prizes for the Promotion, will be liable for any liability / cost / loss / damage / expense / death / personal injury suffered or incurred or any dispute (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion.

22. In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.

23. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

26. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

27. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
