CONDITIONS OF ENTRY

1.    Information on how to enter and the prizes form part of these conditions of entry.  Participation in this promotion constitutes acceptance of these conditions of entry. 

2.    Entry is open to individuals who are Australian residents aged 18 years and over, except Directors, employees and their immediate families of the Promoter and any subsidiary or related companies thereof and the agencies associated with this promotion.

3.    The promotion commences on 1st October 2011 at 00:01am AEST and closes on 18th March 2012 at 23:59pm AEST (“Promotion Period”).

4.     To enter, individuals need to visit www.gourmetgarden.com and provide the following details on the online entry form:
- Answer a multiple choice question found in the website copy
- Contact details including full name, email address and country
- Purchase not required

5.    All entries must be received by 23:59 pm (AEST) on 18th March 2012.  The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries howsoever caused.  The Promoter is not liable for any problems or technical difficulties associated with the online entry system used for this promotion, whether caused by website users, any equipment or programming associated with or utilised for this promotion or any technical error that may arise in the course of running the promotion.  The Promoter and its associated agencies and contractors accept no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries.

6.    All costs of accessing the Promoter’s website are the entrant’s responsibility and will depend on the internet service provider used.

7.    Entry is limited to one (1) per person. All duplicate entries will be removed prior to the draw.

8.    The draw will be conducted at 2pm AEST at the offices of Botanical Food Company Pty Ltd, 80 Palmwoods-Montville Rd, Palmwoods QLD 4555 Australia, on 20th March 2011 via a random computer generated draw.

9.    The prize is a Food Adventure Holiday in Australia for 2 people valued at $9000.  The prize includes:
- Return economy class flights for 2 adults from winners nearest capital city
- Airport Transfers to and from accommodation and scheduled events
- 7 nights accommodation for 2 at Noosa Heads including breakfast daily
- VIP Passes for 2 adults to the Audi Noosa Food and Wine Festival 19-20 May 2012 
- Tour of Gourmet Garden Factory and a “Cooking with Herbs” Masterclass
- 2 Passes to Australia Zoo

Additional meals, spending money, travel insurance and additional transport are not included and will be at the expense of the winner.

10.    The competition is a sweepstakes or game of chance. The first entry selected by random computer generated draw will win.  The winner will be notified by telephone and email on 20th March 2012 and their names will be published on the www.gourmetgarden.com website


11.    The winner of the prize and their 2nd party must be able to travel on 14th May – 21st May 2012 to redeem and accept the prize. Prizes are not redeemable for cash.  The draw results are final and no correspondence will be entered into.

12.    If winner does not claim their prize, is not able to travel in the specified dates or is not contactable by 23:59 (AEST) by 8th April 2012 the Promoter may conduct an unclaimed prize draw. An unclaimed prize draw will be conducted at 10:00 (AEST) on 10th April 2012 at Botanical Food Company Pty Ltd, 80 Palmwoods-Montville Rd, Palmwoods QLD 4555 Australia, via a random computer generated draw.  The winner of the unclaimed prizes will be notified by telephone with confirmation by email within on 10th April 2012.

13.    All entries become the property of the Promoter.  The information entrants provide will be used by the Promoter for the purposes of conducting this promotion and for marketing purposes. By entering this competition, the entrants become a member of Gourmet Garden’s online membership database. They will receive regular e-newsletters if they choose to.  The Promoter may disclose entrants’ personal information to its agents and contractors to assist with the conduct of this promotion, or to communicate with entrants.  The Promoter may also disclose entrants’ personal information to lottery authorities and winners’ names may be published as required under applicable legislation.  Entrants can request access to the personal information the Promoter holds about them by contacting info@gourmetgarden.com.  The Promoter’s privacy policy is available at www.gourmetgarden.com. By entering this competition it is taken as acceptance to the promoter using and disclosing your information as described above.

14.    Prize winners must, at the Promoter’s request, participate in any promotional activity (such as publicity and photography) related to the winning of a prize, free of charge, and consent to the Promoter using their name and image in promotional material.

15.    The Promoter reserves the right, at any time, during or after the closing date of the promotion to verify the validity of entries and to disqualify any entries by any person who tampers with, or benefits from tampering with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.

16.    If for any reason this promotion is not capable of running as planned, including but not limited to, infection by computer virus, network failure, bugs, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the written directions of any relevant authority.

17.    The Promoter, Botanical Food Company Pty Ltd, trading as Gourmet Garden, its related companies and associated agencies and contractors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death howsoever caused which is suffered or sustained by any person arising out of or in any way connected with this promotion, or the use of any prize, except for any liability that cannot be excluded by law, in which case that liability is limited to the maximum extent allowed by law.
