Terms and Conditions for ‘Capture The Fun Competition (“Terms and Conditions”)

Cathay Pacific Airways Limited Cathay Pacific Airways Limited (57 00479514 ABN) of 7/10 Spring Street, Sydney, NSW, 2000 (“Organiser”) is the organiser of the ‘Capture The Fun Competition (“Competition”).  All Entrants should carefully read these Terms and Conditions prior to entering the Competition. This is a game of skill and chance plays no part in determining the winners.

This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to the Organiser and not to Facebook. 

A. Eligibility

1. Entry is only open to residents of Australia aged 18 years or older (“Entrants”).

2. The directors, management and employees (and their immediate families) of the Organiser, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this Competition are ineligible to enter the Competition.

3. In the event an Entrant is a First Prize or Second Prize winner, the Entrant must be able to participate in the First Prize or Second Prize (respectively) during the time period set out below in Section E to be deemed an eligible Entrant in this competition. 

B. Submission Period

1. Submission of Entries to the Competition commences at 12:01am (Sydney time) on 26 October 2011 and ends at 11:59pm (Sydney time) on 6 December 2011 (“Submission Period”).

C. Entry Requirements

1. To enter the Competition, Entrants must, during the Submission Period:

a. log onto the Cathay Pacific Airways Australia page on Facebook http://www.facebook.com/cathaypacificau (“Campaign Website”);

b. ‘like’ the Campaign Website. Entrants who have ‘liked’ the Campaign Website prior to the start of the Submission Period will not be required to complete this step. For the avoidance of doubt, to ‘like’ in this context means to click on the ‘like’ icon on the Campaign Website;

c. access the “Capture The Fun?” promotional application (“Application”) made available on a tab of the Campaign Website; and

d. follow the prompts of the Application in the manner required to fully and correctly complete the Application’s entry form, including providing the Entrant’s full name, current and valid email address, residential address, and phone number, as well as uploading, with respect to the theme of “Where in the world have you had the most fun with Cathay Pacific?”, a photograph:
i. of no more than five (5) MB in size;
ii. of recommended resolution 640x480 or above;
iii. in one (1) of the following formats: .jpg, .png, or .tiff, or .jpg; and
iv. including a funny caption of twenty-five (25) words or less in English only.
(together, an “Entry”).

2. Each Entrant can submit multiple Entries, however each Entry must be submitted separately, must be substantially unique and must independently comply with these Terms and Conditions (with the exception of Resubmitted Entries defined below). There is no maximum number of Entries for each Entrant.

3. An Entrant agrees that all Entries must:

a. be the Entrant’s original and sole work and not based in whole or in part on or copied from the work of any other person or entity;

b. not have been previously published or accepted for publication or made into an audio/visual feature and must not be under consideration for publication or in the process of being made into an audio/video feature;

c. not infringe any Intellectual Property Rights and/or any other rights of any person or entity;

d. not advertise or promote any goods or services;

e. not contain any material which the Entrant does not have permission to use;

f. not contain any viruses or any other components with harmful or contaminating effects on the Application or any equipment connected to it; and

g. acquire permission to use of materials involving any other person apart from the Entrant in the Entry.

h. not reference, contain or link to any:
i. pornography, sexually explicit, obscene, indecent or otherwise objectionable content; 
ii. reference to dangerous or illegal acts or contain any instructions that if followed could be injurious to the viewer;
iii. violence;
iv. private or confidential information or reveal personal information belonging to others or other sensitive information;
v. unlawful, harmful, threatening, harassing, defamatory, libellous, tortuous, misleading or any otherwise objectionable content; and/or
vi. "hate speech" intended to stereotype a particular gender, sexual orientation, race or religion.

4. All Entries will be posted on the Application and/or Campaign Website for public viewing and will be subject to a public voting process for the duration of the Submission Period. The Organiser reserves the right, in its sole discretion, to remove an Entry from the Promotional Website with or without notice to the Entrant for any reason, including but not limited to a breach (or suspected breach) of these Terms and Conditions, and no correspondence will be entered into. Once an Entry is submitted, Entrants acknowledge that the Entry may not be withdrawn, altered or deleted (except as and where required by the Organiser).

5. An Entrant may, during the Submission Period, be requested by the Organiser to resubmit their Entry via the Application if the Organiser considers the Entry submitted to be ineligible to be deemed as a valid Entry (“Resubmitted Entry”). The decision by the Organiser to request a Resubmitted Entry, or to accept or reject a Resubmitted Entry as a valid Entry, is in the Organiser’s sole discretion and no correspondence will be entered into. If a Resubmitted Entry is accepted by the Organiser, in its sole discretion, as a valid Entry, the Resubmitted Entry will be deemed to be the Entry for the Entrant for the remainder of the Competition. If a Resubmitted Entry is rejected by the Organiser as a valid Entry, or is not received by the Organiser by 11:59pm (Sydney time) on 6 December 2011, the Entrant will not have gained an Entry into the Competition.

6. Entries and Resubmitted Entries will be deemed accepted at the time of receipt by the Organiser and not at the time of transmission. Entries and Resubmitted Entries received will be considered final by the Organiser. Incomplete, inaccurate, erroneous, ineligible or incomprehensible Entries and Resubmitted Entries will be deemed invalid. The Organiser accepts no responsibility for late, lost or misdirected Entries. The Organiser does not provide any confidentiality of the Entries, regardless of whether such Entries are published or not or as to the identity of an Entrant.  An Entrant shall be solely responsible for his/her Entries and the consequences of submitting them for the Competition.

7. Costs associated with accessing the Application and/or Campaign Website remain an Entrant’s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly via the Application by an Entrant may deem an Entry invalid.

D. Voting and Judging

1. The top seven (7) Entries who receive the highest number of public votes via the Application and/or Campaign website will automatically be shortlisted as potential winners of the Competition (“Voted Potential Winners”). The Organiser will appoint a panel of appropriately qualified judges to rate each remaining Entry received during the Submission Period by reference to their creativity, originality and relevance to the theme of the “Where in the world have you had the most fun with Cathay Pacific?” marketing campaign and three (3) Entrants will be shortlisted as potential winners of the Competition (“Judged Potential Winners”).  Announcement of the Voted Potential Winners and Judged Potential Winners (together, “Shortlisted Entrants”) will be published on the Campaign Website by 9 December 2011. 

2. If a Shortlisted Entrant is disqualified from the Competition for whatever reason, the Organiser may, at its sole discretion, decide whether to select another Shortlisted Entrant from the list of eligible Entrants. 

3. Each of the Entries of the ten (10) Shortlisted Entrants will then be reviewed by another panel of appropriately qualified judges on 14 December 2011 and the top three (3) Entries will be selected by the judges by reference to their creativity, originality and relevance to the theme “Where in the world could you have the most fun with Cathay Pacific?’ and will deemed the winners the Competition (“Winners”). The Entry determined to be the best Entry will be awarded the First Prize, the Entry determined to be the second best Entry will be awarded the Second Prize, and the Entry determined to be the third best Entry will be awarded the Third Prize, as set out below in the Section E ‘Prizes’.

4. The Winners will be notified by telephone and in writing and published on the Campaign Website by 19 December 2011.

5. All judging will take place at Cathay Pacific Australia, 7/10 Spring Street, Sydney NSW 2000 Australia.

E. Prizes

1. FIRST PRIZE: One travel prize to Hong Kong for the winner and three (3) travel companions (aged 18 years or older) for five (5) days (four (4) nights) during the period 22 March 2012 – 26 March 2012 (inclusive), valued at up to $10,000.00. The First Prize comprises of the following components:

a. four (4) return Economy Class Cathay Pacific airfares (including airfare related taxes and surcharges) from one chosen departure city (i.e. Adelaide, Brisbane, Cairns, Melbourne, Perth or Sydney) to Hong Kong. The winner and their chosen travel companions must all depart from the same port on the same flight on 22 March 2012 and return to the same port on the same flight on 26 March 2012;

b. four (4) nights in two (2) rooms (twin share) at The Gateway Hotel part of the Marco Polo Group of Hotels (or similar) (“Hotel Accommodation”). Check-in will be on 22 March 2012 and check-out on 26 March 2012 ; and

c. four (4) Hong Kong Sevens event tickets. The precise Hong Kong Sevens event for attendance by the winner and travel companions will be subject to availability and determined by the Organiser in its sole discretion.

2. SECOND PRIZE: two (2) return Economy Class Cathay Pacific [airfares to Hong Kong from the Australian capital city airport closest to the ordinary residential address of the winner (inclusive of airfare related taxes and charges, valued at up to $3,000.00.

3. THIRD PRIZE: one (1) six (6) month Platinum Fitness First membership, valued at $1,000.00.

F. First Prize Terms and Conditions

1. The First Prize must be booked by 28 January 2012 and travelled in full by 26 March 2012, or the First Prize is forfeited. Redemption of the First Prize is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including peak travel periods, school holidays, public holidays and special events). Use of the First Prize and any passes or vouchers issued as part of the First Prize may be subject to prevailing First Prize supplier terms and conditions of use. All components of the First Prize must be taken together and when offered or are forfeited. The winner and travel companion/s (if any) must travel together and depart from and return to the same departure point. The winner and travel companion/s (if any) may not accrue frequent flyer points (including but not limited to Asia Miles or Marco Polo Club’s Club mileage/sector credits) and may not upgrade airfares. No extension or variation of the travel dates nominated by the Organiser permitted. The First Prize cannot be used in conjunction with travel discounts or special offers. Travel and accommodation are to be arranged by a licensed travel agent nominated by the Organiser.

2. All additional costs not expressly stated, but which may be incurred in acceptance and use of the First Prize, are the responsibility of the winner and travel companion/s (if any) and are NOT included in the First Prize. Such additional costs include, but are not limited to, meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the First Prize, insurance, travel insurance, passports and visas (if applicable). Winner may be required to present a credit card at time of accommodation check-in.

3. The First Prize winner is solely responsible for their entry and the entry of their travel companions (if any) into Hong Kong, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Organiser. Failure to do so may result in the First Prize being forfeited. Winner is strongly advised to take out insurance cover for all appropriate risks.

4. Taking the First Prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers/travel insurance/tour or ticket providers, and in particular, any health, behaviour, age and safety requirements. No compensation will be payable if a winner or their travel companions (if any), are unable to use any element of the First Prize as stated for whatever reason, including ejection, refusal of entry into or departure from Hong Kong or the Hong Kong Sevens event or participation in certain activities for health, age, behaviour or safety reasons. Any tickets, passes or vouchers issued as part of the First Prize are subject to prevailing terms and conditions of use, are only valid for use within the stated duration on the tickets, passes or vouchers issued, and are not replaceable if lost, stolen or damaged. Any part of the First Prize that is not taken for any reason is forfeited.

5. For the duration of the First Prize, the Winner shall submit to the Organiser on a daily basis a short description and photograph (in a format as requested by the Organiser) of the Winner’s travel experience gained during the First Prize and Second Prize (as applicable) (“Experience Sharing Material”) which the Organiser may publish at its sole discretion. The Organiser shall have a non-exclusive licence to use all Experience Sharing Material on the same terms of Section J.1 (making all necessary changes to that clause).

G. Second Prize Terms and Conditions

1. The Second Prize must be booked by 30 September 2012 and travelled in full by 14 December 2012, or the Second Prize is forfeited. Redemption of the Second Prize is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including peak travel periods, school holidays, public holidays and special events). Use of the Second Prize and any passes or vouchers issued as part of the Second Prize may be subject to prevailing Second Prize supplier terms and conditions of use. All components of the Second Prize must be taken together and when offered or are forfeited. The winner and travel companion (if any) must travel together and depart from and return to the same departure point. The winner and travel companion (if any) may not accrue frequent flyer points (including but not limited to Asia Miles or Marco Polo Club’s Club mileage/sector credits) and may not upgrade airfares. No extension or variation of the travel dates nominated by the Organiser permitted. The Second Prize cannot be used in conjunction with travel discounts or special offers. Travel and accommodation are to be arranged by a licensed travel agent nominated by the Organiser.

Such additional costs include, but are not limited to, accommodation in Hong Kong, any transfers in Hong Kong,  meals, beverages,  telephone calls, laundry services, spending money, transport or travel to and from the airport departure point from their ordinary residential address, taxes including arrival and departure taxes (if applicable), insurance, travel insurance, passports and visas (if applicable). For the avoidance of doubt, the Second Prize ONLY includes airfares (including airfare related taxes and surcharges).

3. The winner is solely responsible for their entry and the entry of their travel companion (if any) into Hong Kong, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Organiser. Failure to do so may result in the Second Prize being forfeited.

H. Third Prize Terms and Conditions

1. The Third Prize is subject to prevailing Fitness First Terms and Conditions of membership, including expiration dates. The Third Prize is valid for non members only and may not be used in conjunction with any other offer or gift certificate.

I. General Prize Terms and Conditions

1. Total maximum Prize pool value is up to $14,000.00. Prizes are not transferable or exchangeable and there is no cash alternative. Prizes must be taken as offered and cannot be varied. The Organiser accepts no responsibility for any tax implications that may arise from the prize winnings. The Organiser accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST, depending on point of departure (as applicable).

2. If a prize or element of a prize becomes unavailable, for any reason beyond the Organiser’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.

3. Any air tickets issued for the First Prize and Second Prize are valid only on flight/date shown. Change of flight/dates, refund or cancellation of issued air tickets are not permitted.

4. The Organiser reserves the right to forfeit a prize and award or dispose of it in such manner and to such person as the Organiser deems fit if the Winner is disqualified for any reason at the sole discretion of the Organiser, including for any breach of these Terms and Conditions. In such circumstances the Winner shall not be entitled to any payment or compensation.

5. During their participation in the First Prize and Second Prize, the Winners shall behave in a manner expected of all international travellers in accordance with appropriate behavioural standards.

6. The Organiser may draw five (5) additional reserve entries in each round of judging and record them (in order) in case an invalid Entry or ineligible Entrant is drawn or the Entrant is unable to accept or participate in a Prize. Winners must confirm their eligibility to be awarded a prize, and ability to accept and participate in a prize within five (5) days of being successfully notified by the Organiser that they have been selected as a Winner, otherwise their Entry will be deemed invalid. In the event of an invalid Entry or an ineligible Entrant, or if the Entrant is unable to accept a prize or declines to participate in a prize, the prize will be awarded to the first reserve entry drawn. If a prize cannot be awarded to the Entrant selected, the Organiser will continue the process until the prize is awarded. If after this process a prize has still not been awarded or the Entrant selected cannot be notified, the Organiser will hold an unclaimed prize judging in accordance with Condition 8 below.

7. The Organiser may award a prize to the next best judged entry by 6 January 2012 at the same time and place as the original judging if a prize is unclaimed by that date. An unclaimed prize winner will be notified by telephone and in writing and their name will be published on the Campaign Website. All reasonable steps to notify an unclaimed prize winner of the results of the judging will be taken by the Organiser. Judges' decision is final and no correspondence will be entered into. 

J. Intellectual Property Rights

1. By entering into the Competition and submitting an Entry, each Entrant hereby grants to the Organiser a non-exclusive, irrevocable, royalty-free, worldwide, perpetual, sublicenceable and transferable license to use and exploit the Intellectual Property Rights subsisting in each of their Entries. The foregoing licence shall provide the Organiser the right to edit, publish, print, use, adapt, translate, exploit, modify, include in a compilation, copy, disseminate, dispose, load onto its server, broadcast and/or transmit each Entrant’s Entry for advertising, promotional, display and/or publicity purposes in all media and in perpetuity, and to use the Entries for all purposes connected with the Competition without any compensation, further permission or notification.  By participating in this Competition, each Entrant also hereby grants each visitor to the Campaign Website a non-exclusive licence to access an Entrant’s Entry and to view, use, reproduce and distribute such Entry only for the purposes of this Competition.

2. Each Entrant expressly consents pursuant to the Copyright Act 1968 (Commonwealth) to the Organiser having an unfettered right to treat an Entrant’s Entry in any manner at its sole discretion, to alter the Entry in any manner and to the Organiser not attributing authorship of the Entry to the Entrant.

3. All rights, title and interest in all Intellectual Property Rights in all of the Organiser’s brands, logos, trading names, products and/or services and the Application and Campaign Website will remain or be vested in the Organiser. Participation in this Competition by an Entrant will not under any circumstances be taken to constitute a transfer, assignment or grant of any ownership rights in any of the Organiser’s brands, logos, trading names and products and/or services. The Organiser, on a case by case basis and to the extent required, grants to each Entrant a non-exclusive licence for the Submission Period use of the Organiser’s brands, logos, trading names and products and/or services solely for the purpose, and to the extent necessary, to enable each Entrant to create their Entry.

4. For purposes of these Terms and Conditions, “Intellectual Property Rights” shall mean all intellectual property rights including, but not limited to patents, trade secrets, trade marks, service marks, copyrights and other rights in works of authorship (including rights in computer software), moral and artists’ rights, design rights, trade or business names, domain names, database rights and semi-conductor topography rights and whether any of the foregoing are registered or unregistered and all rights or forms of protection of a similar nature in any jurisdiction.

K. General Terms and Conditions

1. Without prejudice to any other rights of the Organiser, the Organiser shall, at any stage of the Competition, have the right to disqualify, without notice, any person and his/her Entry(ies) if the Organiser believes that such person does not meet the above eligibility requirements or such person has;

a. breached any of these Terms and Conditions;
b. submitted any invalid, incorrect, inaccurate and/or insufficient information in relation to the Competition; or
c. tampered with the entry process.

The Organiser’s legal rights to recover damages or other compensation from such an offender are reserved.

2. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.

3. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Competition. Entrants found to have provided incorrect, misleading or fraudulent information may, at the discretion of the Organiser, be deemed invalid. The Organiser reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation including but not limited to, if applicable, a copy of their current valid Australian passport (to the Organiser’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the Competition, before issuing a prize. If the documentation required by the Organiser is not received by the Organiser (or its nominated agent) or an Entrant or Entry has not been verified or validated to the Organiser’s satisfaction then all the Entries of that Entrant will be ineligible and deemed invalid.

4. The Organiser reserves the right to request a winner’s travel companion(s) (if any) (as applicable) produce (within the requested time) appropriate photo identification or other documentation (to the Organiser’s satisfaction, at its sole discretion) in order to confirm the travel companion’s (if any) identity and age before issuing a prize.

5. If this Competition is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Organiser reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Competition and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes.

Warranties

6. Each Entrant hereby warrants and represents that:
i. He/she fulfils all the requirements to enter into the Competition as set out in these Terms and Conditions;
ii. All personal data provided for purposes of entering into the Competition are true and accurate.
iii. All Entries of the Entrant comply with the entry requirements and rules set out in these Terms and Conditions.
iv. The Entrant is the owner of all Intellectual Property Rights in all entries of the Entrant and/or he/she has the necessary licence rights, consents and permissions to submit the Entry, and all Entries of the Entrant do not infringe any Intellectual Property Rights and any other rights of any person or entity;
v. All persons featured, named or described in any Entry have provided consent to the Entrant to be so featured, named or described and have provided consent for the Entry to be submitted for consideration and use in the Competition;
vi. Without limitation to (v) above if children feature in an Entry, parental/guardian consent has been obtained;
vii. The Entrant shall not disseminate or otherwise submit the Entry to another entity for publication or to be made into an audio/video feature;
viii. The Entrant has full power and authority to submit the Entry and that by doing so the Entrant is not breaching any agreement or law to which the Entrant is subject.
ix. The Entrant will comply with all applicable laws and regulations in participating in the Competition.

Indemnity

7. Entrants are solely responsible and liable for the content of their Entries and any other information they transmit to other Internet users. To the fullest extent permissible by applicable law, each Entrant agrees to indemnify and hold harmless the Organiser and its associated agencies and companies against all and any claims, losses, damages and costs (including any legal costs) arising out of or in connection with any breach by such Entrant of these Terms and Conditions, such Entrant’s participation in the Competition or the use, in whole or in part, by the Organiser of any Entry submitted by such Entrant in this Competition.

8. To the fullest extent permissible by applicable law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Competition. Facebook membership, the “liking” of Facebook pages, Facebook pages and use of Facebook generally is subject to the Facebook prevailing terms and conditions of use available at www.facebook.com.

Disclaimer

9. Each Entrant agrees that it enters and participates in the Competition at his/her sole risk.  To the fullest extent permitted by law the Organiser makes no warranties or representations of any kind regarding the Competition, the running of the Competition or as to the Prizes, all of which are provided on an “As Is” basis.  The Organiser assumes no liability or responsibility for (i) any errors, mistakes or inaccuracies in running the Competition (ii) any personal injury or property damage of any nature resulting from creating Entries or participating in the Competition (iii) any unauthorized access to or use of an Entry.

10. The Organiser, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Competition. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Competition and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Competition as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of a prize.

Personal Data Protection

11. For purposes of this Competition, the Organiser needs to collect personal data from the Entrant.  Failure to provide personal data as requested will result in Organiser being unable to process or accept an Entry.  In this respect, each Entrant confirms that he/she has read and fully understands the Organiser’s Data Privacy and Security Policy (www.cathaypacific.com) and consents to the Organiser’s use (including any transfer) of such Entrant’s personal data for purposes of the Competition in accordance with this policy and as set out in these Terms and Conditions. An Entrant can gain access to, update or correct any personal information held by the Organiser by writing to the Organiser’s Privacy Officer at: aus_distribution@cathaypacific.com.  All personal information will be stored at the office of the Organiser. A copy of the Organiser’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Organiser.

12. By participating in the Competition and also chooses to “opt-in” in the manner required on the Campaign Website, an Entrant also acknowledges that a further primary purpose for collection of the Entrant’s personal information by the Organiser is to enable the Organiser to use the information to assist the Organiser in improving goods and services and to contact the Entrant in the future with information on new promotions or special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Organiser may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way. By entering the Competition and opting-in, an Entrant acknowledges and agrees that the Organiser may use the Entrant’s personal information in the manner set out in this condition.

Publicity

13. As a condition of entering this Competition, an Entrant consents to, in the event they are a winner, the Organiser using the Entrant’s Entry, Experience Sharing Material (if applicable), name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Organiser. The Entrant agrees that, in the event they are a Shortlisted Entrant or Winner, the Entrant will participate in all reasonable promoted activities in relation to the Competition as requested by the Organiser and its agents. Entrants also agree that the Organiser may publish or cause to be published the Entrant’s Entry (or part thereof) and/or Experience Sharing Material (if applicable) on the Campaign Website and/or Application for public viewing.

14. The Organiser shall deem the information voluntarily supplied non-confidential, which hereby discharges all obligations of confidentiality to the extent permitted by law.

Contract of Carriage

15. For the avoidance of doubt, nothing in these Terms and Conditions is, or shall be construed in any way as, a contract of carriage.  Any tickets issued pursuant to arrangements in these Terms and Conditions will result in a contract of carriage between the travelling passenger and the relevant carrier.  These tickets upon which such passenger travels will be subject to the conditions of carriage of the relevant carrier and all rules applicable to the general public for the class or category of fare selected, including also any charges for changes in travel arrangements that may be applicable to the class or category of fare selected.

Further Assurance and Supplementary Agreement

16. Each Entrant and in particular Shortlisted Entrants undertake at the request of Organiser to do all acts and execute all documents which may in Organiser’s opinion be necessary to confirm Organiser’s licence to use an Entry.

17. As a condition for receiving the Prize the Winner may be required to enter into an express agreement(s) or legal release(s) with Organiser relating to the acceptance and/or use of the Prize, the preparation and submission of Experience Sharing Material and the use of such Experience Sharing Material and/or their Entry by the Organiser.

Changes to Terms and Conditions

18. The Organiser shall have the right to cancel the Competition and /or amend these Terms and Conditions at any time without prior notice. Any changes will be posted on the Campaign Website.

19. It is the responsibility of each Entrant to check and meet his/her local judicial requirements and to comply with all local and applicable laws before and by way of submitting his/her Entries.

20. In the event of any dispute regarding these Terms and Conditions, conduct, results, and all other matters relating to the Competition, the decision of the Organiser shall be final and no complaints shall be entertained and no correspondence or discussions shall be entered into. The Organiser shall not be obliged to consider any appeal by or enter into any correspondence with the Winner or any other person on any other matter concerning a prize.

21. Nothing in these Terms and Conditions shall confer any third parsty rights or benefits.

Governing Law

22. This Competition and the Terms and Conditions shall be governed in all respects by the laws of New South Wales, Australia and each Entrant submits to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts competent to hear appeals from those courts.
