Facebook T.O.M Organic Giveaway
 
1. This promotion is open only to Australian and New Zealand residents aged 18 years and over.
 
2. To be eligible to enter, individuals must, during the promotional period: (a) "like" the HealthSmart Facebook page (located at www.facebook.com/HealthSmartMagazine); (b) follow the prompts to access the entry form (located at www.readersdigest.com.au); (c) include all of the requested details on the entry form and nominate one (1) friend to also “like” the page; and (d) submit the fully completed entry form.
 
The entrant’s nominated friend must then visit www.facebook.com/HealthSmartMagazine and follow the prompts to “like” the HealthSmart Facebook page during the promotional period.
 
Once the entrant’s nominated friend “likes” the page, the entrant (who nominated them) will receive an entry into the draw. It is the entrant’s responsibility to ensure that their nominated friend “likes” the page during the promotional period.
 
3. The promotion opens on 27/10/2011. Entries close at 11:59pm (Sydney time) on 25/11/2011. The prize will be drawn at Reader’s Digest, 80 Bay St Ultimo NSW 2007. The draw will take place on 01/12/2011 at 10:30am.
 
4. The promotional material, information on how to enter and prize details form part of these Terms and Conditions. Employees of the Promoter, T.O.M Organic, and members of their immediate families are not eligible to enter. All eligible entries will have an equal chance to win. The Promoter cannot accept responsibility for lost, misdirected or delayed entries.
 
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights
 
6. The Promoter will conduct the draw and the winner declared will be final and no correspondence will be entered into.
 
7. The first eligible entry drawn will win two (2) x 12-month supply of T.O.M Organic tampons, one for them and one for their nominated friend. A 12-month supply of T.O.M Organic tampons consists of 12 packs of your choice of mini tampons (8 per pack), regular tampons (8 per pack) or super tampons (7 per pack). Total combined value of the two (2) 12-month packs is $191.76. Prizes are not transferable or exchangeable or redeemable for cash. Both 12-month packs will be awarded to the original entrant and it is the original entrant’s sole responsibility to distribute one of the prize packs to their nominated friend.
 
8. The prize winner and their nominated friend will be notified by email after the draw and published on our website www.readersdigest.com.au.
 
9. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
 
10. The Promoter may conduct such further draws at the same time and place as the original draw as is necessary on 01/03/2012 in order to distribute the prize, if it remains unclaimed by that date.
 
11. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter's decision on all matters pertaining to this promotion is final and no correspondence will be entered into.
 
12. Limit one (1) entry per person.
 
13. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The Promoter accepts no responsibility for late, non-directed or misdirected entries, for any technical hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any human error which may occur in the receipt or processing of entries. Further, the Promoter accepts no responsibility for damage to computer systems from downloading any information necessary to participate in the promotion. The Promoter reserves the right to terminate or modify the promotion at any time if the Promoter’s on-line service is no longer available or is compromised by any virus, bugs, or other intervention beyond the Promoter’s control. In either of these events, the prize may be awarded based on entries received prior to date of termination. The Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the internet entry process or is in any other way responsible for compromising the orderly operation of the promotion. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 
15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
