Terms and conditions

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. Entry is open to all residents of Australia who are 18 years of age or over. However, employees and their immediate families of News Limited Pty Ltd, Salmat IDR Pty Limited, and their associated agencies and companies are not eligible to enter.

3. The entire Discover Local and Win Promotion commences on October 17, 2011 at 06:00 AEDT and concludes on December 3, 2011 23:59 AEDT. There will be two components to the competition as outlined below

Component 1 – Enter to Win one of Twenty Prizes

4. The first component of the Discover Local and Win Promotion commences on October 17, 2011 at 06:00 AEDT and concludes:
a. For last mail entries postmarked November 14 and received prior November 18, 2011.
b. Last SMS received on November 13, 2011 23:59 AEDT
c. Last Web entry received on November 13, 2011 23:59 AEDT

5. All valid competition entrants will go into the draw to be selected as one of Twenty (20) prize pool winners. These prize pool winners will attend a promotional event on 3rd December 2011 for the drawing of the competition prizes, with one prize to be won per winner (20 winners for 20 prizes)

6. The competition will be advertised within Cumberland Courier newspapers and online sites for: Blacktown Advocate, Canterbury-Bankstown Express, Central Coast Express Advocate, Fairfield Advance, Hills Shire Times, Hornsby & Upper North Shore Advocate, Inner West Courier, Liverpool Leader, Macarthur Chronicle, Mt Druitt-St Marys Standard, North Shore Times, Northern District Times, Parramatta Advertiser, Penrith Press, Rouse Hill Times, Southern Courier, The Manly Daily, The Mosman Daily, Wentworth Courier, and Central.

7. UNIQUE CODE WORDS: Each week across the competition period, code words will be published in each of the Cumberland Courier Newspapers. Three unique code words will be printed per week, across four weeks and each daily publication will feature all three code words for that week. Unrecognised code words will not be accepted. Participants may enter only once per week.

8. To enter, each week participants must find the three unique code words printed for that week within promotional advertisements placed inside a Cumberland Courier newspaper and either:
a. Send a text/SMS message to 199 199 06. Entries to the SMS number must include all three code words for that week of entry and the entrant’s full name, email address, postcode. SMS entrants will receive a reply message. Or
b. Complete and cut out a competition entry form plus three coupons (one for each code word) from within a Cumberland Courier newspaper and send to Discover Local and Win Promotion, PO Box 662, Parramatta NSW 2150. Or,
c. Log onto www.cumberland-courier.whereilive.com.au or the website of any of the Cumberland Courier newspaper brands and register their details including (but not limited to) name, e-mail address, postcode and all three code words for that week of entry.

9. SMS ENTRY: The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

10. MAIL ENTRY: Each entry form/coupon must be sent in a separate, stamped, standard sized envelope. Envelopes with multiple entry forms/coupons will be treated as a single entry. Only original entry form/coupon will be accepted, no photocopies allowed.

11. This promotion is not open to entrants under the age of 18 and proof of age will be required prior to confirmation of a valid winning entry.

12. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.

13. Entrants in the competition may enter once per week.

14. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

15. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

16. Weekly entries must be received by:
a. Week 1 – SMS and Web entries due 23 October, 2011 at 23:59 AEDT. Mail entries postmarked 24 October, 2011
b. Week 2 – SMS and Web entries due 30 October, 2011 at 23:59 AEDT. Mail entries postmarked 31 October, 2011
c. Week 3 – SMS and Web entries due 6 November, 2011 at 23:59 AEDT. Mail entries postmarked 7 November, 2011
d. Week 4 – SMS and Web entries due 13 November, 2011 at 23:59 AEDT. Mail entries postmarked 14 November, 2011

All dates and times listed are
• the times SMS messages are received by the Salmat IDR Pty Limited database,
• the time online entries are received by the News Limited database, and
• the date that last mail is received by Cumberland Courier Newspapers

The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.

17. Any entry that is made on behalf of an Entrant by a third party will be invalid.

18. SMS cost is $0.55 (including GST). Higher rates apply to calls to the 1900 number from mobile phones. Service not available from payphones. Standard postage is now $0.60 incl GST. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.

19. At the close of the Component 1 stage, twenty (20) individual winners will be drawn to form a pool of winners. The draw will take place in the presence of a valid Scrutineer, November 23, 2011 at 12:00 (AEDT) at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060.

20. The winners will be notified by the Promoter within 2 days of the draw of the pool of winners (required for NSW Permits). The winners will be notified of their place in the final twenty for the Promotional Draw by phone followed by email invitation to the Prize Pool draw. Winners from Component 1 will have their details published online within 2 days of the Prize Pool draw and in the Public Notices section of all Cumberland Courier newspapers within 2 days of the Prize Pool draw.

21. Prizes Pool winners places will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or email address account holder).

22. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

23. All Component 1 winners must claim their place in the final twenty by phone or email by Monday November 28, 2011 at 12:00 AEDT and if their place remains unclaimed, a further draw will be conducted on Monday November 28, 2011 at 15:00 AEDT at the same place as the original draw (subject to written directions given under State Regulations). In the event of a re-drawn winner, they will be notified by the Promoter within 2 days of the re-draw of their place in the final twenty (required for NSW Permits). These winners will be notified by phone followed by email invitation to the Prize Pool draw. Re-draw winners from Component 1 will have their details published online and in the Public Notices section of all Cumberland Courier newspapers within 2 days of the re-draw.

Component 2 – Promotional Prize Drawing Event

24. Each individual winner of a place in the final twenty are required to attend a promotional event in Sydney (location TBC) on 3rd December 2011 at 12:00 (AEDT).

25. At this event each winner will draw a sealed prize envelope from a barrel containing twenty unmarked identical prize envelopes containing the details the prize they have won from the prize pool. An independent scrutineer must be present at this draw event

26. The Component 2 prize pool consists of twenty prizes across three major prize types:

a. Prize A – One 2011 Hyundai Accent 1.6 Premium Manual with on-road coasts including dealer delivery, 12mths registration & CTP, and other government charges, plus $375 for metallic paint, worth $24,780,
b. Prize B – Four (4) Taste kitchens with full installation, worth $12,500 each,
c. Prize C – One (1) $10,000 cash prize
d. Prize D – One (1) $5,000 cash prize
e. Prize E – Eleven (11) $1,000 cash prizes
f. Prize F – Two (2) $500 cash prizes

Total prize value is up to = $101,780 (including GST)

27. Prizes cannot be transferred and cannot be redeemed for cash except for the prizes where cash is specified.

28. FOR CAR PRIZE: Comprehensive insurance, additional options and all ancillary costs (including travel to and from the dealership) are the responsibility of the winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.

29. FOR KITCHEN PRIZE: Full installation is included with these prizes for locations within the Greater Sydney metro area and must be commenced prior to June 30, 2012 and completed no later than December 23, 2012. Appliances (including but not limited to refrigerators, dish washing machines, stove tops, ovens, microwave ovens), light fitting, tap fittings and sinks are not part of this prize

30. FOR CASH PRIZES: All cash prizes will be awarded in the form of a cheque of a direct transfer into the winner’s nominated bank account. No exceptions.

31. Unless expressly stated in these terms and conditions all other expenses including installation costs, travel to and from prize collection point, etc become the responsibility of the winner.

32. If a Component 2 prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

33. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize and Component 2 prize drawing, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting a Component 2 that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

34. Once Component 2 prizes have left the Promoter’s premises or have been signed for delivery by the winner of their prize, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

35. By accepting a component 2 prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

36. In consideration for the Promoter awarding a Component 2 prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

37. In consideration for the Promoter awarding a Component 2 prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Cumberland Courier Treasure Hunt or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

38. In the event that for any reason whatsoever a winner does not take an element of a Component 2 prize at the time stipulated by the Promoter then that element of this Component 2 prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

39. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

40. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

41. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

42. It is a condition of accepting a Component 2 prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

43.It is a condition of accepting a Component 2 prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

44. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

45. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

46. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

47. News Limited Pty Ldt, Salmat IDR Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available.

48. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

49. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.

50. AUTOMATIC OPT-IN: By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.

51. Salmat IDR Pty Limited, on behalf of News Limited, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat IDR Pty Limited for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.

52. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
