The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006. 2. Instructions on how to enter form part of the conditions of entry. The promoter’s decision is final and no correspondence will be entered into. 3. Entry is only open to residents of Victoria. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,nephew, brother, sister, step-brother, step-sister or first cousin. 4. The competition commences Wednesday October 26, 2011 at 00:01am (AEDT) and concludes at 23:59pm (AEDT) Sunday November 13, 2011. (“the Competition Period”). 5. To enter, readers must visit weeklytimesnow.com.au/competitions and register their details on the competition link. Entries without the required information will be deemed incomplete and will not count towards an entry into the Promotion. 6. One entry per email address will be accepted. 7. The time of entry will in each case be the time the entry is received by the Promoter. 8. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries. 9. The first valid entry drawn at random from the pool of entrants who entered their details during the competition period will be the winner. The draw will take place at The Herald & Weekly Times, 40 City Road, Southbank VIC 3006 at 10.00am (AEDT) on Wednesday November 16, 2011. 10. If the winner of any prize is under the age of 16 years, the prize will be awarded to the winner’s nominated parent or guardian. 11. The winner will be notified by phone and in writing within five days of the draw. Winner’s details will be published in the public notices section of The Weekly Times on Wednesday November 23, 2011. 12. The winner will receive 1 x Nectre Alfresco Fire Outdoor Heater valued at $2,250 + delivery charges. The prize includes a 9Kg LPG Gas Bottle and comes with traditional coals. 13. Prize value correct at time of printing. Prize delivery is included – door to door delivery if the winner is located in greater Melbourne, or delivery to the nearest country depot should the winner be located outside of the greater Melbourne area. Prize will be delivered within 28 days of the draw date. All other ancillary costs not outlined above are the responsibility of the winner. 14. The Promoter takes no responsibility for any repairs from the date and time of collection of the prize. 15. The prize must be taken as offered and is not transferable, exchangeable or redeemable for cash. Any unused portion of the prize is non-refundable and non-redeemable for other goods or services. 16. If the prize remains unclaimed, an unclaimed prize draw will be held at 3.00pm (AEDT) on February 27, 2012 at HWT, 40 City Rd, Southbank VIC 3006 subject to any written directions given by the relevant state permit regulatory authorities. The winner will be notified in writing and by phone and their name will be published in the Public Notices section of The Weekly Times on Wednesday March 7, 2012. 17. If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the Promoter will endeavor but is not obliged to provide a substitute prize of equivalent value. 18. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. 19. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation. 20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following: a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); b) any theft, unauthorised access or third party interference; c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; d) any variation in prize value to that stated in these conditions of entry; e) any tax liability incurred by a winner or entrant; f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or g) participation in the prize, including attendance at the venue. 21. Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 22.
