Entry Period: The competition can be entered from 12:00:01am (AEST) on Monday 7 November 2011 until 11:59:59pm (AEST) on Sunday 18 December 2011 (“Entry Period”). The Entry Period is broken into 6 week blocks: Week 1: 12:00:01am (AEST) on Monday 7 November to 11:59:59pm (AEST) on Sunday 13 November 2011 Week 2: 12:00:01am (AEST) on Monday 14 November to 11:59:59pm (AEST) on Sunday 20 November 2011 Week 3: 12:00:01am (AEST) on Monday 21 November to 11:59:59pm (AEST) on Sunday 27 November 2011 Week 4: 12:00:01am (AEST) on Monday 28 November to 11:59:59pm (AEST) on Sunday 4 December 2011 Week 5: 12:00:01am (AEST) on Monday 5 December to 11:59:59pm (AEST) on Sunday 11 December 2011 Week 6: 12:00:01am (AEST) on Monday 12 December to 11:59:59pm (AEST) on Sunday 18 December 2011 Sponsor’s computer clock in Sydney is the official time clock for the entries and will be time stamped accordingly. 2. Eligibility: The competition is open only to legal residents of Australia and New Zealand, who are 18 years of age or older. Employees and their immediate families of the Sponsor , its affiliate companies, retailers, printers, advertising and promotion agencies and those otherwise associated with the development, distribution or implementation of this competition or anyone employed in the Sponsor’s or its affiliate’s owned, leased, managed or franchised hotels are not eligible to enter. By entering, each entrant agrees to the terms and conditions set out in these official rules. 3. How to enter: Entrants must go to http://www.facebook.com/hiaustralasia and enter during the Entry Period by becoming a “fan” of the Holiday Inn Australasia page and providing their contact name, email address and preferred destination from the 7 options available. Entrants may enter as many times as they like in any week of the competition. By indicating a preferred destination from the options available, the entrant will be placed in the weekly draw for prizes at that destination. The 7 destination options are: New South Wales, Victoria, Queensland, Western Australia, Northern Territory, New Zealand and Vanuatu. 4. Prize Draws: On each draw date listed below, a separate draw will take place at 71 Albion Street Surry Hills, NSW 2010 for the prior week’s entries in each of the 7 preferred destinations, using random number generator software titled “Random.org” (ie 1 draw per preferred destination each week (7 draws in total each week)). An entry in any week is for that draw in that preferred destination only and will not be rolled into the next weekly draw or a draw for any other preferred destination. Prizes: On each Draw Date, 7 prizes at each of the Holiday Inn hotels listed below will be drawn for each of the preferred destinations. Each prize is: (i) a one night stay (room only) at one of the Holiday Inn hotels in the Australian or New Zealand preferred destinations listed below, valued at up to AUD$170; or (ii) a two night stay (room only) at Holiday Inn Resort Vanuatu, valued at up to AUD$340, in the week commencing 4 weeks from the Draw Date (the “Redemption Week”). NB. The night of the winning stay in the Redemption Week is at the discretion of the hotel. Travel arrangements to & from the hotel are the winner’s responsibility. Each prize is for a maximum of 2 persons aged 19 and over, staying in the room using existing bedding. Subject to a maximum of 3 persons staying in the room at any time, children under 19 may stay without additional charge (Kids Stay Free at Holiday Inn) using existing bedding. For any additional persons staying in the room, charges will apply. 6. Notification of winners: Winners will be notified in writing (via email) by close of business on the Draw Date and within the email given a reservations email address and a redemption request form to complete with their details and preferred hotels and dates, by order of preference to make their redemption booking in the preferred destination. Winners’ names will also be posted on the Holiday Inn Australasia facebook page. Holiday Inn Resort Vanuatu prize winners’ names will be published in The Australian newspaper on the publication dates set out in clause 4 above. 7. Redemption of prizes: Prizes are redeemable for stays in the week commencing 4 weeks from the Draw Date only, as specified below. All bookings must be made within 3 weeks of the Draw Date or the prize will be forfeited. Booking of the stay is the responsibility of the winner. The Sponsor is not responsible for winners not receiving the night of their choice at the hotel of their choice, in the preferred destination. Prizes are transferable to a friend or family member, provided that the winner books the room in the name of that person. 8. Total prize pool: Total prize pool value is up to AUD$121,380 at time of printing. Prizes, or any unused portion of a prize, are not exchangeable and cannot be taken as cash, unless otherwise specified. Taxes and fees, if any, are the sole responsibility of the winners. 9. Unclaimed Prize Draws: The Sponsor may conduct any further draws at the same place as the original draws as is necessary on the draw dates and times specified below in order to distribute any prizes (if any) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner or winners in the unclaimed prize draw, the winner or winners will be notified in writing (via email) and Holiday Inn Resort Vanuatu prize winners’ names will be published in The Australian newspaper on the publication dates set out below. Personal Information: The Sponsor collects entrants’ personal information in order to conduct the competition. If the information requested is not provided, the entrant may not participate in the competition. By entering the competition, unless otherwise advised by the entrant in writing to the Sponsor, each entrant consents to the information they submit with their registration being entered into a database and the Sponsor may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. As per relevant privacy legislation, a request to access, update or correct any information should be directed to the Sponsor’s office. All personal information collected will be used by the Sponsor in accordance with its privacy policy. 11. Limitations of Liability: Nothing in these terms & conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Sponsor (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) this competition; (b) any technical difficulties or equipment malfunction (whether or not under the Sponsor’s control); (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Sponsor) due to any reason beyond the reasonable control of the Sponsor; (e) any variation in prize value to that stated in these terms & conditions; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize. 12. General: The Sponsor reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Errors and omissions will be accepted at the Sponsor's discretion. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Sponsor, including but not limited to technical difficulties, unauthorised intervention or fraud, the Sponsor reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate. Any cost associated with accessing the competition website is the entrant’s responsibility. 13. Governing law: These terms and conditions are governed by the laws of New South Wales, Australia.
