Terms and Conditions Kinect for Xbox 360 Promotion

1Information about how to enter and prizes forms part of these Conditions of Entry. Entry into the “Kinect for Xbox 360 Promotion” (Promotion) is deemed to be an acceptance of these
Conditions of Entry.

2The Promotion commences at 10:00 AEST on 10 November 2011 and closes at 23:59 AEST on 11 December 2011 (Entry Period).

3Entry is only open to Australian residents who are members of Kleenex Mums. If you are not already a member of Kleenex Mums you can join online at www.kleenexmums.com.au. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.

4To enter the entrant must, during the Entry Period:
(1)Log onto www.kleenexmums.com.au/promotions (Kleenex Mums Website);
(2)Click on the competition link on the Kleenex Mums Website to enter the ‘Kinect for Xbox 360’ Promotion;
(3)Complete all the information requested for Entry into the Promotion including personal contact information; and
(4)Follow the link in the email sent by the Promoter to confirm Entry into the Promotion prior to the end of the Promotion Period.

5Entries are deemed to be received by the Promoter at the time the entrant confirms the Entry by following the link in the email sent by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

6A maximum of one (1) Entry may be submitted per household per week during the Promotion Period.
Draw

7All valid entries received during the Promotion Period will be placed in a draw to be drawn via electronic draw tool to be held at Kimberly-Clark Australia, 52 Alfred Street Milsons Point NSW, 2061 on 12 December 2011 at 10:00 AEST (Draw Date).

8The Promoter and its associated agencies or companies accept no responsibility for any lost, late, stolen, damaged or misdirected Entry.

9The Promoter has no control over internet or mobile telephone communications, networks or lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.

10Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will void the entrant’s entry.

11The first five (5) entries drawn electronically at random on the Draw Date will win a Prize (Prize Winners).

12The Prize consists of one (1) Xbox 360 Family Pack which contains:
(1)One (1) 4GB Kinect for Xbox 360 console bundle valued at $399.00;
(2)One (1) Once Upon a Monster game valued at $69.95; and
(3)One (1) Kinect Sports game valued at $69.95.

13Each Prize is valued at $538.90. The total prize pool is up to a maximum of $2,694.50. The value of the Prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize(s) after that date.

14Each Prize Winner will be notified in writing by email on 12 December 2011. The names of the winners of each Prize will be published on the Kleenex Mums Website by 12 December 2011 and published in the Australian on 19 December 2011.

15The prize(s) (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The prize(s) must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute the prize(s) with a prize or prizes of equal or greater value (including where a prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.

16The Promoter may conduct such further draws as are necessary for an unclaimed prize at Kimberly Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 12 March 2012 at 10.00am AEST, subject however to any directions given by any applicable gaming authorities. The winners of any unclaimed prize will be notified in writing by e-mail within two (2) days of the relevant draw and details of the winner of any unclaimed prize will be published on the Kleenex Mums Website by 12 March 2012 and published in the Australian on 19 March 2012.

17All tax liability arising as a result of accepting any prize is the responsibility of the winner.

18The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.

19If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.

20If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion, subject to approval of the gaming authorities in each State and Territory where relevant.

21The Promoter reserves the right to validate and check the authenticity of entries and online entry forms, and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry. Any entry made with stolen, forged, mutilated, unrecognised or tampered with entry forms is void.

22The winner agrees to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the winners’ names, voices, images and likenesses for
advertising and publicity purposes in any media in perpetuity without additional compensation.

23The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.

24All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
