Kmart Ok it forward Game of Skill Competition Terms and Conditions

By entering the 'Kmart Ok it Forward Game of Skill' Competition (the "Competition"), you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1.   Information on how to enter forms part of the terms of entry.

2.   WHO CAN ENTER?
2.1   Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven and Austereo Signals are received, who are 18 years of age or older.

2.2   Employees and their immediate families of Seven Network (Operations) Limited, Pacific Magazines, Yahoo!7 Pty Ltd, m.Net Corporation Ltd, , Kmart Australia Ltd and their associated agencies and companies are not eligible to enter.

3   HOW TO ENTER
3.1   The Competition commences on Monday 10th October @ 1700 pm AEDST and concludes on Thursday 8th December @ 1000 am AEDST ("Competition Period").

3.2 To enter, users will see editorial modules appear across the yahoo!7 online network during the promotion period, across this time a series of editorial modules will run and people will be prompted to register their details at www.okitforward.com.au and:

Complete the entry fields required including gender, DOB, number of children (if any) and the last time they visited a Kmart store.
leave their full name, address (including postcode) and daytime telephone number (including STD area code); and
Follow the prompts to upload a video of your latest Kmart Haul.
3.3 All entries cannot refer to any other retailer other than Kmart and should avoid featuring any prominent competitor logos on the products that are being featured in the haul. By entering this competition, all entrants confirm that they have the permission of all subjects of the video to film and publicise the video. The Entrant also undertakes that their entry is not in breach of any third party intellectual property rights.

3.4 Once an entry is received by the Promoter, the video will be uploaded to the promotional website. Personal information published at www.okitforward.com.au will be limited to the entrant's first name and the suburb they have entered into the address field at point of entry.

3.5   All entries will be reviewed by the Promoter. The Promoter reserves the right not to upload an entry onto the promotional website, in its absolute discretion, if the entry does not comply with these Terms and Conditions.

3.6   Entrants (including winners) in the Competition may enter as many times as they like but may not use "scripting" for multiple entries (which will be deemed invalid).

3.7   Entries will be judged on creativity, entertainment and originality and chance plays no part in determining a winner.

3.8   Entries must be received by the www.okitforward.com.au web address detailed in clause 3.2 by 09:59 am AEDST on Thursday 8th December 2011

3.9   The entry must be

the original independent creation of the entrant; and
be free from any claims, including but not limited to copyright or trademark claims, by other retailers.
3.10   Entries remain the property of the Promoter and Sponsor and will not be returned to the entrant/s. The winning entrants agree to grant the Promoter and Sponsor a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners will not be entitled to any fee for such use.

3.11   The time of entry will in each case be the time indicated in the entry as received by www.okitforward.com.au website address.

3.12   Entry into the Competition is free and any costs the entrant may incur for access to an internet provider or server is the responsibility of the Entrant.

3.13   The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

4   PRIZES
4.1   There will be Eight (8) prize winners in total (excluding the Northern Territory, Australian Capital Territory and Tasmania). Winners will receive the corresponding prize package/s as set out in clause 4.2.

4.2   Each winner will win the following prize package:

4.3   Total Combined Prize Value is: $800.00 AUD (excluding GST). Prize value is correct as of 10th October 2011. The Promoter accepts no responsibility for any change in prize value.

4.4   The winners of the Kmart Gift Voucher understand that the Kmart Gift Card is redeemable for goods purchased at participating Kmart stores. The Kmart Gift Card is valid for 24 months from date of issue. Gift Cards are non-refundable and cannot be exchanged for cash. Each Kmart Gift Card can be redeemed in whole or for part of a payment. Unredeemed values will remain on the card until card expiry or until redeemed, whichever occurs first. No cash will be given if purchases amount to less than the value of the voucher. Balances can be checked in store. Kmart and the Promoter are not responsible for lost, stolen or damaged cards. The Kmart Gift Voucher is not a cheque guarantee, credit or charge card. The Kmart Gift Voucher should be treated as cash. Kmart reserves the right to amend the terms and conditions of the gift card at any time and to take appropriate actions, including the cancellation of the card if, at its discretion, it deems such action necessary. 4.5   In accepting the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed, recorded and photographed. The winners agree to grant the Promoter a perpetual and exclusive licence to use such footage photographs and audio in all media worldwide and the winners will not be entitled to any fee for such use.

4.6   The winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.7   Any costs or arrangements related to any element of the prize(s) which is not expressly stated in these terms and conditions are the responsibility of the winner

4.8   The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven Network's programming, scheduling or production requirements. The Promoter may at its discretion provide notice of any changes in the competition segments aired during the Competition.

4.9   The winning entrants agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.10   Prizes are not transferable or redeemable for cash.

5   HOW TO WIN
5.1   All valid entries will be individually judged by the Promoter's panel of judges based on creativity, entertainment and originality and chance plays no part in determining a winner. One (1) winner will be selected each week for 8 weeks at 1200 AEDST on the following dates

at 160 Harbour Esplanade Docklands 3008 by a panel of judges nominated by the promoter, to be the most creative, entertaining and original entries from all entries received ("Winners")

5.2   The judges reserve the right to select additional reserve entries at any stage in this promotion which they determine to be the next best and record them in order in case of an invalid entry.

5.3   Each entrant who has entered the Competition within the opening and closing dates and complied with all entry requirements will be eligible to win. Entries that do not contain the information required by clause 3.2 or that do not otherwise comply with these terms and conditions, may be deemed to be invalid.

5.4   Any Entry that is received within the opening and closing dates and complied with all entry requirements who is not deemed the most creative, entertaining and original (Winning) entry for any given week will be re-entered into the promotion for each week following until the promotion ends.

5.5   The competition is a game of skill and chance plays no part in determining the winner.

5.6   The Winners will be notified by phone before 5pm on the same day the judging takes place and their name and locality will be published on the promotional website.

5.7   The judges' decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result The Promoter may in its absolute discretion deem an entry invalid after notification of a winning entry has occurred if it is discovered that entry was not submitted in accordance with these terms and conditions.

5.8   It is a condition of accepting the prize that the winner must comply with all conditions of use of the prize and also the prize supplier's requirements.

5.9   It is a condition of accepting the prize that the winner (and any companions) give full permission to the Seven Network (Operations) Limited, Pacific Magazines, Yahoo!7, and Kmart Australia Ltd to utilise their name, likeness image/s and audio for the purposes of PR and advertising material, as required to support the campaign beyond the event day.

6   NO LIABILITY
6.1   In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.

6.2   Seven Network (Operations) Limited & affiliates, Kmart Australia LTD and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3   Seven Network (Operations) Limited & affiliates, Kmart Australia LTD and their associated agencies and companies and Southern Cross Austereo will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

during the judging;
whilst undertaking any travel won on or connected with their entry into the Competition; or
in the participation in the competition or the acceptance, participation in or use of any prize;
as a consequence of late, lost or misdirected mail;
due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person.
in relation to failure of an entry message to be received by the Promoter on account of technical problems or traffic congestion; or
arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.
arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion.
6.4   The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven's programming, scheduling or production requirements.

7.3   Yahoo!7 Pty Limited, on behalf of Seven Network (Operations) Limited, Kmart Australia LTD will be collecting the entrants' personal information in accordance with Yahoo!7's Privacy Policy located at http://privacy.yahoo.com.au/privacy/au. Entry details remain the property of the Promoter. In addition, if you consent, your personal information will be used for the purpose of Kmart Australia Limited and Austereo Pty Ltd sending you information regarding Kmart Australia and Kmart Australia products, and your information will be disclosed to Kmart Australia Limited for this purpose.
