Terms and conditions

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
The promotion commences at 00:00.01 (AEST) on 01/11/11 and closes at 23:59.59 (AEST) on 08/02/12 (“Promotion Period”).

Entry is open to residents of Australia who are aged 18 years or over (“Eligible Entrant”). Directors, employees and their immediate families of the Promoter, its agencies and retail outlets associated with this promotion are ineligible to enter.

To enter, an Eligible Entrant must, during the Promotion Period, purchase any Whirlpool product from any retailer across Australia (“Eligible Purchase”), then visit http://www.thewhirlpool100.com.au and complete the online entry form with their full name, street address, email address, contact telephone number, Eligible Purchase details including serial number, name of retailer from which the product was purchased, date of purchase, purchase price and invoice/receipt number.

Whirlpool Cash Back Offer customers only: Customers who submit a valid claim in the ‘Whirlpool Cash Back November offer’ or the ‘Whirlpool Cash Back December offer’ will automatically be entered into the Major Prize Draw and any remaining Daily Prize Draw(s) of this Promotion. Entry into this Promotion and any remaining Daily Prize Draw(s) will commence on the next business day after the customer’s claim was processed by the Promoter. One (1) entry for every valid claim submitted will be awarded, subject to Condition 3 of these Terms and Conditions.
Any costs associated with accessing the Promotion remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the Promotional Website shall be deemed invalid and will result in an ineligible entry.

Multiple entries are accepted, however each entry must be based on a separate Eligible Purchase and must independently comply with these Conditions of Entry. Entries will be deemed accepted at the time of receipt, not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the Promotional Period.
Only one Daily Prize per person and household will be permitted, excluding SA residents who are entitled to win more than one prize.
Entrants must retain, and may be required to present an original store receipt of their Eligible Purchase and for all entries they have submitted (“Proof of Purchase”). A failure to provide Proof of Purchase for all entries may, at the discretion of the Promoter, result in all entries submitted by an entrant being deemed invalid.
Prize Draws: There are two types of Prize Draws (not including any further draws conducted in Condition 20): the Daily Prize Draws and the Major Prize Draw.

Daily Prize Draws: Daily Prize Draws will take place at Prime Focus, 403/62 Beach Street, Port Melbourne, Victoria 3207 at 11:00 (AEST) commencing on 11/11/11 with the last draw to take place on 09/02/12. The first ten (10) valid entries randomly drawn on 11/11/11 will each win one (1) of the Daily Prizes randomly allocated for each day commencing on 1/11/11 and ending 10/11/11. The first valid entry drawn in each Daily Prize Draw commencing 12/11/11 and ending 09/02/12 will win the Daily Prize randomly allocated for that prize draw. Draws for Saturday and Sunday and any public holiday will take place on the following business day. Entries close for each Daily Prize Draw at 11:59.59 (AEST) the day prior to the draw. If a winner is invalid, that entry will be discarded and the prize will be awarded by drawing another entry in accordance with these Conditions of Entry. Non-winning entries in each Daily Prize Draw will be entered into any subsequent Daily Prize Draws. All valid entries received during the Promotion Period will be entered in the Major Prize Draw.
Daily Prizes: At the time of each draw, one (1) of the Daily Prize pool prizes as outlined in the table below will be randomly chosen and allocated to the Eligible Entrant randomly drawn for that day.

Major Prize Draw: The Major Prize Draw will take place at the 11:30am (AEST) at the same address as the Daily Prize Draws on 09/02/12. The first valid entry drawn in the Major Prize Draw from all entries received throughout the Promotion Period will win a Holden Cruz SRI ‘V’ Auto Sedan valued at $31,500 including registration, dealer delivery and stamp duty. All optional extras and accessories (including metallic paint), comprehensive insurance and any other insurance not stated, fuel, personal costs and all other ancillary or related costs are excluded. The winner must provide all information and sign all documentation necessary to enable the Promoter to register the vehicle in the name of the winner prior to collection. Receipt of a prize vehicle is subject to the winner being able to lawfully take possession of the prize vehicle and comply with all registration and compulsory third-party insurance requirements of the state/territory in the state/territory the winner elects to register the prize vehicle. Vehicles depicted in all promotional material are not necessarily the same colour as the prize vehicle. The colour of the prize vehicle will be able to be chosen by the winner from the list of available colours as advised by the Promoter at the time of selection. The prize vehicle will be available for collection from the Holden dealership nominated by the Promoter near the winner’s place of residence. Prize value is recommended retail price given at 13/10/11 and the Promoter takes no responsibility for any change in value. If a winning entry is invalid, that entry will be discarded and the prize will be awarded by drawing another entry in accordance with these Conditions of Entry.
A total of 100 prizes will be awarded up to a total prize pool value of $114,975 (including GST).


All winners will be notified in writing (mail or email) and any winner of a prize valued over $250 will have their name and locality published in The Australian newspaper on the one of the following publication dates: 09/12/2011, 06/01/2012, 03/02/2012, 14/02/2012. All reasonable steps to notify the winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
Prize Pool special conditions:

Theme Park Family Holiday: Prize includes return economy airfares for 2 adults and 2 children (under 11 years of age) to Brisbane or Coolangatta airport from the winner’s state of permanent residence, 5 nights accommodation at the SeaWorld Nara Resort and Water Park in a family room, breakfast daily at the Shoreline Restaurant, 4 Escape Passes with unlimited entry to SeaWorld, Movie World, Wet ‘n Wild on the Gold Coast for the duration of their stay (5 nights only), family pass to the Australian Outback Spectacular show (subject to availability) and complimentary admission to the Dolphin Discovery program. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure. The prize must be taken within 12 months from the draw date and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
 

12 month Family Movie Pass: Prize will be awarded as one (1) allocation of twelve (12) movie tickets to be used over a 12-month period. Valid at Village Cinemas, Event Cinemas, Greater Union, Birch Carroll & Coyle Cinemas & selected independent cinemas.


Best Restaurants Card: Prize will be awarded as a gift card that must be activated online at www.bestrestaurantscard.com.au within 3 months of receiving the gift card. Participating restaurants can be located at www.bestrestaurantscard.com.au. The Restaurant Card has a 12-month expiration period that commences upon date of issue.
 

Gold Class Night: Prize will be awarded as Gold Class Double Movie Voucher with a $25 Food and Beverage Voucher valid at Village, Greater Union, Birch Carroll & Coyle and Event Cinemas chains. Tickets will be valid for 6 months from date of issue.

Cash Cards: Prize will be awarded as an EFTPOS card and can be used for purchases anywhere in Australia where EFTPOS is accepted. The cash cards can be activated online at www.activatemycard.com.au within 3 months of receiving the card. The gift card will expire 12 months from the date of activation.

If the prizes or any element of the prizes become unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable Australian State and Territory legislation.
In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative prize (including an alternative Event date as specified by the Promoter) to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
The Promoter accepts no responsibility for any variation in prize value. The prize is non-transferable, non-refundable and non-redeemable for other goods or services. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
Entrants can only enter in their own name. The Promoter reserves the right to request an entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

The Promoter may conduct an unclaimed prize draw as is necessary at the same time and place as the original draw on 09/05/2012 in order to distribute any prize unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing (mail or email) and if a Major Prize winner, their name and locality will be published in The Australian on 14/05/2012.
The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer, mobile phone device or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.
The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the promotion. By participating in the promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way.
