Terms and Conditions Couples Escape to Hayman Island Promotion – Conditions of Entry

1.Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the Couples Escape to Hayman Island Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.

2.The Promotion commences 14 November 2011 at 2.00pm AEST and closes 8 January 2012 at 11.59pm AEST (Promotion Period).

3.Entry is only open to Australian residents who are members of Kleenex Mums. If you are not a member of Kleenex Mums you can join online at www.kleenexmums.com.au. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.

Entry
4.To enter (Entry) the entrant must during the Promotion Period:
(1)log onto www.kleenexmums.com.au/promotions (Kleenex Mums Website);
(2)click on the competition link on the Kleenex Mums Website to enter the Promotion;
(3)complete all the information requested for Entry into the Promotion including personal contact information being:
a)name;
b)email;
c)phone number;
d)postcode; and
e)closest airport;
(4)opt-in to receive electronic messages from travel.com.au by ticking the box on the Promotion page; and
(5)follow the link in the email sent by the Promoter to confirm Entry into the Promotion prior to the end of the Promotion Period.

5.Entries are deemed to be received by the Promoter at the time the entrant confirms the Entry by following the link in the email sent by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

6.A maximum of one (1) Entry may be submitted per household per week during the Promotion Period.

7.The Promoter and its associated agencies or companies accepts no responsibility for any lost, late, stolen, damaged or misdirected Entry(ies).

8.The Promoter has no control over internet or mobile telephone communications, networks or lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.

9.The Promoter reserves the right to validate and check the authenticity of Entry(ies).

10.Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will void all the entrant’s Entries.

11.The entrant MUST, within seven (7) days of being asked, provide to the Promoter documents requested by the Promoter to establish eligibility to enter, including evidence of residence or identity. If the entrant does not do so, the Promoter may, in its absolute discretion, declare any or all of the entrant’s entries invalid

Draws
12.All valid Entries received during the Promotion Period will be placed into the draw to be drawn via electronic draw tool at 10.00am at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 9 January 2012.

13.The first valid entry drawn electronically at random will win the Prize (Prize Winner).

14.The Prize Winner will be notified in writing by e-mail on 11 January 2012. The name of the Prize Winner will be published on the Kleenex Mums Website on 9 January 2012 and published in The Australian on 16 January 2012.

15.The Promoter may conduct such further draws as are necessary for an unclaimed prize at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 13 April 2012 at 10.00am AEST, subject however to any directions given by any applicable gaming authorities. The winner of any unclaimed prize will be notified in writing by e-mail within two (2) days of the relevant draw and details of the winner of any unclaimed prize will be published on the Kleenex Mums Website by 16 April 2012 and in The Australian on 20 April 2012.

Prizes
16.The Prize consists of:
(1)1 return economy flight for 2 adults from the Prize Winner’s nearest capital city airport (either Sydney, Brisbane, Melbourne, Adelaide or Perth) (Departure Airport) to Great Barrier Reef Airport;
(2)1 transfer for 2 adults from Great Barrier Reef Airport by luxury launch to Hayman Resort (Accommodation);
(3)3 nights twin share accommodation for 2 adults in a Pool Room at the Accommodation;
(4)Buffet breakfast for 2 adults for three (3) days at the Accommodation;
(5)2 × 60 minute treatments (either Body Massage or Power Facial); and
(6)1 transfer for 2 adults from the Accommodation by luxury launch to Great Barrier Reef Airport.
17.The Prize does not (except as expressly stated) include:
(1)any airport departure taxes;
(2)any transport between the traveller’s residence and the Departure Airport;
(3)any overnight accommodation or other expenses prior to departure from or after return to the Departure Airport;
(4)any other transport or accommodation;
(5)any incidental Accommodation charges (such as telephone calls, food, beverages and internet usage);
(6)any additional spending money;
(7)excess baggage charges;
(8)any insurance (including travel or health insurance);
(9)any vaccinations or other medical or health related services; and
(10)any other ancillary costs which may be incurred by the Prize Winner or the Prize Winner’s Guest in relation to the Prize.

18.The Prize must be taken and completed prior to 31 October 2012. Reservations must be made a minimum of four (4) weeks prior to departure. All components of the Prize will be arranged by travel.com.au who will liaise directly with the Prize Winner to organise the Prize.

19.The Prize Winner’s nominated dates must be provided to travel.com.au, who will make all bookings and issue tickets and vouchers. The Prize Winner and the Prize Winner’s Guest must travel on the same flight and stay in the same room at the Accommodation.

20.Once the Prize has been arranged by travel.com.au, any changes to the travel, flights, accommodation or scheduling arrangements are at the expense of the Prize Winner.

21.The following specific conditions pertain to the flight component of the Prize:
(1)Limited seats are available and may not be available on every day/flight throughout the travel period;
(2)Any frequent flyer/rewards programs are not applicable;
(3)The conditions of carriage as recited on the flight ticket applies. Requests for upgrades will not be entertained;
(4)Once tickets have been issued, no changes, cancellations, or modifications are permitted; and
(5)The Prize Winner and the Prize Winner’s Guest must travel together throughout the entire journey.

22.The Prize (and each part of the Prize) is subject to booking and availability at the time of booking and cannot be taken during peak season travel dates (6-9 April 2012). Blackout dates may also apply. Should any component of the Prize be unavailable on the dates nominated by the Prize Winner, travel.com.au will consult with the Prize Winner to determine alternative dates on which the Prize will be booked The Promoter accepts no responsibility for the cancellation or rescheduling of flights. The Promoter reserves the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.

23.The total Prize pool is up to a maximum of $4,800. The value of the Prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.

24.To take the Prize, the Prize Winner and the Prize Winner’s Guest must, if requested by the Promoter, agree to and sign:
(1)an eligibility form confirming their compliance with these Conditions of Entry, eligibility to accept the Prize and participate in the Prize; and
(2)a liability release and/or indemnity in favour of the Promoter and/or any entity associated with this Promotion in a form to be determined in the absolute discretion of the Promoter.

25.If the Prize Winner or the Prize Winner’s Guest do not comply with the conditions referred to in paragraphs 24(1) and 24(2) above the Prize Winner will forfeit the Prize.

26.The Promoter may require the Prize Winner’s Guest to confirm in writing that he or she agrees to comply with these Conditions of Entry. If a Prize Winner’s Guest does not agree to comply with any of these Conditions of Entry, the Prize Winner will forfeit his or her Prize.

27.The Prize includes vouchers redeemable through travel.com.au. The Promoter excludes any liability for any voucher or ticket that has been lost, stolen, damaged or tampered with in any way. Redemption of each voucher is subject to the terms and conditions imposed by travel.com.au from time to time.

28.If for any reason the Prize Winner and the Prize Winner’s Guest are unable to travel on their nominated dates, then the Prize will be forfeited by the Prize Winner.

29.All components of the Prize must be taken together as a single trip to be booked by travel.com.au. Any part of the Prize that is not taken for any reason is forfeited.

30.If the Promoter determines, in its absolute discretion, that the Prize Winner is not in the necessary condition to safely participate in the Prize, the Promoter reserves the right to refuse to award to the Prize Winner any part of the Prize.

31.It is the Prize Winner’s and the Prize Winner’s Guest’s personal responsibility to ensure that they have valid documentation for air travel. Any fines, penalties, payment or expenditure incurred as a result of such documents not meeting the requirement of these authorities will be the sole responsibility of the Prize Winner and the Prize Winner’s Guest.

32.The Prize is non-transferable, non-refundable. non-exchangeable, non-replaceable and non-redeemable for cash. The Prize must be taken as offered and cannot be varied.

33.Neither the Promoter or travel.com.au accepts any liability or responsibility for any loss or damage whatsoever that is suffered or incurred by the Prize Winner or the Prize Winners Guest (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any component of the Prize or for any component of the Prize being unavailable for any reason, except for any liability which can not be excluded by law.

General
34.All tax liability arising as a result of accepting the Prize is the responsibility of the Prize Winner.
35.If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.

36.If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion, subject to approval of the gaming authorities in each State and Territory where relevant.

37.The Prize Winner and the Prize Winner’s Guest agree to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the Prize Winner’s and the Prize Winner’s Guest’s names, voices, images and likenesses for advertising and publicity purposes in any media in perpetuity without additional compensation.

38.All entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using his or her personal information for future marketing purposes, unless otherwise advised by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.

39.By entering this Promotion, the entrant will be automatically subscribed to the travel.com.au database and will receive electronic messages from travel.com.au. An entrant may opt-out of receiving any future communications from travel.com.au upon request to travel.com.au.
