Promotions are not open to:
(a)  employees of, or contractors to, the Promoter or any of its agencies involved with the Promotion; 
(b)  the spouse, de facto spouse, parent, natural or adopted child, or sibling (whether natural or adopted by a parent) of such employees and contractors (whether or not they live in the same household);
(c)  any person who is discovered to have used or attempted to use any more than one name in order to qualify to win any Promotion run by the Promoter except in the case of a legal change of name;
(d)  any person where that person or anyone from the same family or household has won a prize or prizes from the Promoter or any radio station that is a member of the Australian Radio Network, valued either individually or collectively at more than $500 in the 30 days prior to the commencement of the Promotion
(e)  All prizes are accepted entirely at the risk of the contestants and ARN excludes all warranties in connection with any prize (including  representations as to merchantability and fitness for purposes) to the extent permitted by law. 
(f)  Any special conditions associated with the cash or  prizes on offer will be announced during the recording of the Segments.  The conditions must be adhered to in order to claim the cash or prize.
(g)  ARN, its employees, agencies, affiliates, sponsors  and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage (whether foreseeable or not) arising out of or in connection with this Competition, whether caused by the negligence of any of the aforementioned or not. 3

2.  Mix101.1 its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this promotion or accepting or using the prize/s, except for any liability which cannot be excluded bylaw (in which case that liability is limited to the minimum allowable by law).

4.  If due to a technical difficulty with a telephone line, ISDN line, mobile telephone or other technicalinstrument critical to the broadcast prevents the competition from proceeding; the decision of ARN is absolute and final. No discussion will be entered in to. 

5.  ARN’S DECISION IS FINAL

6.  ARN’s decision in respect of the selection of participants is binding and conclusive and can not be challenged on the grounds that ARN failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness. ARN’s decision will remain binding and conclusive notwithstanding that it can be demonstrated that ARN made a decision that was wrong, based on a factual error or an irrelevant or irrational consideration. It is not ARN’s policy to enter into negotiations with listeners or that may challenge a decision made by ARN.
