DEFINITIONS

'AEST': Australian Eastern Standard Time.

'AEDST': Australian Eastern Daylight Savings Time.

'Promotional Period': This promotion commences on 28/11/2011 and ends 23:58 AEDST on 10/12/2011.

'Eligible Entrant': An Eligible Entrant is an Australian resident aged 18 years or over who enters their contact details into the form through the Promoter's Facebook Application and completes the process as outlined in 1.0 during the Promotional Period.

'Promoter': The Promoter is Lumo Energy Australia Pty Ltd (Lumo Energy) ABN 69 100 528 327 of Level 3, 565 Bourke Street, Melbourne, VIC 3000.

'Facebook' – Facebook is a social networking service website found at www.facebook.com .

'Facebook application' – Facebook application is the platform created by the promoter which provides a framework to interact with the core features of Facebook.
1.0 HOW TO ENTER
1.1 The Eligible Entrant must, within the Promotional Period, meet the below criteria to go in the draw to win the prize.
(i) 'LIKE' the Promoter's page on Facebook and enter their contact details via the Facebook Competition Application.
1.2 Only one entry per person is permitted unless
(i) the Eligible Entrant has referred other friends to the promotion via the Facebook Application and/or shared the promotion link on Facebook and/or Twitter. The Eligible Entrant will be given additional entries up to the number of entries received from the above mentioned referral methods.
2.0 CONDITIONS OF ENTRY
2.1 Information on definitions, how to enter and the prizes form part of these Terms & Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions.
2.2 Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
2.3 The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant's identity, age, place of residence and/or place of employment) and to disqualify any Eligible Entrant who has tampered with the entry process, or who submits an entry that does not comply with these Terms & Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
2.4 Incomplete or illegible entries will be deemed invalid.
2.5 If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
2.6 This competition is a game of chance.
2.7 The winning entries will be randomly drawn daily, via computer generation from November 28 to December 10, 2011 at Level 1, Building 1, 85 O'Riordan Street, Alexandria, NSW 2015 at 11.59pm AEST. The winners will be notified via email and a phone call, and their name and Facebook profile picture will be published on the Lumo Energy Facebook page. The names and postcodes of prize winners in excess of $250 will be published in The Australian on December 15, 2011.
2.8 There will be 13 draws and 13 prize-winners.
2.9 The minor prizes will be drawn daily from November 28 to December 9, 2011 and the first eligible entry drawn electronically will receive any or one of the below listed electronic Gift Vouchers:
i. Day 1 draw: $500 from Virgin Australia ii. Day 2 draw: $100 from Country Road iii. Day 3 draw: $250 from Appliances Online iv. Day 4 draw: $50 from Dymocks v. Day 5 draw: $250 from Red Balloon vi. 2.10 The grand prize will be drawn on December 10, 2011 at 11.59pm AEST and the first eligible entry drawn electronically will receive $5,000 on a Visa prepaid card.
2.11 Any costs in excess of the value of the prize (including GST) and all ancillary costs associated with redeeming the prize are the responsibility of the winner.
2.12 Prizes are not exchangeable or redeemable for cash. All vouchers will need to be used within the validity period.
2.13 Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
2.14 If a prize (or part of a prize) is not available, the Promoter reserves the right to substitute the prize (or part of a prize) with a prize to the equal value, subject to any written directions from a regulatory authority.
2.15 If any prize remains unclaimed by 3.00pm AEDST on 12/03/2012, an unclaimed prize draw will take place at this time and date, at the same place as the original draws. The first valid entry drawn and successfully contacted by phone and email will win the relevant unclaimed prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, the Promoter will contact the next drawn winner until a prize winner for the relevant unclaimed prize is determined. The name(s) and Facebook profile picture(s) of any unclaimed prize winner(s) will be published on the Lumo Energy Facebook page. The names and postcodes of prize winners in excess of $250 will be published in The Australian on March 19, 2011.
2.16 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
2.17 Nothing in these Terms & Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
2.18 The Promoter, its related companies, employees and associated agencies and contractors is not responsible for and shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or loss of opportunity), expense, damage, any personal injury or death suffered or sustained as a result of or in connection with: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; (f) this promotion; or (g) the taking of any prize, except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, in which case that liability is limited to the maximum extent allowed by law.
2.19 We will take reasonable steps to preserve the security of your personal or sensitive information and other information or data collected by us. Unfortunately, no data transmission over the Internet can be guaranteed as perfectly secure. As a result, although we strive to protect your personal and sensitive information, we cannot guarantee the security of any information transmitted to us. Information is transmitted at your own risk.
2.20 Prize winners must, at the Promoter's reasonable request, participate in any promotional activity (such as participation on publicity events and photography) related to the winning of a prize free of charge for an unlimited period and consent to the Promoter using their name and image in promotional material for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
2.21 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
