Experience Competition Terms & Conditions
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions.
Participation in this competition is deemed acceptance of these Terms and
Conditions.
Who is eligible to enter
2. Entry is only open to Australian residents aged 18 years or over. Employees (and
their immediate families) of the Promoter and agencies associated with this
competition are ineligible to enter. Entrants may enter this competition once
only. Multiple entries will result in the entrant being disqualified. This
competition is not open to trade (commercial) or wholesale customers.
3. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and to
disqualify any entrant who submits an entry that is not in accordance with these
Terms and Conditions or who tampers with the entry process. Errors and
omissions may be accepted at the Promoter's discretion. Identification
considered suitable for verification is at the Promoter’s discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights. Incomplete or indecipherable entries will be deemed invalid.
How to enter
Complete the online entry form in full. Entrants must tell the Promoter in 25
words or less, ‘Why would you like to win the ultimate VIP experience at the
Good Food & Wine show in your state?’
Entrants must have read these Terms and Conditions and having done so, tick
‘Yes' to having read the Terms and Conditions on the website as a condition of
entry.
Competition period
Competition commences midnight AEST on 01/12/2011 and closes midnight
AEST on 01/05/2012. Entries will be judged on Monday 8th May 2012 at 11:00AM
at Fisher & Paykel Australia Pty Ltd (16 Parramatta Rd, Lidcombe NSW 2141).
All entries will be judged on creativity. This is a game of skill and chance plays no
part in determining the winners. Winners will be notified by phone and email/post
by 5:00PM AEST Thursday 10th May, 2012. The Promoter will make reasonable
attempts to contact the winner but if they are unable to be contacted within 7
days, the prize will be forfeited and a new winner will be selected.
Prize
4. There will be one (1) winner. The most creative answer, as determined by the
Promoter in the Promoter’s sole discretion, submitted to the 25 words or less
question will win: i) One night twin share accommodation for two (2) people at a
hotel within reasonable proximity to the Good Food & Wine Show venue in
winner’s state as determined by the Promoter, ii) Entry for two (2) into the Good
Food & Wine Show, iii) Exclusive access to the Fisher & Paykel VIP room at the
Good Food and Wine Show, iv) a Meet & Greet session with the chef of your
choice (restricted to chefs that are appearing at the winner’s state show), v) Two
personally signed cookbooks. All costs associated with the prize, including
additional meals ,travel or additional charges incurred at the accommodation are
the responsibility of the winner.
Prize terms
The selection of the winner will be determined by the Promoter based on the
creativity of the entrant’s 25 words or less answer to the question “Why would
you like to win the ultimate VIP experience at the Good Food & Wine show in
your state?” The selection of the winner is at the absolute discretion of the
Promoter and no correspondence will be entered into.
5. The prize is not transferable or exchangeable and cannot be taken as cash. The
Promoter accepts no responsibility for a variation in prize value. If any prize is
unavailable, the Promoter, in its discretion, reserves the right to substitute the
prize with a prize to the equal value and/or specification, subject to any written
directions from a regulatory authority.
Variations
6. The Promoter reserves the right to vary these Terms and Conditions or any of
the terms of entry applying to this competition or to modify, terminate, suspend or
reschedule this competition without notice but subject to State and Territory
legislation.
Exclusions and liability
7. If this competition is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, the Promoter reserves the right, in its sole discretion, to
the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to
any written directions from a regulatory authority, to modify, suspend, terminate
or cancel the competition, as appropriate.
8. Any cost associated with accessing the promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used. The use of
any automated entry software or any other mechanical or electronic means that
allows an entrant to automatically enter repeatedly is prohibited and will render
all entries submitted by that entrant invalid. If for any reason, any aspect of this
competition is not capable of running as planned, including by reason of infection
by computer virus, mobile network failure, bugs, tampering, unauthorized
intervention, fraud, technical failure or any cause beyond the control of the
Promoter which corrupts or affects the administration, security, fairness, integrity
or proper conduct of this competition, the Promoter may in its sole discretion
cancel, terminate, modify or suspend the competition, or invalidate any affected
entries. Each entrant assigns all rights in the entry to the Promoter and consents
to the Promoter using the entry in any manner the Promoter wishes.
9. This competition is in no way sponsored, endorsed or administered by, or
associated with Facebook. Entrants understand that they are providing their
information to the Promoter and/or agencies acting on its behalf and not to
Facebook.
10. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights. The competition is not valid in conjunction
with any other offer, unless otherwise advised. The Promoter accepts no
responsibility for lost, delayed, misdirected or illegible entries. Except for any
liability that cannot be excluded by law, the Promoter (including its officers,
employees and agents) and Facebook excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way
out of the competition, including, but not limited to, where arising out of the
following: (a) any technical difficulties or equipment malfunction (whether or not
under the Promoter’s control); (b) any theft, unauthorised access or third party
interference; (c) any entry or prize claim that is late, lost, altered, damaged or
misdirected (whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter; (d) any variation in prize value to
that stated in these Terms and Conditions; (e) any tax liability incurred by a
winner or entrant; or (f) use of a prize.
Intellectual property
11. The Promoter (or its associated or affiliated companies or third parties who have
licensed its brands to the Promoter or contributed to the application) (Content
Owner) own or license from third parties all application content. All application
content remains the sole property of the applicable Content Owner and is
protected under all relevant copyright, trade mark and other applicable laws.
Nothing on the application should be construed as granting any license or rights
to use or distribute any application content, without the Promoters express
written agreement or of the other applicable Content Owner.
Use of personal information
12. The Promoter collects personal information in order to conduct the competition
and may, for this purpose, disclose such information to third parties, including but
not limited to agents, contractors, service providers, prize suppliers and, as
required, to Australian regulatory authorities. Entry is conditional on providing this
information. The Promoter may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or telephoning the
entrant. Entrants should direct any request to access, update or correct
information to the Promoter. All entries become the property of the Promoter.
The Winner agrees to be available for reasonable publicity purposes without
compensation including, but not limited to, photographs and interviews and
agrees that their name and town or city may be published by the Promoter
including on national television, in newspapers, magazines and online.
Jurisdiction
13. These terms and conditions shall be governed by and construed in accordance
with the laws of New South Wales.
