Terms and Conditions of Entry for 'Dunlop sidewall' competition ("Promotion")

1.Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
2.The promoter is V8 Supercars Australia Pty Limited (ACN 077 053 484) of 34 Nerang Street, Nerang QLD 4211 ("Promoter").
3.The Promotion will be open from 9:30am Australian Eastern Time ("AEST – Qld Time ") on Wednesday 30th November and will continue until 5.00pm AEST- Qld Time on Monday 5th December ("Promotion Period").
4.Entry is open to people who:
1.Have visited the V8 Supercars webpage and 'liked' the V8 Supercars facebook page during the promotional period.
other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including suppliers of prizes), and their immediate families ("Eligible Entrants").
5.To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:
1.Go to the V8 Supercar website HYPERLINK "http://www.v8supercars.com.au" www.v8supercars.com.au ('website');
2.Click on the 'Dunlop web banner' and input the their details to complete the form. Including the answer to the below question.
3.Answer the question 'What is your best 2011 V8 Supercars memory?' ("Eligible Entry").
4.Like the V8 Supercars facebook page.
6.An Eligible Entrant may only enter the Promotion once only during the Promotion Period.
7.The winner will be determined by a team of V8 Supercars judges on the most creative answer to the question 'What is your best 2011 V8 Supercars memory?'.
8.Notwithstanding clause 8, redemption of any prize is subject to the Promoter's absolute discretion, directions, terms and conditions.
9.The Promotion involves a game of skill only and chance plays no part in determining the winner. Each Eligible Entry will be individually judged based on the creative merit of the Eligible Entry (in the Promoter's absolute discretion).
10.The total prize pool value is up to $500(GST incl). The prize pool consists of one framed sidewall plus cap from Garth Tanders Bathurst winning Holden.
11.Prizes are not transferable or exchangeable and are not redeemable for cash. All costs not included as prizes which are associated with redemption of the prize are the responsibility of the winner.
12.If the Promoter is unable to provide a winner with the nominated prize (or part thereof), the Promoter reserves the right, in its absolute discretion, to supply an alternative prize of similar monetary value. The Promoter accepts no other liability or responsibility for any loss incurred by the winner or any other party if the prize (or part thereof) is unavailable for any reason.
13.The judges' decision is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which infringe third party intellectual property rights, are not eligible to win.
14.The Promoter is not responsible for technical difficulties with the Website entry application or the Website and does not warrant that the Website will be available at all times during the Promotion Period. The Promoter is not responsible for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries.
15.The prize winner will be notified via an email on December 7th 2011.
16.Any prizes which have not been claimed by 5pm AEST on 9th December 2011 will be distributed at the Promoter's absolute discretion.
17.If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
18.Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
19.The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry and the Promoter's decision in relation to any aspect of the Promotion is final and binding on each person who enters. No correspondence will be entered into.
20.Eligible Entrants consent to the Promoter using their name, likeness, image and photograph (including film) (the "Materials") in any media for an unlimited period for the Promoter's promotional and marketing purposes and without further reference or compensation to the Eligible Entrant.
21.By entering the Promotion, the Eligible Entrant understands and agrees that the Promoter may collect, use and disclose the information provided by the Eligible Entrant on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at http://www.v8supercars.com.au/PrivacyPolicy/tabid/633/Default.aspx or by calling (07) 5630 0364. The Eligible Entrant agrees that the Promoter can continue to contact them after the conclusion of this Promotion. If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about the Eligible Entrant, or if the Eligible Entrant does not wish that information to be disclosed, the Eligible Entrant should advise the Promoter by phoning (07) 5630 0364.
22.Eligible Entrants acknowledge and agree that:
1.The Promoter may use, reproduce, alter, edit and communicate to the public the Materials as the Promoter wishes at any time, anywhere and by ane means and the Promoter may licence, authorise or otherwise transfer the rights in the Materials to others to do the same;
2.The Eligible Entrant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the Eligible Entrant's moral rights in the Materials and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights"); and
3.The Eligible Entrant agrees not to institute, maintain or support any claim or proceedings for infringement of the Eligible Entrant's Moral Rights in the Materials.
23.Eligible Entrants acknowledge that motorsport is a dangerous activity and that accidents can and do happen and may happen to the winner of the prize. Eligible Entrants accept the risk arising from the hot lap.
24.To the maximum extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury or death suffered or sustained in connection with this Promotion or accepting or using a prize. The Promoter accepts no responsibility for any variation in the value of the prizes offered in the Promotion.
25.The Promoter accepts no responsibility for any tax liabilities that may arise from an Eligible Entrant winning a prize in the Promotion.
