Simply download the TargART Pasadena design brief below from 2 December 2011, read through the Terms and Conditions and upload your artwork until midday 06 January 2012 to win. Targart Pasadena COMPETITION HOW TO ENTER To be eligible to enter the "Targart" competition (the "Competition"), individuals must download the artist brief from Target’s facebook page www.facebook.com/targetaus. In order to enter the Competition individuals must then submit their entry TargArt design through Target’s Facebook page www.facebook.com.au/targetaus (the "Website"), by following the prompts on the competition page, and enter an original themed wall design (the "Design"), answer any necessary competition questions, input the requested details including personal details, and submit the fully completed entry form by 12pm , 06/01/12, AEDST TERMS AND CONDITIONS Acceptance by you TargArt (“the Competition”) is provided by Target Australia Pty Ltd ABN 75 004 250 944 of 12-14 Thompson Road, North Geelong, Vic 3215 (‘the Promoter”). These terms and conditions (including without limitation the information on how to enter and prize details which we publish in relation to the competition) apply to the competition. By entering the competition, you acknowledge that you have read and understood, and agree to be bound by these terms and conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT ENTER THE COMPETITION. 1. These Terms and Conditions together with all other information provided prior to entering the Competition form part of the rules of entering the Competition. Instructions on how to enter the Competition form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer. 2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Entries shall be restricted to one entry per eligible individual. Multiple entries are not permitted only. Incomplete or indecipherable entries will be deemed invalid. 5. Competition commences on 12pm, 02/12/11 AEDST and closes 12pm 06/01/12, AEDST on (the "Competition Period"). Artists are able to download the ‘Artist brief’ from 12:00pm on 02/12/11, and are able to begin uploading designs to www.facebook.com/targetaus from 12:00pm on 02/12/11. 6. At the conclusion of the Competition Period the winner will be selected and notified by 10/01/12 by email. The awarding of the final winner shall be determined by Promoter at their discretion and announced at 12:00pm on 10/01/12.The Promoter’s decision is final and binding upon all entrants and no correspondence will be entered into. The prize winner must be (eighteen) 18 years of age or older as at 02/12/11, 12:01am. The Winner shall be entitled to receive the following: There is one prize to be won of AUD$5000 (five thousand dollars) The Winner’s Design shall, subject to final creative and technical adaptations, be released for a number of purposes relating to the Promoter’s Urban retail outlet including in store presentation, promotion and marketing collateral (collectively the "Prize"). 7. No substitutions or exchanges of the Prize will be permitted. The Prize is valued at A$5,000 (five thousand Australian dollars). Prizes not claimed by the Winner within fourteen (14) days of notification will be forfeited and not awarded to an alternate winner. Prizes are not transferable or redeemable for cash. The Promoter takes no responsibility for any variation in the prize value between the date of publication and the date the prize is taken. 8. Total gift pool value is A$5000.00 (five thousand Australian dollars). 9. The Prize including replication of the design, subject to final creative and technical adaptations as directed by the Promoter, the prize money and the internship are at the discretion of the Promoter who reserves the right to substitute the Prize with a gift to the equal value and/or specification, subject to any written directions from a regulatory authority. 10. The prizes will be issued as a cheque or via electronic funds transfer which will be organized with the winner at time of prize collection. 11. The Prize is not transferable and must be accepted as offered. 12. Prize winners will be notified by phone, mail, and published online at www.facebook.com/targetauswww.target.com.au 13. All entries are deemed to be received at the time of receipt into the competition’s database and NOT at the time of transmission by the entrant. Disclaimers 14. We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 15. We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. 16. We accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters. 17. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments). 18. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition. 19. All rights in and to the Images or part thereof utilised or incorporated by an entrant as part of their Design are owned by or under licence to the Promoter or their Related Bodies Corporate (as defined under the Corporations Act 2001 (Cth). 20. The entrant hereby assigns all rights in their Design to Promoter or a Related Body Corporate throughout the world for the full life of copyright and any and all extensions and renewals thereof. For the avoidance of doubt this includes the right to edit or adapt the Design for the purposes of commercial exploitation. The entrant irrevocably and unconditionally consents to all or any acts or omissions by Promoter, and persons authorised by the Promoter, in relation to the Design and any product incorporating the Design which might otherwise infringe any of the entrants moral rights in such recordings or performances, as described in Part IX of the Copyright Act 1968, or any analogous rights that exist or may come to exist anywhere in the world. If requested by Promoter, the entrant shall complete and sign a formal assignment of copyright to give effect to the foregoing. 21. Promoter will be registered and credited as the sole owners of the Design created by the entrant and shall be entitled to exploit the Design at its sole discretion. By entering a Design as part of this Competition the entrant agrees that no consideration shall be payable in the event the Promoter exploits the Design.22. The entrant will not acquire a copyright interest in the assets available and supplied within the artist brief by virtue of creating their Design incorporating the Images. 23. The entrant warrants that the Design does not incorporate any materials which are subject to third party proprietary rights or otherwise infringe the rights of any third party. 24. The entrant confirms that the Design and their entry is an original creation wholly owned by the entrant and is not obscene, defamatory, libellous, threatening, harassing, hateful, racially or ethnically offensive, or encouraging of conduct that would be considered a criminal offence, gives rise to civil liability, or violate any law. 25. The entrant will not exploit, or allow others to exploit, the Design created by the entrant without seeking the prior approval of the Promoter. 26. The entrant confirms and warrants that they have full power and authority to enter into this agreement and hereby indemnify Promoter from and against any and all costs and damages incurred as a result of any breach of the representations and warranties made by the entrant herein. 27. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate. 28. Any cost associated with accessing the Website is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition or the Prize, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of a Prize, including use resulting in any personal injury. 30. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised and in accordance with any relevant laws or regulations, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
