Aurora Short Film Festival 2012 CALLING ALL CREATIVES! The 2012 Aurora Short Film Festival is now open for business. This year’s theme is ‘Make Something’. And as long as it's under 10 minutes, we don't mind what it is. It could be an animation, drama, documentary, music video, anything. The point is to just ‘Make Something’. So if you’re after cash prizes, industry recognition, or you’re just in it for the love of the craft, then get those creative caps on and enter the 2012 Aurora Short Film Festival. What about the prizes? Critics Choice - $1000 (panel of industry experts) Viewers Choice - $1000 (online voting) Entry Details: Call For Entries: Dec 1st 2011 - April 30th 2012. Finalists - Top 10 Announced: May 4th 2012. Voting: May 4th 2012 - May 31st 2012. Winners announced 3rd June 2012. ENTER HERE (http://www.aurora.tv/UserFiles/Image/ASFFLOGO%20FINAL2.png) Terms and Conditions of Entry The Competition Aurora Community Channel (Aurora) as the competition organiser and promoter is inviting aspiring filmmakers to submit a piece of digital content (Entry) to Aurora’s competition, the 2012 Aurora Short Film Festival “Make Something 2012” (ASFF). The ASFF aims to uncover fresh Australian talent and showcase tomorrow’s film and TV sensations. By completing an ASFF Entry Form and uploading your Entry, you (Entrant) apply to enter the ASFF. You agree that the terms of the Entry Form, the Terms and Conditions of Entry (Summary) and these Terms and Conditions of Entry (Terms and Conditions of Entry) create a legally binding agreement between you and Aurora. Where several persons are specified as the Entrant on the Entry Form, each person specified agrees to remain jointly and severally liable for all obligations under the Terms and Conditions of Entry. Key dates Entries may be received by Aurora during the period starting on 1 December 2012 at 9.00 am Australian (Eastern Daylight Savings Time) and ending on 30 April 2012 at 5.00 pm (Australian Eastern Standard Time) (Competition Period). Voting by the public for the Viewers’ Choice Award opens on 4 May 2012 and ends on 31 May 2012. Winners will be contacted by Aurora by phone and email. Winners will be publicly announced on 3 June 2012 on the Aurora website and on-air. Are you eligible to enter? You do not need any filmmaking experience to enter the ASFF. If you want to enter the ASFF, you must be at least 15 years of age and an Australian citizen or resident. If you are under 18 years old, you must have a parent’s or legal guardian’s permission to enter. Your parents or guardian must also agree to ensure that you comply with the Terms and Conditions of Entry. Employees, directors, management, licensees and contractors of Aurora, its related companies and agencies associated with the promotion, the immediate families of the above persons and the retailers of and suppliers to Aurora are ineligible to enter the ASFF. How to enter Entrants must submit Entries in the following manner:- a. DVD format (file format .avi, .mpeg, .mov etc) delivered to the Aurora office at 54 Alexander Street, Crows Nest, NSW 2065; or PO Box 408 Crows Nest NSW 2065. We cannot accept authored DVDs. b. uploaded to the Entrant’s own YouTube channel, and the link provided to ASFF. 2 There is no entry fee. To be eligible for the ASFF, your Entry must comply with all of these requirements: • the Entry should be no longer than 10 minutes in length, including titles and credits; • any dialogue in the Entry must be in English, or have English subtitles; • the Entry must be in either a DVD format (file format .avi, mpeg2, .mov etc) or uploaded onto YouTube; and • If an Entry was to be classified, it would be classified no higher than M rating under the television codes of practice for subscription television available at http://astra.org.au/pages/codes-of-practice under the classification guidelines. If you are a Finalist, you may be asked to send Aurora a broadcast quality version of your Entry. If an Entry becomes a Finalist then that Finalist must submit still images for use in preevent promotions, media promotion etc. Aurora may ask for other additional materials for this purpose which you agree to provide. However, if you do not by the date specified by Aurora, you may be deemed ineligible and replaced as a Finalist or winner. Aurora will take the person whose name appears on the entry form as the Entry’s producer. If more than one person has participated in producing the Entry, multiple people may be named as the producers of the Entry on the Entry Form. If such an Entry wins an Award, the specified persons will be named as a winner and share the prize equally. Your Entry must be received by ASFF no later than 5:00 pm Australian Eastern Standard time on the last day of the Competition Period, 30 April 2012. How Entries are judged A panel of industry experts will select 10 finalists (Finalists) from the Entries and these will be announced on 4 May 2012 by Aurora. The panel of industry experts will choose the winner of the Critics’ Choice Award from the Finalists. The winner of the Viewers’ Choice Award will be the Finalist that receives the most valid votes as determined by Aurora in its absolute discretion. The panel of industry experts’ decision is final and no correspondence or discussion will be entered into the selection of the Finalists, the choice of the winner of the Critics’ Choice Award or any other aspect of the judging process. The winner of both Awards will be contacted by Aurora via email and telephone, and will be announced publicly online and on-air by Aurora. How eligible Entries are used If you enter an eligible Entry into the ASFF before the closing date (30 April 2012 at 5.00pm Australian eastern standard time), it may be uploaded to a dedicated website by Aurora and be available for viewing there by the general public. The public will be able to vote for their favourite Entries using an online voting system on the dedicated website. Viewers are limited to one vote per person per day. 3 How winning Entries are used Aurora may use the winning Entries for the purposes outlined in these Terms and Conditions of Entry including the paragraph headed “Aurora’s rights” or as otherwise specified in Terms and Conditions of Entry (Summary). Prizes for winning Entries Critics’ Choice Award The winner of the Critics’ Choice Award will receive a cash prize of $1,000. If the Entrant is multiple persons, this amount will be shared equally by those persons specified as the Entrant on that Entry’s Entry Form. Viewers’ Choice Award The winner of the Viewers’ Choice Award will receive a cash prize of $1,000. If the Entrant is multiple persons, this amount will be shared equally by those persons specified as the Entrant on that Entry’s Entry Form. Your representations about you and your Entry You (and if there are multiple persons as Entrant for the Entry, each of you jointly and severally) represent, warrant and agree that: • you are eligible to enter the ASFF; • all the details in the Entry Form are true and correct; • you own the copyright in your Entry, which is your original work; • you own all copyright material included in your Entry or that this material has been used with appropriate permission, and that your Entry does not otherwise infringe or violate the intellectual property or other rights or interests of any third party, including in relation to any music, lyrics and sound recordings included in the Entry; • your Entry does not include any nudity or profanities, and does not otherwise defame, misrepresent, contain disparaging remarks or other content that could adversely affect the name, reputation or goodwill of Aurora or anyone else; • your Entry does not contain pornographic or sexually explicit or hateful content that promotes violence or harm, or any other offensive, obscene or inappropriate content (Aurora determines what is inappropriate); • your Entry does not include threats and does not intimidate, harass or bully anyone; • all performers in your Entry have given their written consent to the use of their performances in the Entry; • you have obtained written consents from all contributors of copyright material to your Entry to their material being edited, altered and reproduced by you and anyone you permit to do this (including Aurora), to the extent permitted by applicable law; • your Entry does not contravene any applicable law; and • your Entry is not, and will not be, the subject of any third party agreement or arrangement that would prevent its use according to the Terms and Conditions of Entry or require Aurora or anyone else to pay any third party for this use. You unconditionally indemnify Aurora, and must pay Aurora on demand the amount of, all losses, liabilities, expenses and taxes that Aurora may suffer (including the cost of settlement and any legal expenses on a full indemnity basis) because any of your representations or warranties are incorrect, you breach the Terms and Conditions of Entry, or because of a claim or proceeding by another person against Aurora caused or contributed by you. 4 Aurora’s rights You remain the owner of the copyright in your Entry. You agree that a copy of your Entry may be kept by Aurora in perpetuity. You grant to Aurora a perpetual, royalty-free, irrevocable, worldwide, transferable, nonexclusive licence (with the right to sub-licence) to copy, reproduce, screen in public, communicate to the public, and otherwise exploit your Entry in all media, whether known now or developed in the future, for the purpose of the ASFF, or to advertise and promote Aurora and its products and services, or both, and to showcase your Entry. Without limiting this, you agree that Aurora may (and may allow others such as Aurora’s media partners to) do all or any of these things: • make your Entry available online; • copy all or parts of your Entry; • include your Entry in a compilation; and • use your Entry for advertising and promoting the ASFF or Aurora or both. To the extent permitted by applicable law, you unconditionally and irrevocably: (a) consent, and will obtain all other necessary unconditional and irrevocable written consents, to additions to, deletions from and other alterations or modifications of, your Entry that would otherwise infringe any moral rights in the Entry, or copyright material included in the Entry, whether before or after a consent is given; and (b) waive, and will obtain all other necessary unconditional and irrevocable written waivers of all moral rights in your Entry, and all copyright material included in your Entry, for the benefit of Aurora, and any person claiming an interest in your Entry through Aurora. Right to use names and likenesses If you submit an Entry, you grant Aurora the right to use (and to license others to use) your name and likeness to promote and advertise all or any of the ASFF, your Entry or Aurora. You represent and warrant that you have also obtained permission from each contributor to your Entry that allows Aurora to use their name and likeness to promote and advertise all or any of ASFF, your Entry or Aurora. Finalists and winners will make themselves available for publicity appearances whenever Aurora reasonably requests, and agree that Aurora may use all or any part of any statement made by them about the ASFF, their Entry and Aurora for advertising or promoting any or all of the ASFF, their Entry and Aurora. However, Aurora agrees not to use your name or likeness or the name or likeness of any contributor to your Entry in connection with any commercial tie-ups, merchandising or for the direct or indirect endorsement of any product or services except for the commercial or other sponsorship of the ASFF or Aurora, or both. Your personal information Personal information collected from you will be used by Aurora according to Aurora’s Privacy Policy so you can enter and we can administer the ASFF. Without your personal information we are not able to accept your Entry. Subject to some exceptions allowed by law, you may request access to your personal information while we store it. We will assess your request in accordance with the law and tell you why if access is denied. A request to access, update or correct any information should be directed to the Aurora Community Channel, PO Box 408, Crows Nest, NSW, 2065. 5 You expressly agree to the use of your information for this purpose. A copy of Aurora’s Privacy Policy may be accessed at http://www.aurora.tv/index.php?option=com_content&task=view&id=124 Exclusions & limitations of liability To the extent permitted by applicable law, Aurora, its contractors, employees and agents, is not responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, defect, failure of any computer or network, inability to access websites associated with the ASFF, for problems uploading entries or downloading ASFF information or voting or for late, lost, damaged, misdirected, incorrect or incomplete entries or for any injury or damage to your or any other person’s computer related to or resulting from participation in or down-loading any material in this ASFF. To the extent permitted by applicable law, Aurora, its contractors, employees and agents, exclude all liability relating to the ASFF, whether arising in contract, tort (including negligence) or under statute and whether they have been advised or are aware of the possibility of that liability. Without limiting this, Aurora excludes liability for indirect or consequential losses, including loss of profits, loss of revenue, loss of data, and loss of business opportunity. Tax implications may arise from the receipt of a prize. You should seek independent financial advice and in no instance is Aurora liable for any tax liability arising from the award of a prize. Disqualification and cancellation Your Entry may not be accepted or may be disqualified at any time (in Aurora’s sole discretion) if: • it is received after 5.00 pm Australian eastern standard time on the last day of the Competition Period (even if it was transmitted before then); • you have not properly completed the Entry Form; • you have not agreed to the Terms and Conditions of Entry; or • your Entry does not comply with the Terms and Conditions of Entry. If there is an event beyond Aurora’s reasonable control which prevents or hinders the conduct of the ASFF or Aurora’s ability to announce winners, then Aurora may in its discretion cancel, change or suspend the ASFF, or any aspect of it. If this occurs, Aurora reserves the right to deal with Entries received up to the date of the cancellation, change or suspension according to the Terms and Conditions of Entry. Further, Aurora may at its sole discretion recommence the ASFF. 6 Further Assurances You must do everything (including execute necessary document) to give full effect to the Terms and Conditions of Entry. Governing law The Terms and Conditions of Entry are governed by the laws of New South Wales, Australia and you submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Right to Amend Terms and Conditions Aurora reserves the right to amend these Terms and Conditions of Entry and the Terms and Conditions (Summary) as appear at www.aurora.tv from time to time. You are deemed to have accepted these changes from when they appear at www.aurora.tv. Severability Clause Any part of these Terms and Conditions of Entry which is held to be illegal or unenforceable by a court of law will be read down by Aurora to the extent necessary to make that part legal and enforceable. If this is not possible, that part will be severed from the Terms and Conditions of Entry with all other parts remaining in full force and effect. Waiver No failure to exercise and delay in exercising any right, power or remedy by Aurora under these Terms and Conditions of Entry will operate as a waiver unless made in writing by Aurora. Priority In the extent of any actual inconsistency, these Terms and Conditions of Entry take precedence over the Terms and Conditions (Summary). Costs The Entrant is responsible for all costs arising out of, or in connection with, their Entry in the ASFF. Assignment The rights and obligations of the Entrant under these Terms and Conditions of Entry are personal and cannot be assigned, charged or otherwise dealt with. Aurora may assign its rights or transfer its obligations in its absolute discretion. Entire Agreement These Terms and Conditions of Entry contain the entire agreement between Aurora and you with respect to the ASFF. They set out the only conduct relied on by you and supersede any earlier conduct and prior agreements and understandings between the parties in connection with the ASFF. |
