General 1. Information on how to enter the Australian Classic Car Win a Morris Mini Competition (Promotion) and prizes form part of these conditions of entry. 2. By participating in this Promotion, you will be deemed to have accepted these terms and conditions. 3. The promoter is NRMA Open Road Pty Ltd (Promoter) ABN 91 000 026 844 of 9A York St, Sydney, NSW 2000. 4. The Promotion commences at 9am am (AEST) on 1 November 2011 and entries close at 5.30 pm (AEST) on 12 June 2012 (Promotional Period). 5. Entry is open to Australian residents. Persons under 18 years must seek permission to enter from the parent or guardian. How to Enter 6. To enter this Promotion, during the Promotional Period entrants must: Subscribe or renew an existing subscription to Classic Car magazine for a minimum of 12 months (Subscription). Each Subscription will entitle the entrant to one hundred (100) chances to win in the draw. Entry is subject to a valid credit card payment or, if payment is made by cheque, the cheque must be cleared for payment within the Promotional Period. Entrants must order their Subscription bywww.isubscribe.com.au during the Promotional Period and include their name, address, email, telephone number, NRMA Membership number (if relevant) and any other information so requested (Subscription Order). 7. Entrants who enter via receipt of a Subscription as a gift, must consent to their personal information being provided to the Promoter and agree to these Promotion terms and conditions as per clause 8. 8. In the case that the Subscription is ordered as a gift, both the gift recipient and the donor are eligible to enter this Promotion and will receive one hundred (100) entries each into the draw, as long as the donor has: a) received the consent of the gift recipient for their personal information to be provided to the Promoter for the purposes of receiving a subscription to Classic Car and entry into this Promotion, including agreement to these Promotion terms and conditions; and b) provided the gift recipient with the Promoter’s contact details; and c) completed the Subscription Order, including their details as well as those of the gift recipient as so requested (see clause 6); and d) complied with the Subscription payment conditions for this Promotion (see clause 6). 9. This is a game of chance and skill plays no part. Eligibility 10. Employees of the Promoter and its Related Bodies Corporate (as this term is defined in the Corporations Act) and such employees’ immediate family members are not eligible to enter. 11. To protect the integrity of the competition, the Promoter reserves the right, at its sole discretion, to verify, at any time (including after the closing of the Promotion) the validity of all entries (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits invalid, incomplete, indecipherable, or illegible entries or tampers with the entry process or uses any automated entry software or any other mechanical or electronic means that allows repeated illegal entry. 12. Winners who cannot be reached within 3 months at the email address, address or telephone number provided on their entry will unfortunately be disqualified and the winner will be re-selected. Draws and Prizes 13. All draws will take place at DCA, Level 5, 355 Spencer Street, West Melbourne, VIC 3003, at 11am (AEST) on 20 June 2012. 14. The first valid entry drawn from the total number of entries received, will win one (1) 1967 Morris Mini, including 12-months’ on-road registration costs. The prize must be collected by the winner from the Sydney metropolitan area, within 3 months of the draw. If prizewinner is from Victoria or South Australia, the prize includes a one-way economy airfare for the winner only, from the winner’s nearest commercial airport to Sydney to collect the car. Any additional costs involved in getting the car back to the winner’s residence, including airport transfers where relevant, are the responsibility of the winner. 15. The prize is valued at $19,000, as at 12 October 2011, and is correct at time of printing. The Promoter accepts no responsibility for any subsequent variation in the prize value. 16. If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute the prize (or part of the prize) with a prize of equal value or specification, subject to any written directions given by the appropriate State or Territory Lottery Departments. No responsibility or liability is accepted for any variation in the value of the prizes. All prize values are in Australian dollars. 17. The prize is not exchangeable, transferable or redeemable for cash. 18. The winner will be notified by mail by 22 June 2012 and, with their consent, the winner’s name will be published in the August 2012 issue of Australian Classic Car magazine, on sale 11 July 2012 and published online at www.ccar.com.au. Only the winner will receive written notification. 19. If for any reason a winner does not take an element of a prize by the time stipulated by the Promoter, or chooses not to participate in the Promotion, then that prize, or element thereof, will be forfeited. 20. The draw for any unclaimed prizes will take place at 11am (AEST) on 20 September 2012 at DCA, Level 5, 355 Spencer Street, West Melbourne, VIC 3003, subject to any directions from a regulatory authority, and the subsequent winner will be notified by mail by 22 September 2012 and have their name published in the November 2012 issue of Classic Car magazine. Personal Information and Privacy 21. The details contained in your entry are protected by security safeguards as detailed in the Promoter's Privacy Policy, which is available at www.mynrma.com.au. Personal information will only be used in accordance with the the Promoter’s Privacy Policy. The Promoter will also endeavour to provide you with an option to opt out of receipt of such communications. You should direct any request to access, update or correct information to the Promoter. 22. You can contact the Promoter’s Privacy Officer if you would like details of the personal information that the Promoter may hold about you or if you would like it to be corrected. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. 26. Permits The Promoter has obtained the following permits in regard to the Promotion: NSW Permit No. LTPS/11/09761; ACT TP 11/04349; SA T11/2412; Vic 11/2395
