Terms and Conditions

By entering The Morning Show ‘De Longhi’ Promotion (“the Promotion”), you are agreeing to the following terms and conditions:

1.STANDARD TERMS
1.1Information on how to enter forms part of the terms of entry.

2.WHO CAN ENTER?
2.1Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven signal is received.
2.2Employees and their immediate families of Seven Network (Operations) Limited and their associated agencies and companies are not eligible to enter.

3.HOW TO ENTER
3.1The Competition commences on Monday 12 December 2011 at 9.00am (AEDT) and concludes on Friday 16 December 2011 at 2.00pm (AEDT) (“the Competition Period”).
3.2In order to enter the Competition, viewers must watch The Morning Show (“the Program”) on the Seven Network during the Competition Period where there will be a Competition segment aired during the Program (or any replacement program broadcast in The Morning Show timeslot). 
3.3Viewers must log into The Morning Show website (www.yahoo7.com.au/morning) between Monday 12 December 2011 at 9.00am (AEDT) and Friday 16 December 2011 at 4.30pm (AEDT) and register their entry details (name, address, telephone number) online to enter.
3.4Only one entry per person per day will be accepted from entrants online. No scripting is allowed for online entries (which will be deemed invalid).
3.5The time of entry for online entrants will be the time at which the completed online entry form is received by the Competition online database. 
3.6Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.

4.PRIZES
4.1There will be one (1) daily winners of the Competition (a total of 5 winners throughout the Competition Period). The prize winners will receive:

TOTAL VALUE PRIZE $17,995
Total Combined Prize Value is: AU$17,995 (including GST). Prize value is correct as of 18 November 2011. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the time of the draw.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize Sponsor’s requirements. Unless otherwise stated in these terms and conditions, prizes cannot be transferred or exchanged and all non-cash prizes cannot be redeemed for cash.
In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. 
In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
The winners agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation. 
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter accepts no responsibility for any variations in the value of the prize as quoted in the terms and conditions and the ultimate travel date. 
Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.
If the winner is under the age of 18 as at the date of the determination of winners, the prize will be awarded to their parent or legal guardian as nominated by the winner.

HOW TO WIN
There will be one (1) daily winners of the Competition (a total of five (5) throughout the duration of the Competition Period). Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the prize draw. 
The draws will take place at MNET Group Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 on Monday 19 December 2011 at 4.00pm (AEDT).
5.3The winners may be announced in the Programs following the prize draw (subject to programming and Executive Producer’s decision). Winner will be notified in writing and by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper on Wednesday 28 December 2011. 
5.4The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.5It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the promoters in its absolute discretion.
5.6Subject to State legislation an unclaimed prize draw will take place at MNET Group Ltd at Level 1, 16 Anster Street, Adelaide SA 5000 on Monday 2 April 2012 at 10.00am (AEST) and the winner will be notified in writing and by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper of The Australian newspaper on Monday 9 April 2012.
NO LIABILITY
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to State Legislation.
Seven Network (Operations) Limited & affiliates, MNET Group Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
Seven Network (Operations) Limited & affiliates, MNET Group Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
during the draw;
whilst undertaking any travel won on or connected with their entry into the draw; or
in the participation in any prize;
as a consequence of late, lost or misdirected mail; 
due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;
arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Promotion;
if any flight is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; or
due to circumstances outside the Promoter’s reasonable control.
6.4The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements, subject to State legislation.
6.5The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
6.6Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.7If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State legislation.
