COMPETITION

TERMS AND CONDITIONS
1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City
Road Southbank, Victoria 3006.
2. Instructions on how to enter form part of the conditions of entry. The judge’s decision is
final and no correspondence will be entered into.
3. Entry is only open to residents of Victoria. Employees of the Promoter and their
immediate families, directors, management, related companies, and their agencies
associated with this promotion are ineligible. Immediate family means any of the
following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or
by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,
nephew, brother, sister, step-brother, step-sister or first cousin.
4. To enter, readers must SMS 197 197 22 with their name, address and phone number.
SMS cost 55 cents including GST.
5. The competition commences Sunday December 18, 2011 at 00:01am (AEDT) and
concludes at 11:59pm (AEDT) that same day (“the Competition Period”).
6. Multiple entries accepted provided that each entry is submitted separately in accordance
with the entry instructions. SMS entries via internet or computer generation are invalid
and will not be accepted.
7. The SMS entry mechanic is only open to readers with an SMS compatible mobile phone
connected to a service provider which permits text messaging to the promotional SMS
number. It is recommended that entrants check with their individual service provider in
this regard. For SMS help call 1300 131 276.
8. The time of entry will in each case be the time the SMS message is received by Salmat
IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060.
9. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late
or misdirected entries.
10. The major winner will be the first valid entry drawn at random from the pool of valid
entrants. The next four valid entries will receive runner up prizes. The draw will take
place at 10.00 am (AEDT) on 19/12/2011 at Salmat IDR, Level 2, 116 Miller Street, North
Sydney, NSW 2060.
11. If the winner of any prize is under the age of 16 years, the prize will be awarded to the
winner’s nominated parent or guardian. Entrants under the age of 16 years must obtain
the prior permission of a parent or guardian who is over the age of 16 years before
entering the competition.
12. The major winner will be notified by phone call, writing and their name will be published
in the Herald Sun Public Notices on 22/12/11. Runners up will be notified by mail.
13. The major winner will receive ten Rod Laver Arena ‘day session’ tickets to the Australian
Open semifinals on Thursday January 26, 2012 valued at $1799.
Four runners up will be allocated a double pass to a single session at Hisense Area.
Runner up tickets will be allocated as follows;
a) The first runner up drawn will receive a double pass to the day session (from 11am) at
Hisense Area on Saturday January 21 valued at $99.80.
b) The second runner up drawn will receive a double pass to the night session (from 7pm) at
Hisense Area on Saturday January 21 valued at $99.80.
c) The third runner up drawn will receive a double pass to the day session (from 11am) at
Hisense Area on Sunday January 22 valued at $99.80.
d) The forth runner up drawn will receive a double pass to the day session (from 11am) at
Hisense Area on Monday January 23 valued at $99.80.
14. Transport to the event and any additional costs are the responsibility of the prize
winner/s.
15. All tickets are issued subject to the Australian Open Ticket Conditions of Sale and Entry.
16. Tickets will be mailed to winners. Allow 10 days for delivery. The Promoter and Tennis
Australia accept no responsibility for any lost, damaged or misdirected mail resulting in
the loss of tickets.
17. The prize is not exchangeable and cannot be taken as cash. The Promoter accepts no
responsibility for any variation in the prize value.
18. In the event that a winner does not take the prize at the time and place stipulated, then
the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is
not-transferable, non-refundable and non-redeemable for other goods or services and
cannot be taken as cash.
19. The Promoter reserves the right to verify the validity of entries and to disqualify any
entry which, in the opinion of the Promoter, includes objectionable content, profanity,
potentially insulting, inflammatory or defamatory statements, disqualify any entrant who
tampers with the entry process, who submits an entry that is not in accordance with
these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged
in conduct in entering the promotion which is fraudulent, misleading, deceptive or
generally damaging to the goodwill or reputation of the promotion and/or Promoter. The
Promoter reserves the right to disqualify a winner if the Promoter becomes aware that
the winner and/or the winner’s entry is of a type described in this clause.
20. If for any reason, this competition is not capable of running as planned, including due to
infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical
failures or any other causes beyond the reasonable control of the Promoter which corrupt
or affect the administration, security, fairness, integrity or proper conduct of this
promotion, the Promoter reserves the right, in its sole discretion, to disqualify any
individual who tampers with the entry process, take any action that may be available and
to cancel, terminate, modify or suspend the competition subject to any written directions
given under State Legislation.
21. To the full extent permitted by the law, the Promoter and Tennis Australia Limited (the
promoter of the Australian Open) exclude liability for any loss, damage or injury
whatsoever suffered or sustained (including, but not limited to direct, indirect, special or
consequential loss or damage, loss of opportunity revenue or profit) arising directly or
indirectly out of or in connection with this promotion, including attendance at the venue.
22. The Promoter and Tennis Australia accept no responsibility if the event is cancelled, or
the date is re-scheduled for any reason whatsoever. If the prize or any part of the prize
becomes unavailable for reasons beyond the Promoters’ control, the Promoter will
endeavor but is not obliged to provide a substitute prize of equivalent value.
23. The Promoter collects entrants’/claimants’ personal information in order to conduct the
promotion. If the information requested is not provided, the entrant/claimant may not
participate in the promotion. The Promoter may share entrants’/claimants’ information
with persons or entities assisting in the conduct of the promotion and with companies
who are prize partners. By participating in the promotion, unless otherwise advised, each
entrant/claimant also agrees that the Promoter may use this information to contact the
entrant/claimant by any means (including SMS or e-mail) at any time in the future to let
them know about goods, services and promotions which may be of interest to them
without any further reference, payment or other compensation to the entrant/claimant. If
