Information on how to enter the Canon Island Facebook promotion “the Promotion” and prizes form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions. 2. In order to be eligible to enter the promotion, the individual must be an “Eligible Entrant”. An Eligible Entrant is an Australian resident who is a Facebook user and: (a) is not an employee of the Promoter or agencies associated with the promotion; (b) is not an immediate family member of an employee as specified in clause 2 (a). 3. The prize is a Canon Powershot SX 40 HS valued at $599.00 RRP (“Prize”). 4. To enter the Promotion Eligible Entrants must visit and like the Canon Facebook Page at www.facebook.com/CanonAustralia (“Promotional Website”) and (a) vote for one of the competition images during the Voting Period; and (b) answer the following question: For your chance to win a Powershot SX 40 HS, tell us in 25 words or less which island you’d most like to photograph and why? (“Entry”). 5. The Promotional Website will commence at 09:00am on 5 December 2011 and ends at 5:00pm Australian Eastern Daylight Standard Time (AEDST) on 1 March 2012 (“Promotional Period”). The Promoter reserves the right to extend the Promotional Period at its discretion. Only those entries that are received during the Voting Period will be considered. 6. Visitors to the Promotional Website will, by following instructions contained in the website, be able to vote for the photograph of their choice. Eligible Entrants may vote up to five times in total by voting once in each of the competition challenge phases. However, only the latest Entry (as set out in clause 4(b)) is counted for the judging process at the end of the Voting Period. Voting will be open from 09:00am on 20 December 2011 and ends at 5:00 pm AEDST on 1 March 2012 (“the Voting Period”). 7. The Eligible Entrant whose Entry is judged best to answer the prescribed question by the close of the Voting Period will be declared the Winner. Each entry will be individually judged based on its originality and creativity. The Canon Judge -- appointed by the Promoter as being suitably qualified -- will select based on originality and creativity, the Winner. The judge’s decision is final and no correspondence will be entered into. This judging process will take place on 12 March 2012. 8. The Winner will be notified by email prior to the announcement on Canon’s platforms. The Winner will also be announced on the Canon Australia Page on Facebook (http://www.facebook.com/CanonAustralia). The Promoter reserves the right to publish the Winner’s name, vote, Entry, town and state The Eligible Entrant acknowledges that the Promoter may publish their vote and Entry for any purpose connected to (i) conducting or (ii) promoting, this Promotion or any other related promotions (including, but not limited to, the Canon Island promotion). This includes displaying any part of the Entry on the Promotional Website or any other related websites or internet applications controlled by the Promoter. The Promoter will use best endeavours to attribute the Eligible Entrant for their Entry. 9. The Promoter reserves the right, at any time, to verify the validity of votes and entries and Eligible Entrants (including an Eligible Entrant's identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request an individual establish that they are eligible, and may also request that they sign a statutory declaration confirming compliance with these terms and conditions. The Promoter reserves the right to request Eligible Entrants provide proof of identity, residency, and age. Proof considered suitable for verification is at the discretion of the Promoter. 10. Entrants are solely responsible and liable for the content of their entries and vote and any other information they transmit to other internet users. All entries are subject to the www.facebook.com website prevailing terms and conditions of use (available at http://www.facebook.com/promotions_guidelines.php). The Promoter may delete any content posted on its site (including, but not limited to the Canon Australia Facebook Page) in accordance with the Promoter’s prevailing terms and conditions of use of its site. Any entries that are removed by the Promoter will not be considered Eligible Entries for the purposes of this promotion. The Promoter is not responsible and excludes all liability (to the greatest extent allowable by law) for the content of any entries submitted for the purposes of this promotion (including but not limited to any illegal, incorrect or inaccurate content and third party advertising). 11. Entrants acknowledge that they are providing their entry information to the Promoter and not to Facebook. Entrants release and indemnify Facebook from any liability solely occurring as a result of this Promotion. The Promoter reserves the right to disqualify any vote or entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. 13. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification. 14. The Prize is not transferable or exchangeable and cannot be taken as cash. 15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate. 16. Any cost associated with accessing the Promotional Website is the entrant's responsibility and is dependent on the Internet service provider used. 17. The use of any automated entry software or any other mechanical or electronic means that allows an entrant or voter to automatically enter repeatedly is prohibited and will render all entries or votes submitted by that entrant or voter invalid. The Promoter reserves the right to determine this in its absolute discretion. 18. Except for any liability that cannot be excluded by law, including but not limited to the Australian Consumer Law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, photograph or prize claim or vote that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. For the avoidance of doubt, nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act. 19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian authorities. Entry and voting is conditional on providing this information. Eligible Entrants or voters should direct any request to access, update or correct information to the Promoter. By participating in the Promotion as an Eligible Entrant you consent, until you advise the Promoter otherwise, to receive future marketing communications from the Promoter for an indefinite period, including via electronic communications. 20. These terms and conditions are governed by the laws in NSW. The Entrants submit to the non-exclusive jurisdiction of the Courts of NSW. 21.
